HomeMy WebLinkAbout32 - 36th Street Improvements• 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 COPY RESOLUTION OF INTE* ON NO. 32 COPY A resolution by the Board of Trustees of the City of New- port Beach declaring that the public interest and also the public convenience require, and that it is the intention of the said Board to establish the grade of, and to order work done or im- provements made upon portions of certain streets in the City of Newport Beach, referring to said streets by the names by which they are commonly known, briefly describing the work to be done or improvements to be made, diredting the publication of this Resolution of Intention and designating the newspaper in which such publication shall be madeg and ordering notices posted. The Board of Trustees of the City of Newport Beach do re- solve and declare that the public interest and also the public convenience require, and that it is the intention of said Board of Trustees to order that the grades be established and certain work be done or improvements made upon portions of certain streets in the City of Newport Beach, which streets are referred to in this resolution of Intention by the name by which they are com- monly known. Section 1: Resolved that the portion of streets upon which it is the intention of the Board of Trustees of the City of Newport Beach to order the grade established and work to be done or improvements made and the name by which such streets are commonly known are as follows: (a) All that portion of 36th Street in the City of New- port Beach which extends from the northerly curb line of Ocean Avenue to the Southerly line of the right of way of Los Angeles Interurban Railway Company, and also that additional portion of the said 36th Street which extends from the northerly line of the right of way of Southern Pacific Company to the southerly line of the Rivo Alto canal. (b) All that portion of 37th Street in the City of Beach which extends from the northerly line of the right of way of Southern Pacific Company to the Southerly curb line of Bay Avenue, and also all that additional portion of the said 37th Street which extends from the southerly line, if extended weste of Lot 8 in Block 136 of River Sections Newport Beach, as shown -1- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 upon a map thereof recorded in Book 4, page 25, Miscellaneous Maps, Orange County records, to the southerly curb line of Lake Avenue. (c) All that portion of 38th Street in the City of Newport Beach which extends from the northerly line of the right of way of Southern Pacific Company to the southerly curb line of Lake Avenue. (d) All that portion of Bay Avenue in the City of Newport Beach which extends from the westerly line of 32nd Street, if ex- tended southerly, to the easterly line of 38th Street. (e) All that portion of Lake Avenue in the City of Newport Beach which extends from the Westerly line of 36th Street to the westerly line of 38th Street. Section 2: Resolved that it is the intention of the Board of Trustees of the City of Newport Beach to order the grade where - ever the same has already been established to be changed and where no grade has been established then the same to be established, so that the official grade of that portion of 36th, 37th, 38th Street Lake Avenue, and Bay Avenue mentioned and described in Section 1 of this Resolution of Intention shall be as follows' All grades are expressed in feet and tenths of feet and are based upon a datum plane bench mark, which bench mark is at the southwest corner of the cement sidewalk in front of the build- ing of the State Bank of Newport at Newport Beachq California, the elevation of which bench mark is 11.55 feet above low water in the Pacific Ocean. Bay Avenue on the southerly side at the intersection thereof by 32nd Street, the grade shall be 11.4 feet. At the intersection thereof by 33rd Streetq the grade shall be 12 febt. At the intersection thereof by 36th Street, the grade shall be 1011 feet. At the intersection thereof by 37th Street, at the south- easterly corner of said intersection, the grade shall be 8.71 feet. On the southwesterly corner of said intersection by 37th Street the grade shall be 8.41 feet. At the intersection thereof by 38th Street, the grade shall be 7.35 feet. Bay Avenue on the northerly side at the intersection there of by 32nd Street, the grade shall be 11 feet. At the intersection thereof by 33rd Street, the grade shall be 11.57 feet. At the intersection thereof by 34th Street, the grade shall be 11.57 feet. At the intersection thereof by 35th Street, the grade shall be 11.57 feet. At the intersection thereof by 36th Street, the grade shall be 9.66 feet. At the intersection thereof by 37th Street, the grade shall be at the northeasterly corner of said intersection 8.71 feet. And at the northwesterly corner of said intersection, the grade shall be 8.41 feet. At the intersection thereof by 38th Street, the grade j shall be 7.35 feet. Lake Avenue at the intersection thereof by 36th Street the grade shall be 8.16 feet. At the intersection thereof by 37th Street, the grade shall be 7.56 feet. At the southerly line of Los Angeles Inter -urban right of way the grade shall be 12.9 feet. At the northerly line of right of way of Southehn Pacific Company, the grade shall be 11.4 feet. At the intersection thereof by Bay Avenue, on the south- erly side of said intersection, the grade shall be 10.1 feet. On the northerly side of said intersection, the grade shall be 9.66 feet. At the intersection thereof by Lake Avenue, the grade I be 8.16 feet. 37th Street - -at the northerly line of right of way of Southern Pacific Company, the grade shall be 10.83 feet. At the intersection thereof by Bay Avenue on the easterly side of said intersection the grade shall be 8.71 feet. On the westerly side of said intersection the grade shall be 8.41 feet. At the southwesterly corner of Lot 8, Block 136, of River Section, Newport Beach, as shown on a map thereof recorded in Book 4, page 25, Miscellaneous Maps, records of Orange County, the grad shall be 8.14 feet. At the intersection thereof by Lake Avenue, the grade I be 7.56 feet. 38th Street - -at the northerly line of right of way of Southern pacific Company, the grade shall be 10.26 feet. At the intersection thereof by Bay Avenues the grade shall be 7.35 feet. At the intersection thereof by River Avenue, the grade shall be 7.25 feet. At the intersection thereof by Lake Avenue, the grade shall be7.25 feet. 1 2 3 4i 5, 61 7 8 9, 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Section 3: Resolved that the work to be done or improve- � ments made is briefly described as follows: (a) That all that portion of 36th -37th -38th Streets, Lake Avenue and Bay Avenue, mentioned and described in Section 1 of this Resolution of Intention be graded by cutting and filling the sand or other natural soil of which said portions of.said streets are composed, to a sub -grade six inches below the official grade to be established as designated in Section 2 of this Resolution of Intentions and then capped with a crown of earth suitable to be made solid by tamping and rolling, which crown of earth shall be six inches thick, tamped and rolled to a true, even and solid surface, conforming to the official grade. (b) That a cement sidewalk and cement curb be constructed upon and along both sides of that portion of said 36th- 37th -38th- Streets, Lake Avenue and Bay Avenue mentioned and described in Section 1 of this Resolution of Intention. That the cement side- walks and cement curbs be constructed upon(.the sidewalk reserva- tion provided for for said streets by Section 1 of Ordinance 24 of the City of Newport Beach, and shall be constructed adjoining, along and parallel with the property line upon said portion of said streets. That upon Bay Avenue and Lake Avenue the cement sidewalk shall be 32' feet in width, and immediately outside of said side- walk there shall be reserved a strip of land 2 feet in width for the planting of trees, shrubs and plants, and immediately outside of said 2 ft. strip of land there shall be a cement curb six inches thick, That the cement sidewalk to be constructed upon that por- tion of 36th -37th -38th- Streets mentioned in Section 1 of this Resolution of Intention shall be five feet in width, provided however that the outer six inches of said sidewalk, being the six inches next to the street line, shall consist of the curb -5- • 1 2� 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 so that the sidewalk and curbs when constructed, shall wholly cover the sidewalk reservation provided for streets of the width of 36th -37th -38th Streets by Section 1 of Ordinance No. 24 of the City of Newport Beach. Whenever any portion of the streets mentioned upon which work is to be done or improvements made, shall be intersectedby a street or alley, then the sidewalks to be constructed shall be considered cross - walks, and shall be reduced or increased in width so that the cross -walks or walks across the intersecting streets or alleys shall be 4 ft. in width, and the curb shall not be carried across said intersecting streets or alleys; but on either side of said intersecting streets or alleys the curb shall be re- turned from the street line to the outer edge of the cross -walk on a curve, the radius of which curve shall be five feet, and the crosswalks shall be sloped or tapered by an apron from the surface of the sidewalk to the surface of the street. (c) The cement sidewalk shall be constructed as follows: The earth foundation shall be filled in and tamped solid to such a height as when surfaced shall conform to the grade established; the cement surfacing of said sidewalk shall consist of a founda- tion layer 2z inches thick of concrete composed of seven parts of fine, clean gravel to one part of best Portland cement, one -half inch thick composed of equal parts of clean, sharp sand and best Portland cement, to be floated and troweled to a true, even sur- face, sloping towards the streets in the ration of 3 /16ths of an inch fall to each foot in width of the sidewalks. (d). All aprons by which sidewalks are tapered at inter- sections shall be composed of like materials as sidewalks, except that the surface of the aprons shall be left rough. (e) The curbs shall consist of a core ten inches thick at the bottom, six inches thick at the top, and fifteen inches deep, set with the batter towards the street, and the top, when finished, M 1 I LA 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 1. in line with the sloping surface of the walk. Such top and the upper ten inches of the batter of street surface to be dressed one -half inch thick with the same finish as required for the sur- face of sidewalks. Section 4: There is excepted from the operation of this resolution of intention, any of said grading construction of said sidewalks and curbs, where the grading has already been done and the cement sidewalks and curbs constructed, upon the line and to the official grade of that portion of the streets mentioned and designated in Section 1 of this Resolution of Intention. Section 5: This Resolution of Intention shall be publi twice in the "Newport News" a weekly newspaper published and cir- culated in the City of Newport Beach, which "Newport News ", is hereby designated for that purpose. Section 6: The Street Superintendent bhall, immediately after the adoption of this Resolution of Intention, cause to be conspicuously posted along the line of said contemplated work or improvement, at not more than three hundred feet in distance apart but not less than three in all, notices of the passage of this res olution, of intention; said notices shall be headed: 11% tice of Improvement" in letters of not less than one inch in length and shall, in legible characters, state the fact of the passage of this Resolution of Intention, its date, and briefly, the work or improvement proposed, and refer to this Resolution of Intention fof further particulars.
