HomeMy WebLinkAbout138 - Vacating a Portion of 24th Street4 1 2 3 • 4 5 6 • • 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 0 31 32 RESOLUTION NO. 138 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT BEACH DECLARING THEIR INTENTION TO VACATE, CLOSE UP AND ABANDON FOR PUBLIC STREET PURPOSES A CERTAIN PORTION OF 24th STREET WITHIN SAID CITY. The Board of Trustees of the City of Newport Beach do resolve as follows: Section etae. It is the intention of the Board of Trustees to order that portion of the public street hereinafter described within the said City to be closed -up, vacated and abandoned for public street purposes; the said portion of said street to be closed- up, vacated and abandoned for public,street- purposes is des- cribed as follows, to wit: All that portion of 24th Street within the said City, beginning at the northwesterly corner of Lot 15, Block 223 of a Map of Section "A ", Newport Beach as recorded in Miscellaneous Maps Book 4, Page 21, Records of Orange County , California; thence north 80 degrees 20 minutes 30 seconds east, along the northerly line of said Lot 15 and along the easterly prolong- ation of the northerly line of said Lot 15, which northerly line of said Lot 15,is also the southerly line of the aforesaid 24th. Street, a distance of 199.04 feet to a point; thence north 19 degrees 42 minutes 30 seconds west, a distance of 6.70 feet to a point; thence south '78 degrees 29 minutes west, a distance of 198.02 filet to the place of beginning. SECTION TWO. .That the public work herein provided for, is for the closing up of the portion of the street herein described in Section One, and it appearing to the Board of Trustees that there are no costs, damages or expense occasioned b y or arising out of said work and that no assessment is necessary to pay -1- 1 • 2 3 • 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 • 28 • 29 30 31 32 the costs, damages or expenses of said work and that therefore no assessment district of lands to be affected or benefited by said work or improvement is necessary. SECTION THREE. the Street Superintendent of the City of Newport -Oeach is hereby directed to cause to be conspicuously posted along the lime 6f said contemplated improvement, at not more than three hundred feet in distance apart upon said street and not less than three in all upon said street, notices of the passage of this resolution, said notice to be headed "NOTICE OF PUBLIC WORK ", in letters not less than one inch in length and stating the fact of the passage of this resolution, its date and briefly the work of improvement proposed, being that of vacating the portion of 24th Street herein described, and the said notice shall refer to the$ resolution for further particulars; the said Street Supreintendent shall also cause a similar notice to that herein described, to be published by four successive insertions in the Newport News, a weekly newspaper, printed, published and circulated in $aid City of Newport Beach (there beiggno daily newspaper so printed, published and cir- ulated in said City). SECTION FOUR. The City Clerk shall certify to the passage of this resolution and cause a minute thereof to be recorded in the minutes of the meeting of the Board of Trustees at which this resolution was passed. Adopted by the Board of Trustees of the City of Newport Beach and approved this 7th day of March, 1921. J.P.
