• AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH APPROVING AN AMENDMENT TO RECLASSIFY PROPERTY
LOCATED AT 1800 -06 WEST BALBOA BOULEVARD FROM THE TWO
FAMILY RESIDENTIAL DISTRICT TO THE RETAIL AND SERVICE
COMMERCIAL DISTRICT AND TO AMEND THE HEIGHT LIMITATION
ZONE MAP TO PLACE THE SUBJECT PROPERTY INTO THE 26/35
HEIGHT LIMITATION ZONE (PLANNING COMMISSION AMENDMENT

WHEREAS, an application has been filed proposing the reclassification of the property located at
1800 -1806 West Balboa Boulevard from the Two Family Residential (R -2) District to the Retail and Service
Commercial (RSC) District; and
WHEREAS, the City Council of the City of Newport Beach has adopted General Plan Amendment
98 -1 (A) and Local Coastal Program Land Use Plan Amendment Number 50 to change the land use
designation of the subject property from Two Family Residential to Retail and Service Commercial; and
WHEREAS, that the proposed reclassification of the subject property from the Two Family
• Residential (R -2) District to the Retail and Service Commercial (RSC) District is necessary to implement these
land use changes; and
WHEREAS, the Zoning Code requires that the 26/35 Height Limitation Zone shall apply to all zoning
districts, other than R -1, R -1.5, R -2 and MFR, within the area known as the Shoreline Height Limitation Zone;
and
WHEREAS, on April 9, 1998, the Planning Commission of the City of Newport Beach held a public
hearing regarding this amendment; and
WHEREAS, on May 11, 1998, the City Council of the City of Newport Beach held a public hearing
regarding this amendment; and
WHEREAS, the public was duly noticed of the public hearings; and
WHEREAS, pursuant to the California Environmental Quality Act, it has been determined that the
• proposed amendment is categorically exempt under Class 1, existing facilities.
THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY ORDAIN AS FOLLOWS:
• SECTION 1: Districting Map Number 9 shall be amended to read as provided in attached Exhibit
SECTION 2: The City of Newport Beach Height Limitation Zone Map shall be amended to place the
property identified in Exhibit `B" in the 26/35 Height Limitation Zone as depicted in Exhibit "C."
SECTION 3: The Mayor shall sign and the City Clerk shall attest to the passage of this
Ordinance. This Ordinance shall be published once in the official newspaper of the City, and the same shall
become effective thirty (30) days after the date of its adoption.
This Ordinance was introduced at a regular meeting of the City Council of the City of Newport Beach
held on April 27, 1998, and adopted on the I I th day of May, 1998, by the following vote, to wit:
