HomeMy WebLinkAbout74 - Improvements within the City• ti ti 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 COPY RESOLUTION OF COPY INTENTION NO. 74 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECIA RING THAT THE PUBLIC INTEREST AND ALSO THE PUBLIC CONVENIENCE REQUIRES AN IM- PROVEMENT TO BE MADE WITHIN THE BOUNDS OF SUCH DITY, DECLARING ITS INTENTION TO ORDER THE IMPROVE- MENT TO BE MADE, DESCRIBING THE IMPROVEMENT, THE IA ND DEEMED NECESSARY TO BE TAKEN THEREFOR SPECIFYING THE EXTERIOR BOUNDARIES OF THE LISTRICT OF LANDS TO BE BENEFITED BY SAID IMPROVEMENT AND TO BE ASSESSED TO PAY THE DAMAGES, COST AND EXPENSES THEREOF, DIRECTING THE GIVING OF NOTICE, AND DESIG- NATING THE NEWSPAPER IN WHICH NOTICE SHALL BE PUBLISHED The Board of Trustees of the City of Newport Beach, as the City Council thereof, do hereby resolve and declare as follows; Section 1. Resolved; that the public interest and also the public convenience requires that an improvement be made at and within the bounds of the City of Newport Beach and that it is the intention of said Board of Trustees of the City of Newport Beach, as the City Council of said city, to order such improvement made. Section 2. Resolved, that the improvement to be made shall, consist of and is described asfbllows:- That Central Avenue within the bounds of the City of Newport Beach from a point of the intersection of the southerly line of Central Avenue and a line which is 22.05 feet westerly of and par- allel with the southerly prolongation of the westerly line of 'IF" Street to the southerly prolongation of the easterly line of "L" Street, as said "F" and ^L °1 Streets are laid out and shown upon a map of East Side Addition to the Balboa Tract, which map is recorder in Miscellaneous Maps, Book 4, page 20, Orange County records, be widened to a uniform width of seventy (70) feet and Central Avenue be thence opened and extended easterly from the easterly line of said "L" Street and the southerly prolongation of said easterly line of said "L" Street, hereinbefore mentioned, the center line of the portion of Central Avenue to be opened and extended easterly is described as,- beginning at a point, which point is hereby desig- nated Station 1, and is 28.99 feet westerly of the common corner of !Sections 35 and 36, Township 6 South, Range 10 West, and Sections 1 -1- 11 2�i 3 _ 4 5 I 6 71 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 z 30 31 32 :J and 2, Township 7 South, Range 10 West, San Bernardino Meridian, said Station 1 being in the section line between Sections 35, Township 6 South, Range 10 West, and Section 29 Township 7 South, Range 10 West, San Bernardino Meridian; thence due east 846.39 feet to a point, which point is hereby designated Station 2, said portio of Central Avenue to be opened and extended easterly to have a uni- form width of seventy (70) feet, the northerly and southerly bounda lines of which shall be thirty -five (35) feet southerly and north - erly of and parallel with the said center line hereinbefore de- scribed, and Central Avenue be thence opened and extended south- easterly, the center line of the portion of Central Avenue to be opened and extended southeasterly is described as,- beginning at the point hereinbefore designated Station 2 thence pursuing a curve of which curve Station 2 is the beginning, said curve having a (radius of 920.4 feet and a length of 452.2 feet, to a point hereby designated Station 3, which point is the end of the aforesaid curve and is south 290 4' 30" East 447.66 feet from the point here - inbefore designated as S }ation 2; the beginning of said curve; thence south 150 East 1067.8 feet to the ordinary high water mark of the Pacific Ocean, said portion of Central Avenue to be opened and extended southeasterly to have a uniform width of seventy (70 feet, the easterly and westerly boundary lines of which shall be 35 feet easterly and westerly of and parallel with saidscenter line hereinbefore described. Section 3. Section 4. Resolved, that a district of lands will be ben- efited by the making of said improvement and that the exterior boundaries of the district oflands to be benefited, and which will be benefited by the making of said improvement and to be assessed to pay the damages, cost and expenses thereof are specified as: All of the land situate in the City of Newport Beach, County of Orange, State of California, located within and bounded by the following specified exterior boundaries, to -wit:- Beginning at the intersection of the center line of Main Street and the northerly line of Surf Avenue, as said Main Street and Surf Avenue are laid out and shown on a map of the Balboa Tract as recorded in Miscellaneous Maps, Book 4, page 11, Orange County Records, thence easterly along the northerly line of the said Surf Avenue to a point in the northerly line of said Surf Avenue, which point is 212.94 feet easterly of the easterly line of "E" Street, ias laid out and shown on a map of the East Side Addition to the Balboa Tract, as recorded in Miscellaneous Maps, Book 4, page 20, Orange County Records; thence westerly along the northerly line of said Block 13 to the northwesterly corner of Lot 1 of said Block 13; thence westerly across "A" Street to the northeasterly corner of Lot 7, Block 11 of the aforesaid Map of the Balboa Tract; thence Southerly along the center line of said Main Street to the intersection of the center line of Main Street and the northerly line of Surf Avenue, the place of beginning, excepting therefrom any part of any public street or alley. Section 5. Resolved, that the street superintendent of the City of Newport Beach shall cause to be conspicuously posted ialong the line of the said contemplated improvement at not more than three hundred feet in distance apart, but not less than three in all notices of the passage of this Resolution; said notices shal be headed "Notice of Public Work" in letters not less than one inch in length, shall be in legible characters, state the fact of passag of this resolution, its date, and briefly the improvement proposed, and shall refer to this Resolution for further particulars. There being no daily newspaper published and ciruclated in the City of Newport Beach, the Street Ouperintendent of the City of Newport Beach shall also cause a notice similar in substance to be published in the "Newport News ", a weekly newspaper published and circulated in the City of Newport Beach, by four successive in- sertions in said Newport News, which newspaper is hereby�bsignated for that purpose. The foregoing Resolution of Intention No. 74 was passed by ,the Board of Trustees of the City of Newport Beach as the City Council of said City, at a regular meeting thereof held this 9th day of April, 1917, by the vote of the following named members of said Board of Trustees, to wit: Ayes, Trustees: S. R. Jumper, Glenn Helms, H. A. Robinson, J. C. McCain, George P. Wilson.
