ORDINANCE NO. 2001 -12 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF NEWPORT BEACH APPROVING A ZONING <br />AMENDMENT INCREASING THE MAXIMUM <br />ALLOWABLE BUILDING SQUARE FOOTAGE IN OFFICE <br />SITE B OF THE KOLL CENTER NEWPORT PLANNED <br />COMMUNITY [ZONING AMENDMENT 9051 <br />WHEREAS, Koll Center Newport Number A ( "Developer'), 1900 Main Street, Suite 350, <br />Irvine, California, has applied to the City of Newport Beach ( "City") for a General Plan <br />Amendment (GPA 97 -3(B)) and a Zoning Amendment for "Office Site B" of the Koll <br />Center Newport (KCN) Planned Community in order to allow future additional <br />development on Parcel 1 of PMB 114/22 -24 and Parcels 1, 2, and 7 of PMB 181/13 -19; <br />and <br />WHEREAS, the proposed Amendment to the Koll Center Newport Planned Community <br />text would increase the maximum allowable building floor area in KCN Office Site B to a <br />total of 1,201,349 net square feet while eliminating restaurant and retail - service uses; <br />and <br />WHEREAS, on August 3 and September 7, 2000 and June 7, 2001, the Planning <br />Commission held duly- noticed public hearings, and, at the conclusion of the hearing and <br />after considering the evidence and arguments submitted by the City staff, Developer, <br />and all interested parties, adopted a resolution recommending that the City Council <br />approve the Zoning Amendment; and <br />WHEREAS, on June 26, 2001, the City Council held a public hearing and considered <br />the Zoning Amendment, the recommendation of the Planning Commission, and the <br />evidence and arguments submitted by the City staff, Developer, and all interested <br />parties a notice of time, place and purpose of the public hearing was duly given and <br />testimony was presented to and considered by the City Council at the public hearing. <br />THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY ORDAIN <br />AS FOLLOWS: <br />SECTION 1: ENVIRONMENTAL REVIEW. Pursuant to CEQA and the CEQA <br />Guidelines, an Environmental Impact Report (EIR) has been prepared for this project. <br />After reviewing the EIR, all comments received during the public review process, and all <br />responses to those comments, the City Council has certified the EIR as complete, <br />reflecting the independent judgment of the City of Newport Beach. All records pertaining <br />to preparation, review, and comment on the EIR are retained in the Planning <br />Department of the City of Newport Beach. <br />SECTION 2: FINDINGS.
