• ORDINANCE NO. 99- 28 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF NEWPORT BEACH APPROVING <br />AMENDMENT NO. 890 AMENDMENT TO THE <br />KOLL CENTER PLANNED COMMUNITY DISTRICT <br />TO INCREASE THE PERMITTED GROSS FLOOR <br />AREA FOR OFFICE SITE "A" BY 15,000 SQUARE <br />FEET. <br />(AMENDMENT NO. 890) <br />WHEREAS, on November 18, 1999, Planning Commission of the City of <br />Newport Beach held a public hearing regarding this amendment, and recommended <br />approval to the City Council; and <br />WHEREAS, the public was duly noticed of the public hearings; and <br />WHEREAS, the City Council finds that the proposed amendment to the <br />Kell Center Planned Community District Regulations is consistent with the General Plan; <br />and <br />• WHEREAS, on December 13, 1999, the City Council of the City of <br />Newport Beach held a public hearing regarding this amendment at which time <br />amendments to the Kell Center Newport Planned Community District Regulations were <br />discussed and determined to be in conformance with the "Administrative, Professional and <br />Financial CommerciaP' designation of the Newport Beach General Plan, and the City <br />Council finds that the proposed amendment does not alter the professional office character <br />of the subject property or the Kell Center Newport Planned Community District as a whole; <br />and the proposed amendment to increase the permitted gross floor area for Office Site "A" <br />by 15,000 square feet is consistent with the General Plan, and <br />WHEREAS, the Newport Beach Municipal Code provides specific <br />procedures for the implementation of Planned Community zoning for properties within the <br />City of Newport Beach; and <br />WHEREAS, the City of Newport Beach has determined that the proposed <br />project will not have a significant effect on the environment upon implementation of the <br />• mitigation measures set forth in the Negative Declaration prepared for the project pursuant <br />to the California Environmental Quality Act (CEQA) and the State CEQA Guidelines; and <br />
