HomeMy WebLinkAbout91 - Surf Avenue Improvements1 2 3 4 5 6 7 8 4 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 w 32 RESOLUTION NO. 91 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT BEACH, AWARDING THE CONTRACT FOR CERTAIN WORK ON CERTAIN PORTIONS OF SURF AVENUE WITHIN THE SAID CITY OF NEWPORT BEACH. WHEREAS, the Board of Trustees of the City of Newport Beach did on the 7th day of January, 1918, duly adopt a Resolution bo. 90 ordering the following work to be donee That Surf Avenue within the said City, from the westerly line of the ,Alley situated between Block 2 of the Newport Bay Tract, as recorded in Map Book 4, page 16, Records of Orange County, California, and Block 4 of the Balboa Tract as recorded in Map Book 49 page 11, Records of Orange Countyq California, and the southerly prolongation of the said westerly line of said Alley to a line which is 180 feet easterly of and parallel with the easterly line of E Street, by the construction of a board walk on wooden pile bents on that portion of said Surf Avenue lying be- tween the northerly line of said Surf Avenue and a line twelve (12 feet southerly of and parallel with the said northerly line of Surf Lvenue, including all street and alley intersections, be con- structed to official line and grade, in accordance with Plans No. 104 and 105 and on file in the office of the City Engineer of said City of Newport Beach, and in further accordance with specif`icatio numbered 26, adopted by Resolution N 65 of the Board of Trustees n of the City of Newport Beach and on file in the office of the City Clerk of said City. That the said contmeplated work or improvement of the por- tion of said Surf Avenue, is, in the opinion of the said Board of Trustees of the City of Newper t Beach,.of more than local or ord- inary public benefit and they declare that the exterior boundaries of thelands to be benefited by said improvement and to be assessed to pay the costs and expenses of said improvement shall be as follows: Beginning at a point, which point is at the intersection of the northerly prolongation of the westerly line of Lot 59 -1- F] • 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Block 2 of a Map of the Nekp ort Bay Tract as recorded in Map Book 49 page 169 Records of Orange County, Californiag and the center line of the Alley in said Block 2 of the Newport Bay Tract; thence easterly along the center line of the aforesaid alley to the intersection of said center line with the center line of the alley situated between the aforesaid Block 2 of the Newport Bay Tract and Block 4 of the Balboa Tractq as recorded in Map Book 4, page 11, Records of Orange County', California; thence southerly along the center line of the last mentioned alley to a point which is 100 feet northerly of the northerly line of Surf Avenue, as said Surf Avenue is shown and laid out upon a Map of the Balboa Tract, as hereinbefore described; thence easterly in a straight line 100 feet northerly of and parallel with the aforesaid northerly line of Surf Avenue to a point in the center line of A Street; thence easterly in a straight line to the northwesterly corner of Lot 159 Block 14 of the aforesaid Map of the Balboa Tract; thence easterly in a straight line to a point in the center line of B Street, which point is 104.05 feet southerly ofthe center line of Central Avenueq and measured along the center line of the afore- said B Street; thence northerly along the center line of B Street to its intersection with the center line of Central Avenue; thence easterly along the eenter line of Central Avenue to a point at the intersection with the northerly prolongation of the easterl, line of Lot 6, Block 22 of the aforesaid Map of the Balboa Tract; thence southerly along the northerly prolongation of the aforesaid easterly line of said Lot 6, and along the easterly line of said Lot 69 and the southerly prolongation of the said easterly line .of said Lot 6 to its intersection with the southerly line of Surf Avenue; thence westerly along the southerly line of said Surf Avenue to the intersection of the southerly prolongation of the westerly line of Lot 5, Block 2 of the aforesaid Map of the Newpor Bay Tract; thence northerly Along the southerly prolongation of th -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 aforesaid westerly line of Lot 59 Block 2, and along the westerly line of said Lot 5, and along the northerly prolongation of the said westerly line of Lot 5 to its intersection with the center line of the aforesaid Alley in Block 2 of the aforesaid Map of Newport Bay Tract, the place of beginning; excepting therefrom any portion of any public street or alley. The City Engineer is hereby directed to make a diagram of the property affected or benefited by the proposed work or improv ment as described in the Resolution of Intention, and to be assessed to pay the expenses thereof, said diagram to be made as required by law. The said Board of Trustees determines that serial bonds shall be issued to represent each assessment of $25,00 or more for the costs of said work or improvement; said serial bonds shall ex- tend over a period of nine years from the 2nd day of January next succeeding the date of said bonds and shall bear interest at the rate of seven per centum per annUm, and an even annual pro- portion of the principal sum thereof shall be payable by coupon on the 2nd day of January of each year after their dates until the whole is paidg and the interest shall be payable semi - annually by coupon on the second days of January and July respectively of each year at the rate of seven per centum per annum on all sums unpaid until the whole of said principal and interest have been paid. All of the proceedings for the aforesaid improvement and for the issuance of said bonds shall be taken under and in accor- dance with the provisions of an Act of the Legislature of the State of California, known and designated as the "Improvement Act of 1911," and all acts amendatory thereof. AND WHEREAS, the Board of Trustees of the said City of Newport Beach in open session on the 4th day of February, 1918, has publicly opened, examined and declared all sealed proposals or bids offered for the aforesaid work. NOW, THEREFORE9 BE IT RESOLVED9 by the said Board of Trus- tees, that the said Board hereby rejects all of said bids except the next herein mentioned and hereby awards the contract for said work to the 11lowest, regular, responsible bidder thereBor, to wits TO W. M.LEDBETTER AND CO. at the prices specified in their proposal on file for said work, to wits Board Walk on wooden pile bentsq per lineal foot 4$ .95 ANDI BE IT FURTHER RESOLVED, that the City Clerk is hereby directed to post notice of this award conspicuously for five days on or near the Council Chamber door of the Board of Trustees of said City, and also to publish said notice by two in- sertions in the Newport News, a weekly newspapers printed, pub- lished and circulated in said City, and which is hereby designated for that purpose.
