ORDINANCE No. 2001 -18 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />NEWPORT BEACH APPROVING A CODE AMENDMENT, <br />INCLUDING A REVISED SUBDIVISION CODE (TITLE 19 OF <br />THE MUNICIPAL CODE) AND ACCOMPANYING <br />AMENDMENTS TO TITLES 13 AND 20 <br />[CODE AMENDMENT 2001 -0021 <br />WHEREAS, the City has initiated a Code Amendment to overhaul its subdivision <br />regulations and to make corresponding changes to other portions of the Municipal Code; and <br />WHEREAS, pursuant to the California Environmental Quality Act (CEQA), the City staff <br />has completed an Initial Study, determined that the subject amendments will not have a significant <br />effect on the environment, and has accordingly prepared a draft Negative Declaration for the Code <br />Amendment; and <br />WHEREAS, on May 17, June 21, and July 19,200 1, the Planning Commission of the City of <br />Newport Beach held a worksession and a public hearing regarding the proposed Code Amendment <br />and forwarded it to the City Council with a recommendation of adoption; and <br />WHEREAS, on August 28, 2001, the City Council of the City of Newport Beach held a <br />public hearing, at which time the proposed Code Amendment was considered. A notice of time, <br />place and purpose of the public hearing was duly given and testimony was presented to and <br />considered by the City Council at the public hearing. <br />THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY ORDAIN AS <br />FOLLOWS: <br />SECTION 1: ENVIRONMENTAL REVIEW. <br />a. Pursuant to CEQA Guidelines Section 15063, an Initial Study has been prepared for <br />this project. After reviewing the Initial Study, the proposed Negative Declaration, and <br />all comments received during the public review process, the City Council finds that the <br />subject project will not have a significant effect on the environment and accordingly <br />
