HomeMy WebLinkAbout2000-22 - Adopting Sign Regulations and Design Guidelines for Commercial Properties on the Balboa Peninsula and Related Amendments to Title 20 of the Newport Beach Municipal Code [Amendment 907].ORDINANCE 2000 -22 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ADOPTING SIGN REGULATIONS AND DESIGN GUIDELINES FOR COMMERCIAL PROPERTIES ON THE BALBOA PENINSULA AND RELATED AMENDMENTS TO TITLE 20 OF THE NEWPORT BEACH MUNICIPAL CODE [AMENDMENT 9071 WHEREAS, the City of Newport Beach desires to update the sign regulations for commercial properties on the Balboa Peninsula; and WHEREAS, the City Council of the City of Newport Beach appointed a steering committee to oversee the drafting of the new sign regulations; and WHEREAS, on September 21, 2000, the Planning Commission of the City of Newport Beach held a public hearing on the proposed sign regulations; and • WHEREAS, the Planning Commission of the City of Newport Beach voted unanimously to recommend approval of the Balboa Sign Overlay to the City Council; and WHEREAS, on October 24, 2000, the City Council of the City of Newport Beach held a public hearing regarding this amendment; and WHEREAS, the public was duly noticed of the public hearings; and WHEREAS, pursuant to the California Environmental Quality Act, it has been determined that the proposed amendment is categorically exempt under Class 5, minor alterations in land use limitations. THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: The Balboa Sign Overlay as provided in Exhibit "A" is hereby adopted. • SECTION 2: All signs in commercial districts on the Balboa Peninsula shall be subject to the regulations contained in the Balboa Sign Overlay. • SECTION 3: Sections 20.43.050, 20.45.035, and 20.67.010 of Title 20 of the City of Newport Beach Municipal Code" shall be revised to read as provided in Exhibit `B." SECTION 4: Districting Maps 2, 3, 4, 8, 9, 10, 11, and 12 shall be revised to identify the Balboa Sign Overlay. SECTION 5: The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. This Ordinance shall be published once in the official newspaper of the City, and the same shall become effective thirty (30) days after the date of its adoption. A sign that expresses local character. 1. Purpose and Intent This Chapter provides supplemental standards for on -site signs in the commercial areas on Balboa Peninsula. The provisions of this Chapter are intended t0: A. Encourage creative, fun, and well - designed signs that contribute in a positive way to Balboa Peninsula's visual environment, express local character, and develop a distinctive image. Predictable and mediocre signs will be strongly discouraged. A creative and tun sign. B. Encourage signs that are responsive to the aesthetics and character of their particular location on the Peninsula. Signs should be compatible and integrated with the building's architectural design and with other signs on the property. C. Recognize that many businesses on the Peninsula are small, non- franchise establishments. These businesses depend on their sign's clear communication to bring in customers. By providing more permitted sign types and choices, small businesses may more successfully deal with limited funds and time. D. Providethe meansof approval for unique sign concepts and programs. E. To provide merchants with a way to effectively communicate without creating sign clutter. Page y City of Newport Beach Applicability Balboa Sign Overlay dt. Applicability ill. Relationship to Chapter 2®.67 and Other Chapters A. The sign regulations provided in this Chapter are intended.to apply to on -site signs in the commercial districts on Balboa Peninsula. Certain types of signs authorized in this Chapter may only be employed on Balboa Peninsula. B. The Sign Design Standards (Section XVII) shall be used to evaluate Sign Permit applications to ensure that signs are well designed, compatible with their surroundings and the proposed use, and do not detract from the overall visual quality of the Peninsula. City of Newport Beach A. The following regulations represent an overlay or "supplemental" provisions to the base Sign Code in Newport Beach (Chapter Z ®.67). When the provisions of this Chapter and the base Sign Code conflict, the provisions of this Chapter shall apply. B. In addition to the regulations of this Chapter and the base Sign Code, the provisions of Chapter 15.16 relating to building codes, sign permits, fees, penalties, and a method of enforcement shall apply. Where a use permit, variance, modification permit, or site - plan review procedure has been used, any applicable conditions of that approval shall supercede this Chapter. Definitions This Chapter contains a comprehensive section of definitions, including the definitions contained in Chapter 20.67. A. Abandoned Sign. A sign which no longer identifies or advertises a bona fide business, lessor, service, owner, product, or activity, and/or for which no legal owner can be found. B. A- Frame Sign. A freestanding portable sign usually used on public sidewalks. These signs are usually small and are removed at the close of business. Typically hinged at the top, or attached in a similar manner, and widening at the bottom to form a shape similar to the letter A. Typically constructed of wood, metal, or plastic. other similar devices. This also includes any type of electronically controlled changeable copy signs. D. Awvins£ Signs. A sign painted on, printed on, or attached flat against the surface of an awning. E. Back -Lit Awning. An internally illuminated, fixed, space -frame structure with translucent, flexible, fabric reinforced covering designed in awning form and with graphics or copy applied to the visible surface of the awning. A sign identifying the architect, engineer, designer, contractor, developer, lending institution, or future occupant of a construction project. L. Copy. The graphic content of a sign surface in either permanent or removable letter, pictographic, symbolic, or alphabetic form. M. Directory Sis n. A sign listing the tenants or occupants of a building or building complex. N. Directional/Information Sign. An on- premise sign giving directions, instructions, or facility information of an establishment but no advertising copy, e.g., parking orexit and entrance signs. O. Display Surface. The area made available by the sign structure for the purpose of displaying the advertising copy. P. Doubie -raced Siyrn. A sign designed with the intent of providing copy on both sides. A sign which does not meet the requirements of this code and which is not a legal non - conforming status as defined in definition AA. AA. Illuminated Sign. Holiday window painting such as for Christmas and Halloween shall be permitted and exempt from window sign limitations. However, such painting shall contain no reference to named goods or services. In addition, all such decorations shall be removed within 10 days of the applicable holiday. 11. Window signs indicating that an establishment is "Open" or "Closed" for business, maximum two square feet in area, and no more than one sign per business frontage. They shall be considered accessory window signs and shall not be included in incidental window sign area calculations. V11. Text Versus Graphics. In the case where the text and a graphic contained in this Sign Overlay occur, the text shall always take precedence over the graphic. A sign permit shall be required for all signs permitted under the provisions of this chapter. B. The wilding Director is authorized to issue all sign permits which comply with the provisions of this Chapter after review by the Planning Director. The Planning Director shall review all sign permit applications for conformance with the design guidelines of this Chapter, Newport Sign Code - Chapter 20.67, and Chapter 15.16 relating to building codes, sign permits, and method of enforcement.
