ORDINANCE NO. 2001-3 <br />A ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT <br />BEACH APPROVING AMENDMENT NO. 909 TO AMEND THE <br />ZONING DISTRICT MAP TO ESTABLISH A 4 -FOOT, FRONT YARD <br />SETBACK FOR THE BAYSIDE DRIVE FRONTAGE THE PROPERTY <br />LOCATED AT 2720 & 2730 BAYSIDE DRIVE. <br />WHEREAS, Section 20.94 of the Municipal Code of the City of Newport Beach <br />provides that Title 20 (Zoning Code) may be amended by changing the zoning designation of <br />Districts and other provisions whenever the public necessity and convenience and the public <br />welfare require such an amendment; and <br />WHEREAS, Section 20.94.020 of the Newport Beach Municipal Code provides that <br />amendments to amend Title 20 must be approved by a Resolution of the Planning Commission <br />setting forth full particulars of the amendment; and, <br />WHEREAS, in conjunction with the consideration of the subject amendment to the Zoning <br />Code , the proposed project has been determined to be Categorically Exempt under the Class 3 <br />(New Construction or Conversion of Small Structures) requirements of the California <br />Environmental Quality Act (CEQA), and the State CEQA Guidelines; and, <br />WHEREAS, pursuant to Section 20.94, the Planning Commission has held a duly <br />noticed public hearing on February 8, 2001 and on February 22, 2001 to consider Amendment <br />No. 909 to establish a 4 -foot, front yard setback for the Bayside Drive frontage the property <br />located at 2720 & 2730 Bayside Drive, legal description being Lots 1 & 3 of Block 333 of the <br />Corona Del Mar Tract as modified by NBLLA No. 81 -1; and, <br />WHEREAS, pursuant to Section 20.94, the City Council has held a duly noticed public <br />hearing on March 27, 2001 and on April 10, 2001 to consider the adoption of Amendment No. <br />909. <br />THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DOES HEREBY <br />ORDAIN AS FOLLOWS: <br />Section 1: The Zone Districting Map of the City of Newport Beach shall be amended to <br />establish a 4 -foot, front yard setback for the Bayside Drive frontage the property located at 2720 <br />& 2730 Bayside Drive, legal description being Lots 1 & 3 of Block 333 of the Corona Del Mar <br />Tract as modified by NBLLA No. 81 -1. <br />Section 2: The Mayor shall sign and the City Clerk shall attest to the passage of this <br />Ordinance. This Ordinance shall be published once in the official newspaper of the City, and the <br />same shall become effective thirty (30) days after the date of its adoption. <br />
