A RESOLUTION OF THE BOARD OF TRUSTEES OF THE • CITY OF NEWPORT BEACH DECLARING ITS INTENTION TO ORDER THE IMPROVEMENT OF CERTAIN PORTIONS OF COAST BOULEVARD AND CERTAIN OTHER STREETS, AVENUES AND ALLEYS WITHIN SAID CITY, AND CER- TAIN PROPERTY AND RIGHTS -OF -SPAY OWNED BY SAID CITY, UNDER THE IMPROVEMENT ACT OF 1911 AND THE AMENDMENTS TO SAID ACT. - - o 0 o - - The Board of Trustees of the City of Newport Beach does resolve as follows: SECTION 1. That the public interest and convenience require, and it is the intention of the Board of Trustees of the City of Newport Beach, California, to order the construction of the following described work and improvement in said City, to -wit: (a) That pipes, hydrants and other appliances and appurte- nances for supplying and distributing domestic water, and for fire protection be constructed in certain portions of the following described streets, alleys and rights -of -way owned by said City: 1. In Fifth Avenue from a line 246.35 feet southeasterly of and parallel with the southeasterly line of Begonia Avenue (some- times called 29th Avenue) to a line fourteen (14) feet northwesterly of and parallel with the southeasterly line of Poppy Avenue; 2. In Coast Boulevard and a portion of Fifth Avenue from a line 14 feet northwesterly of and parallel with the southeasterly line of Avocado Avenue to the junction of two pipe lines at the termination of Fifth Avenue in Coast Boulevard, which junction is 246.35 feet southeasterly of and parallel with the southeasterly line of Begonia Avenue (sometimes called 29th Avenue); and thence southwesterly from the aforesaid Junction along a line 246.35 feet southeasterly of and parallel with the aforesaid southeasterly line of Begonia Avenue, a distance of 40 feet to a point in the pipe line in Coast Boulevard;-thence in Coast Boulevard from the last mentioned point to a line, which line is 14 feet northwesterly • of and parallel with the northeasterly prolongation of that part of • the southeasterly line adwiftwomp&WB of Larkspur Avenue (sometimes called 37th Avenue) lying immediately northeasterly of Pacific Drive (sometimes called Electric Way Street); 3. (c) That a pumping plant complete with building, engines, pumps, reinforced concrete reservoir, oil storage tank, air re- ceivers, air compressors, pipes, valves, together with other ap- p�liances and appurtenances thereto be constructed upon the follow- ing described property owned by said City: All that piece or parcel of land being a portion of Block 94 of Irvine Subdivision, as per map thereof recorded in Miscellaneous Record Map Book 1, page 88, Records of Orange County, California, described as follows: Beginning at a point in the northeasterly line of that certain County Road heretofore deeded to the County of Orange, lo- cated along the northerly shore line of Newport Bay, which point is 290 .40 853.14 feet due north, and feet due west of the easterly corner of the aforesaid Block 94; thence North 500 East 45 feet to a point; thence South 600 141 East 101.25 feet to a point; thence South 400 East 105 feet to a point; thence South 500 West 80 feet to a point in the northeasterly line of the aforesaid County Road; thence North 400 West along the northeasterly line of the afore- said County Road a distance of 200 feet to the place of beginning, containing 0.329 acres of land. (d) The grades and elevations to which the work provided for shall be done and the improvement made in the streets, avenues, alleys and rights -of -way and property owned by said City herein- before described, which are provided for in this Resolution, are the grades and elevations shown on the plans and profiles therefor on file in the office of the City Engineer to which said plans and - 27 - 1 profiles reference is hereby made for the description of such grades and elevations to which said work to be constructed shall conform. (e) All of the foregoing work and improvement is fully set forth, delineated and described on plans, profiles, cross - sections and detailed drawings numbered 305, on file in the office of the City Engineer of said City heretofore approved by the Board of Trustees of said City on the 2 d 9day of November, 1924, by Resolution No. S 0 3 , and in Specifications No. 36 adopted by besolution No. 30 2- of the Board of Trustees of said City, and on file in the office of the City Clerk of said City. The said plans, profiles, cross- sections, detailed drawings and specifica- tions are hereby referred to for the full and detailed description of the said proposed work and improvement. SECTION_II. Notice is hereby given that serial bonds to represent unpaid assessments and bear interest at the rate of(7%) seven per cent per annum will be issued hereunder in the manner provided by the Improvement Bond Act of 1915, the last installment of which bonds shall mature fourteen (14) years from the second day of July next succeeding ten (10) months from their date. Notice is hereby given that on Monday, the �0- day of December, 1924, at 7 :30 o'clock, PzM. in the Council Chamber of the City Hall of the said City of Newport Beach, any and all per- sons having any objections to the proposed work or improvement, or to the extent of the district, or both, may appear before the said Board of Trustees and show cause why said proposed improve- ment should not be carried out in accordance with this Resolution. SECTION V. The Newport News, a weekly newspaper printed, published and circulated in the City of Newport Beach, is hereby designated as the newspaper in which this Resolution of Intention shall be published, and for the publication of all other notices, resolu- tions, orders or other matter required to be published by the provisions of the Improvement Act of 1911 hereinafter ieferred to, and the City Clerk of,said City is hereby directed to cause this Resolution of Intention to be published by two insertions in said newspaper in the manner and form required by law. The Board of Trustees does not deem it advisable that the Clerk mail copies of the notices of improvement to owners, or reputed owners, and he is not required to mail the same. SECTION VI. The Street Superintendent of said City shall, after the • adoption of said Resolution of Intention, cause to be conspicuously • posted along the lines of said contemplated work or improvement, and along all the open streets within the hereinbefore described assessment district, notices of the passage of this Resolution of Intention in the manner and form required by law. SECTION VII. Except as hereinbefore stated, all the proceedings for the aforesaid work and improve- - 31 - ment shall be had and taken under and in accordance with the pro- visions of an Act of the Legislature of the State of California, MW designated as the "Improvement Act of 1911", approved April 7th, 1311, and Amendments thereto.
