ORDINANCE NO. 2000- 3 <br />• AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF NEWPORT BEACH APPROVING <br />AMENDMENT NO. 897 TO THE KOLL CENTER <br />PLANNED COMMUNITY DISTRICT TO DESIGNATE <br />PARCEL 1 OF KCN RETAIL AND SERVICE SITE 1 <br />FOR HOTEL USE, ESTABLISH THE PERMITTED <br />GROSS FLOOR AREA FOR KCN RETAIL AND <br />SERVICE SITE 1 AT 120,000 SQUARE FEET, AND <br />ESTABLISH THE PERMITTED HEIGHT FOR THE <br />SITE AT 60 FEET. <br />(PLANNING COMMISSION AMENDMENT NO. 897) <br />WHEREAS, on December 9, 1999, Planning Commission of the City of Newport <br />Beach held a public hearing regarding this amendment, and recommended approval to the <br />City Council; and <br />WHEREAS, the public was duly noticed of the public hearings; and <br />WHEREAS, the City of Newport Beach has determined that the proposed project <br />will not have a significant effect on the environment upon implementation of the mitigation <br />• measures set forth in the Negative Declaration prepared for the project pursuant to the <br />California Environmental Quality Act (CEQA) and the State CEQA Guidelines; and <br />WHEREAS, on January 11, 2000, the City Council of the City of Newport Beach <br />held a public hearing regarding this amendment at which time amendments to the Koll <br />Center Newport Planned Community District Regulations were discussed and determined to <br />be in conformance with the "Retail and Service Commercial' designation of the Newport <br />Beach General Plan, and the City Council finds that the proposed amendment does not alter <br />the character of the subject property or the Koll Center Newport Planned Community <br />District as a whole; and the proposed amendment to increase the allowable gross floor area <br />for Parcel 1 of Retail and Service Site 1 by 17,890 square feet is consistent with the <br />General Plan; and <br />WHEREAS, the City Council finds that the proposed amendment to the Koll <br />Center Planned Community District Regulations is consistent with the General Plan; and <br />WHEREAS, the Newport Beach Municipal Code provides specific procedures for <br />• the implementation of Planned Community zoning for properties within the City of Newport <br />Beach; and <br />
