RESOLUTION NO. 99
A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEW ORT
BEACH, DECLARING THEIR INTENTION TO IMPROVE CERTAIN PORTIONS OF
CENTRAL AVENUE AND OThER STREETS, ALLEYS, AND RIGHTS OF WAY WITH*
IN THE SAID CITY, AND ALSO CERTAIN PORTIONS OF RIGHTS OF WAY AND
PROPERTY OWNED BY SAID CITY, SITUATED OUTSIDE OF AN ADJACENT TO
THE CORPORATE BOUNDARY LINES OF SAID CITY, FORMING AN ASSESSMENT
DISTRICT OF LANDS WITHIN THE SAID CITY TO BE BET%EFITTED BY AND
TO PAY THE COSTS AND EXPENSES OF SAID PROPOSED IMPROVEMENTS AND
DETERMINING THAT BONDS SHALL BE ISSUED TO KREPRESENT THE COSTS
THEREOF, UNDER THE IMPROVEMENT ACT OF 1911.
The Board of Trustees of the City of Newport Beach do resolve
as follows:
SECTION ONE
That the public interest and convenience require and it is the
intention of the Board of Trustees of the City of Newport Beach
to order the following work to be done, to wit:
That cement pipe sanitary sewers be constructed in the follow-
ing locations:
Ins along and over th right of way and property owned by the
said City of Newport Beach, from a point in the receiving basin
of pumping station No.l, which point is 613 feet, North 6 degrees,
9 minutes East of the intersection of the center lines of Rail-
road Avenue and 36th. Street; thence in along and over said righ t
of way and property owned by said City, and across the Santa Ana
River and in Railroad Avenue, Sotith 6 degrees, 9 minutes West,
613 feet to the intersection of the center lines of Railroad
Avenue and 36th. Street and in Railroad Avenue from the last
mentioned point to the intersection of the center lines of Rail-
road Avenue and 32nd. Street;
And in 32nd. Street form the intersection of the center lines
of Railroad Avenue and 32nd. Street, sotthwesterly to the center
line of the first alley northeasterly of Ocean Avenue;
And in Pacific Avenue from the center line of 32nd. Street
northwesterly to the center line of 36th. Street:
And in 33rd. Street from the center line of racific Avenue,
southwesterly to a point 115 feet southwesterly of the center
line of the Coast Boulevard;

And in 38th. Street from the intersection of the cneter line
of said 38th. Street and the center line of the first alley
southwesterly of Lake Avneue, southwesterly to a point which is
210 feet wouthwesterly of the center line of the Coast Boulevard;
And in 39th. Street from the center line of River Avenue,
south - westerly to a point 36C feet southwesterly of the center
line of the Coast Boulevard;
And in 4Cth. Street from the center line of River Avenue,

west of the intersection of the center lines of Central Avenue
and Washington Avenue thence from said point Sotth 33 degrees,
53 minutes East, 258 feet to the intersection of the center lines
of Central Avenue and Washington Avenue; thence in Central Avenue
from the last mentioned point to the intersection of the center
line of 21st. Street;
And in Central Avenue along the North Drive from the center
line of 21st. Street• easterly to the center line of Ninth Street;
And in Central Avenue along the northerly side of said Central
Avenue from the center$ line of Ninth Street, easterly to a point

feet easterly of the center line of E Street;
All of the aforesaid cement pipe sanitary sewers shall be
constructed across all street and alley intersections or portions
thereof, between the points, on the grades, at the elevations and
along the lines of said sewers, together with manholes, cast iron
frames and covers, and other appurtenarc es, all as shown upon the
plans and profiles of said sewers, numbered consecutively from
200 to 242, both inclusive, adopted by Resolution No. 98 of the
Board of Trustees of the City of Newport Beach, and on file in the
office of the City Engineer of said City, and in further accordanc
with Specifications No. 27, adopted by Resolution No. 97 of,the
Board of Trustees of said City and on fislb in the office of the
City Clerk of said City.

Reference is hereby made to said plans and profiles, and to
said specifications for a more complete and particular description
of said work.
Section Two
That the pxblic interest and convenience require and it is
the intention of the Board of Trustees of the City of Newport
to order the following work to be done to wit:
That a reinforced concrete septic tank, together with
building, and other appurtenances; also a reinforced concrete
pumping station, designated as Pumping Station No. 1, together
with building, motors, pumps and other appurtenances; also a sludg
bed, together with pipes and other appurtenances, all shall be
constructed in accordance with plans and profiles, numbered
2399 24og 241 and 242, adopted by Resolution No. 98 of the Board
of Trustees of said City, and on file in the office of the City
Engineer of said City, and in further accordance with Specificati
No. 27, adopted by Resolution No. 97 of the Board of Trustees of
said City and on file in the office of the City Clerk of said
City, and on the following described property owned by the City
of Newport Beach and situated outside of the Corporate boundary
lines of the said City to wit: Beginning at a point in the west-
erly line of the Southern Pacific Railroad Company's right of way
which point of beginning is 2716.11 feet North and 2669.56 feet
blest of the Common Corner of Sections 27, 289 33 and 34 of Town-
ship 6 South, Range 10 West, San Bernardino Meridian; thence
North 80 degrees, 21 minutes West, 403.90 feet to a point; thence
North 17 degrees, 33 minutes East, 276.26 feet to a point; thence
South 72 degrees, 27 minutes East, 175 feet to a point; thence
South 17 degrees, 33 minutes West, 70.25 feet to a point; thence
South 80 degrees, 21 minutes East, 227.24 feet to a point in the
westerly line of the Southern Pacific Railroad Company's Right
of Way; thence along the westerly line of said Right of Way,

South 17 degrees, 33 minutes west, 181.73 feet to a point, the
place of beginning; also on the following described right of way
owned by said City and situated outside of the Corporate boundary
lines of the said City, beginningat a point in the southerly

line of the last <.bove described property, which point is 283 feet
North 80 degrees, 21 minutes West of the southeasterly corner of
the last above described property; thence from said point along
the center line of a strip of land 10 feet in width, South 9
degrees, 39 minutes West, 140 feet to the ordinary hight water
line of the Santa Ana River, which line is also the northerly
boundary line of said City. The easterly and westerly boundary
lines of said strip of land are 5 feet easterly and westerly of
parallel with the above described center line .
Also that a reinforced concrete pumping station, designa
as Pumping Station No. 2, together with motors, pumps and other
appurtenances shall be constructed at the intersection of 14th
Street and North Drive of Central Avenue, in accordance with Plan
No. 237, adopted by Resolution No. 98 of the Board of Trustees
of $aid City and on file in the office of the City Engineer of
said City, and in further accordance with Specifications No. 27,
adopted by Resolution Nc. 97 of the Board of Trustees of said
City, and on file in the office of the City Clerk of said City.
Also that a reinforced concrete pumping station, desig-
nated as Pumping Station No. 3, together with motors, pumps and
other appurtenances shall be constructed at the intersection of
A Street and Central Avenue, in accordance with Plan No. 238,
adopted by Resolution No. 98 of the Board of Trustees of said
City, and on file in the office of the City Engineer of said
City, and in further accordance with Specifications No. 27,
adopted by Resolution No. 97 of the Board of Trustees of said
City and on file in the office of the City Clerk of said City.

That the said contemplated work or improvement in the
opinion of said Board of Trustees is of more than local or ordin-
ary public benefit and the said Board of Trustees makes the expe .
of said work or improvement chargeable upon the district herein-
after described and declares that the district in said City of
Newport Beach benefited by said work or improvement is described
as follows:
All that portion of the City of Newport Beach included
within the following described exterior boundary lines:
Beginning at a point,kfiich point is the northeasterly
corner of Lot 7, Block B of a Map of the East Side Addition to
the Balboa Tract, as recorded in Map Book 4, page 20 Recrods of
Orange Coui.ty, California; thence westerly along the southerly
line of Bay Avenue, as said Bay Avenue is laid out and shown upon
the aforesaid Map of the East Side Addition to the Balboa Tract,
and along the northerly lines of Blocks 28, 27, 26, 25, 24, 23,
21, 19, 17 and 15 of the aforesaid East Side Addition to the
Balboa Tract, to the northwesterly corner of Block 15 of the
aforesaid East Side Addition to the Balboa Tract; thence westerly
across B Street to the northeasterly corner of Block 13 of the
Balboa Tract as recorded in Map Book 4, page 11, Records of

to the United States or to the State of California.
Section Four.
The City Engineer is hereby directed to make a diagram of
the property affected or benefitted by the proposed work or im-
provement as described in this Resolution of Intention, and to be
assessed to pay the expenses thereof, said diagram to be made as
required by law.
Section Five.
The said Board of Trustees determines that serial bonds
shall be issued to represent each assessment of $25.00 or more
for the costs of said work or improvement; said serial bonds shal
extend over a period of nine years from the 2nd day of January
next succeeding the date of said bonds and shall bear interest at
the rate of seven per centum per annum, and an even annual pro-

portion of the principal sum thereof shall be payable by coupon
on the 2nd day of January of each year after their date until the
whole is paid, and the interest shall be payable semi - annually
by coupon on the second days of Jnauary and July respectively of
each year at the rate of seven per centum per annum on all sums
unpaid until the whole of said principal and interest have been
paid.
Section Six
It is hereby determined and notice is hereby given that
any and all persons having an objection to the proposed work or
improvement above mentioned may appear before the said Board of
Trustees on the 22nd day of July, 1918, at the hour of 7:30
o1clock P.M. of said day at the regular meeting place of said
Board of Trustees in the City Hall of said City, and show cause
why said proposed improvement should not be carried out in accor-
dance with this Resolution.
Section Seven
All of the proceedings for the aforesaid improvement and
for the issuance of said bonds shall be taken under and in accor-
dance with the provisions of an Act of the Legislature of the
State of California, known and designated as the "Improvement
Act of 191111 and Acts amendatory thereof.
Section Eight.
The Streets, Avenues and Alleys referred to in this Res-
olution are public Streets, Avenues and Alleys in the City of
Newport Beach, and the rights of way and property referred to
in this resolution are rights of way and property owned by the
City of Newport Beach.
Section Nine
The Street Superintendent of the City of Newport Beach
shall post notice of this work or improvement, as required by
law.

Section Ten
The City Clerk shall certify to the passage of this Reso-
lution.and shall cause the same to be published twice in the
Newport News, a weekly newspaper, printed, published and circu-
lated in the said -City of Newport Beach, and which is hereby
designated for that purpose.
Adopted by the Board of Trustees of the City of Newport
Beach at their eegular meeting held on the 1st day of July, 1918,
and approved this 1st day of July, 1918.
