AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH MODIFYING THE BOUNDARIES OF COUNCIL DISTRICT 7
WHEREAS, Section 1005 of the City Charter provides that, in the event of
an annexation of territory, the City Council shall, by ordinance, add the
annexed territory to an adjacent Council District; and
WHEREAS, on January 1, 2002, the areas commonly known as Newport
Coast and Newport Ridge were annexed to the City of Newport Beach
(Annexed Area); and
WHEREAS, the Annexed Area is depicted on the map attached as Exhibit
A; and
WHEREAS, the City Council has entered into an agreement with certain
residents of the Annexation Area that, among other things, contained
commitments that the Annexation Area would remain within a single
Council District until after the next general municipal election (November
2002); and
WHEREAS, the City Council has determined that the Annexed Area shares
the greatest community of interest with the residents of Council District
7 in that both the Annexed Area and the area currently encompassed by
Council District 7 are primarily residential communities with very limited
commercial development; and
WHEREAS, the City Council has determined that adding the entire
Annexed Area to Council District 7 is consistent with the provisions of
the Newport Beach City Charter and is in the best interests of all of the
residents of Newport Beach.
NOW, THEREFORE, the City Council of the City of Newport Beach does
ordain as follows:
SECTION 1: The Annexed Area as depicted in Exhibit A shall, in
its entirety be added to Council District 7 until such time as the City
Council adopts a subsequent ordinance altering the boundaries of the
Council Districts.

SECTION 2: If any section, subsection, sentence, clause or
phrase of this ordinance is, for any reason, held to be invalid or
unconstitutional, such decision shall not affect the validity or
constitutionality of the remaining portions of this ordinance. The City
Council hereby declares that it would have passed this ordinance, and each
section, subsection, clause or phrase hereof, irrespective of the fact that
any one or more sections, subsections, sentences, clauses and phrases be
declared unconstitutional.
SECTION 3: The Mayor shall sign and the City Clerk shall attest
to the passage of this ordinance. The City Clerk shall cause the same to be
published once in the official newspaper of the City, and it shall be
effective thirty (30) days after its adoption.
SECTION 4: This ordinance was introduced at a regular meeting
of the City Council of the City of Newport Beach, held on the Stn day of
January, 2002, and adopted on the 22nd day of January, 2002, by the
following vote, to wit:
AYES, COUNCILMEMBERS O'Neil, Bromberg, Glover, Proctor,
Mayor Ridgeway
NOES, COUNCILMEMBERS Heffernan, Adams
ABSENT COUNCILMEMBERS None
