to the City Council with a recommendation of adoption, subject to certain <br />amendments; and <br />h. On October 10, 2000 and June 26, 2001, the City Council of the City of Newport <br />Beach held duly- noticed public hearings regarding the proposed Development <br />Agreement, and testimony was presented to and considered by the City Council; and <br />i. Pursuant to the California Environmental Quality Act (CEQA), the City has <br />completed an Initial Study, determined that the impacts of the subject Development <br />Agreement have been fully evaluated in previously certified Environmental Impact <br />Reports, that the conditions to the preparation of a Subsequent or Supplemental EIR <br />do not exist, and that a Negative Declaration is appropriate; and <br />j. The Development Agreement will preserve the benefits of years of land use planning <br />and open space- habitat preservation efforts, while establishing ultimate City control <br />of the area. <br />SECTION 2. Development Agreement No. 14, attached hereto as Exhibit A, is hereby adopted. <br />SECTION 3. The Mayor shall sign and the City Council shall attest to the passage of this <br />Ordinance. This Ordinance shall be published once in the official newspaper of the City, and the <br />same shall become effective thirty (30) days after the date of its adoption. <br />This Ordinance was introduced at a regular meeting of the City Council of the City of Newport <br />Beach held on July 10, 2001, and adopted on July 24, 2001 by the following vote, to wit: <br />
