Section 1. Resolved: That the public interest and conven- ience require, and that it is the intention of the Board of Trustees of the City of Newport Beach, to order certain public work or improvement to be done. Section 2. Resolved: That the work to be done, or improve- ment to be made, shall be, and is described as follows, to -wit: That a portion of First Street of the City of Newport Beach, sh be vacated, abandoned and closed; and also that ac certain alley in said city, be vacated, abandoned and closed: That the portion of First Street so to be va- cated, abandoned and closed, is described as follows, to -wit: Commencing at a point, being the Southwesterly corner of Lot 12 in Block 1 of East Newport as the same appears upon a map recorded in Book 3 at page 37, Miscellaneous Maps, Records of Orange County, California; thence Westerly pursuing the northerly line of Central Avenue, Fifty (50) feet to the South- easterly corner of Lot 1 in Block 3 of said East Newport; thence northerly pursuing the easterly line of said Lot 1, Thirty (303 feet to the Northeasterly corner of said Lot l; thence easterly fifty (50) feet to the northwesterly corner of Lot 12 in Block 1 of said East Newport; thence southerly thirty (30) feet to the point of beginning. That the alley to be so vacated, abandoned and closed, is described as follows, to -wit: Commencing at a point, being the Northwesterly corner of Lot 15 in Block 3 of East Newport, as the same appears upon a map recorded in Book 3 at page 37, Miscellaneous Maps, Records of Orange County, California; thence southerly seventy (70) feet to the southwesterly corner of said Lot 15; thence wes- terly pursuing the northerly line of Central Avenue, ten (10) feet to the southeasterly corner of Lot 14 in said Block 3; thence northerly one hundred and fifty (150) feet to the northeasterly corner of Lot 10 in said Block 3; thenceeasterly pursuing the southerly line of Bay Avenue inssaid city, tre (10) feet to the northwesterly corner of Lot 9 in said -1- l 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Block 3; thence southerly seventy (70) feet to the southwesterly corner of said Lot 9 in Block 3 of said East Newport Section 3. Resolved: That the work to be done and improve- ment made, consists in closing, vacating and abandoning the portion of said First Street; and of said alley in said City of Newport Beach, and that no land is deemed necessary to be taken therefore; and that no damages, costs or expenses will accrue therefrom; and that it is unnecessary to create or form any dis- trict of land, which will be affected or benefited by said work, or to be assessed to pay the damages, costs and expenses thereof. Section 4. Resolved: That the Street Superintendent of the City of Newport Beach shall cause to be'conspicuously posted alon the line of said contemplated work.or improvement, at not more than 300 feet in distance apart, but not less than 3 in all, . notices of the passage of this resolution. Said Notices shall be headed: "Notice of Public Work" in letters not less than one inch in length, and shall be in legible characters; state the fact of the passage of this resolution, its date and briefly, the work or improvement proposed, and shall refer to this reso- lution for further particulars. Section 5. Resolved, That Whereas, no daily newspaper is published and circulated in the City of Newport Beach, that the Street auperintendant',of said City, shall cause a Notice similar in substance to be published in the "Newport News ", a weekly newspaper, published and circulatedin said city, by four suc- cessive insertions in said "Newport News "; which "Newport News" is hereby designated as the weekly newspaper, published and cir- culated in the City of Newport Beach, for the publication of said Notice. -2- 11 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 The above and foregoing Resolution was passed and adopted at a regular meeting of the Board of Trustees of the City of Newport Beach, held on the 7th day of September, A.D. 1909 by the following vote: AYES: C. A. Barton, J. Ferguson, J. McMillan, A. N. Smith. NOES: None ABSENT:C F. W. Beckwith The above and foregoing Resolution of Intention No. 18 is approved this 7th day of September, 1909. ATTEST: L. S.
