HomeMy WebLinkAbout79 - Ocean Avenue Improvements• 1 �I 2 If N 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 RESOLUTION NO. 79 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT BEACH, AWARDING THE CONTRACT FOR CERTAIN WORK ON CERTAin PORTIONS OF OCEAN AVENUE IN THE CITY OF NEWPORT BEACH WHEREAS, the Board of Trustees of the City of Newport Beach did on the 16th day of April, 1917, duly adopt a Resolution No. 76 ordering the following work to be done: That Ocean Avenue, within the said City, from the southerly prolongation of the westerly line of_'Twemty -third Street to the southerly prolongation of the easterly line of Thirty -sixth Street by the construction of a board walk on pile bents on that portion of said Ocean Avenue lying between the northerly line of said Ocean Avenue and a line twelve (12) feet southerly of and parallel with the northerly line of said Ocean Aveiuej including all street and alley intersections, be constructed to official line and grade according to Plans No. 100 and 101 on file in the office of the City Engineer of Newport Beach, Californiag and in further accord- ance with Specifications Numbered 26, adopted by Resolution No. 65 of the Board of Trustees of the City of Newport Beach and on file in the office of the City Clerk of said City. That the said contemplated work of improvement of the por- tion of said Ocean Avenue is, in the opinion of the said Board of Trustees of the City of Newport Beach, of more than local or ordinary public benefit and they declare that the exterior bound- aries of the lands to be benefited by said improvement and to be assessed to pay the costs and expenses of said improvement shall be as follows: Beginging at the intersection of the southerly prolongati of the center line of Thirty -sixth Street and the southerly line ofOcean Avenue; thence easterly along the southerly line of said Ocean Avenue to a point of the intersection with the center line of the Southern Pacific Railroad CompanYls right of way, said right of way being 100 feet in width; thence northwesterly along -1- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 the center line of the said right of way of the Southern Pacific Railroad Company to a point of the intersection with the northerly prolongation of the center line of Thirty- second Street; thence southerly along the center line of said Thirty- second Street to a point of the intersection with the easterly prolongation of the northerly line of Block 332 of a Map of the Canal Section, New- port Beachq as recorded in Miscellaneous Mapsq Book 49 page 989 Records of Orange County, California; thence westerly in a straigh line along the northerly lines of Blocks 332, 3339 334 and 335 of the aforesaid Map of the Canal Section, Newport Beachq to the center line of Thirty -sixth Street; thence southerly along the center line of said Thirty -sixth Street to the southerly line of Ocean Avenueq the place of beginning, excepting therefrom lands forming part of any public street or alley. The total expense of all Aork done in constructing said im- provements, as described in the Resolution of Intention, shall be assessed on the lots and parcels of land lying within the limits of the assessment districtq described in Section Two of the Reso- lution of Intention. The City Engineer is hereby directed to make a diagram of the property affected or benefited by the proposed work of improve ment, as described above, and to be assessed to pay the expense thereofq Such diagram shall show each separate lot, piece or parcel of landq the area of each of said lots, pieces or parcels of land and the relative locations of the same to tIm work propose to be doneq all within the limits of said assessment district. A plat of the said district above described has been ap- proved by the City Council of theCity of Newport Beach, which plat indicates by a boundary line the extent of the territory to be included in the said assessment district, and the same is now on file in the office of the City Engineer of the said City and ref- erence to said plat is hereby made. -2- �1 r 1 That the proceedings for the aforesaid improvement shall 2 I be had and taken under an act of the Legislature of the State of 3 California, entitles "An Act to provide for work upon streets9 4 lanes, alleys, courts9 placesq and sidewalksg and for the con - 20 To FRED HOFFMAN at the prices specified in his proposal �� 5 struction of sewers within municipalitiesq" approved March 18thq 6 1885 (Commonly known as the Vrooman Act), and under all acts sup- 7 plementary thereto or amendatory thereof. 8 AND WHEREAS9 by said Resolution the City Clerk was directed 9 to publish and post a notice inviting proposals for doing said 10 work, as required by law and the time for opening said bids was 11 fixed at 8 P.M. of Monday the 28th day of May, 1917- 12 AND WHEREAy, the Board of Trustees of the said City of New - 13 port Beach in open session on the 28th day of May 19179 has public 14 opened, examined and declared all sealed proposals or bids offered 15 for the aforesaid work. 16 NOW THEREFORE, be it resolved by the said Board of Trustees 17 that the said Board hereby rejects all of said bids except the 18 next herein mentioned and hereby awards the contract for said work 19 to the lowest, regulars responsible bidder therefore to wit: 20 To FRED HOFFMAN at the prices specified in his proposal 21 on file for said work, to wit: 22 Board Walk on Wooden Pile Bentsq per lineal foot complete $3.25. 23 AND BE IT FURTHER RESOLVED, that the City Clerk is hereby 24 directed to post notice of this award conspicuously for five days 25 I on or near the Council Chamber door of the Board of Trustees of 26 said Cityq and also to publish said notice by one insertion in the 27 Newport Newsq aweekly newspapers printedg published and circulated N28 in said cityq and hereby designated therefore. 29 Passed by the Board of Trustees of the City of Newport 30 Beach at their regular meeting held on the 28th day of May, 1917.
