HomeMy WebLinkAbout312 - Park Avenue & Other Improvementsr, s a _ • RESOLUTION NO.31 Z• A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NE "PORT BEACH DECLARING ITS INTENTION TO ORDER THE IHPROVP,iENT OF PARK AVENUE AND CERTAIN OTHER STREETS AND AVENUES ON BALBOA ISLAND IVITHIN SAID CITY, UNDER THE I1TPROVE -' PENT ACT OF 1911, AND THE AMENDMENTS TO SAID ACT. - - o 0 o - - The Board of Trustees of the City of Newport Beach do resolve as follows: SECTION I. That the public interest and convenience require, and it is the intention of the Board of Trustees of the City of Neimort Beach, California, to order the construction of the following described work and improvement in said City, to -wit; 1. That the roadway of the following streets be graded and have a constructed thereupon /concrete pavement (a) Emerald Avenue between a line drawn from the most south- erly corner of Lot 12, Block 1, of a resubdivision of Section 1, Balboa Island, as per map thereof recorded in Hap Book 6, page 30, Records of Orange County, California, to the most westerly corner of Lot 1, Block 3, of the aforesaid resubdivision of Section 1, Balboa Island, and a line, which line is 101.63 feet (measured along the center line of said Emerald Avenue) northeasterly of and parallel with the northerly line of the first alley northeasterly of Park Avenue; (b) Garnet Avenue between a line, which line is 88.88 feet (measured along the center line of said Garnet Avenue) southwest- erly of and parallel with the southwesterly line of the first alley southwesterly of Park Avenue and a line drawn from the north- westerly corner of Lot 1, Block 6, of the aforesaid re- subdivision of Section 1, Balboa Island to the most easterly corner of Lot 6, A Block 4, of the aforesaid re- subdivision of Section 1, Balboa Island; - • (c) Pearl Avenue between a line drawn from the most southerly corner of Lot 6, Block 5 of the aforesaid re-'subdivision of Section 1, Balboa Island to the most westerly corner of Lot 1, Block 7, of the aforesaid re- subdivision of Section 1, Balboa Island, and a line, which line is 91.03 feet (measured along the center line of said Pearl Avenue) northeasterly of and parallel with the northerly line of the first alley northeasterly of Park Avenue; (d) Agate Avenue betiveen.a line which line is 86.35 feet (measured along the center line of said Agate Avenue) southwester- ly of and parallel with the southwesterly line of the first alley southwesterly of Park Avenue, and a line which line is 91.03 feet (measured along the center line of said Agate Avenue) northeast- erly of and parallel with the northerly line of the first alley northeasterly of Park Avenue; (e) Opal Avenue between a line, which line is 86.35 feet (measured along the center line of_said Opal Avenue) south�est- erly of and parallel with the southwesterly line of the first alley southwesterly of Park Avenue and the westerly line of Col- lins Avenue; (f) Topaz Avenue between a line drawn from the most south- erly corner of Lot 6, Block 11, of the aforesaid re- subdivision of Section 1, Balboa Island to the most westerly corner of Lot 1, Block 13, of the aforesaid re- subdivision of Section 1, Bal- boa Island, 'and the westerly line of Collins Avenue; (g) Turquoise Avenue between a line drawn from the south- easterly corner of Lot 6, Block 13, of the aforesaid re- subdivision of Section 1, Balboa Island to the most westerly corner of Lot 1, Block 15, of the aforesaid re- subdivision of Section 1, Balboa - 2 - • Island, and the southwesterly line of Park Avenue'and the west- erly line of Collins Avenue; (h) Collins Avenue between a line which line is 85 feet southerly of and parallel with the southerly line of the first alley southerly of Park Avenue and.the westerly prolongation of the northerly line of Block 12, Section 3, Balboa Island, as per map thereof recorded in.Map Book 7, page 15, Records of Orange County, California; (1} Ruby Avenue between a line, which line is 85 feet southerly of and parallel with the southerly line of the first alley southerly of Park Avenue and a line, which line is 86.38 feet (measured along the center line of seid Ruby Avenue) north - erly of and parallel with the northerly line of the first alley northerly of Central Avenue; (j) Diamond Avenue between a line, which line is 85 feet southerly of and parallel with the southerly line of the first alley southerly of Park Avenue, and a line, which line is 86.38 feet (measured along the center line of said Diamond Avenue) northerly of and parallel with the northerly line of the first alley northerly of Central Avenue; (k) Sapphire Avenue between a line, which line is 85 feet southerly of and parallel with the southerly line of the first alley southerly of Park Avenue, and a line, which line is 86.38 feet (measured along the center line of said Sapphire Avenue) northerly of and parallel with the northerly line of the first alley northerly of Central Avenue; • (1) Coral Avenue between a line, which line is 85 feet • southerly of and parallel with the southerly line of the first alley southerly of Park Avenue and the westerly prolongation of the northerly line of Block 16 of the aforesaid Section 3, Bal- boa Island; - 3 - a P . 4 • (m) Apolena Avenue between a line, which line is 85 feet southerly of and parallel with the southerly line of the first • alley southerly of Park Avenue, and a line, which line is 85 feet northerly of and parallel with the northerly line of the first alley northerly of Central Avenue;. (n) Amethyst Avenue between a, line, which line is 85 feet southerly of and parallel with the southerly line of the first alley southerly of Park Avenue, and a line, TAiich line is 85 feet northerly of and parallel with the northerly line of the first alley northerly of Central Avenue; (0) Onyx Avenue between a line, which line is 85 feet southerly of and parallel with the southerly line of. the first alley southerly of Park Avenue, and a line, which line is 85 feet northerly of and parallel with the northerly line of the first alley northerly of Central Avenue; (p) Marine Avenue between a line, which line is 85 feet southerly of and parallel with the southerly line of the.first alley southerly of Park Avenue, and a line, which line is 85 feet the northerly of and parallel with,./a?-.:northerly line of the first alley northerly of Central Avenue; (q) Abalone Avenue between a line, which line 'is 85 feet southerly of and parallel with the southerly line of the first alley southerly of Park Avenue and the southerly line of Central Avenue; (r) Crystal Avenue between a line, which. line is 85 feet southerly of and parallel with the southerly line of the first alley southerly of Park Avenue and the southerly line.of Central Avenue; (s) Jade Avenue between a line, which line is 85 feet south- erly of and parallel with the southerly line of the first alley southerly of Park Avenue, and the southerly line of Park Avenue; • (t) Central Avenue between -the easterly line of Collins Avenue • and a line 85 feet easterly of and parallel with the easterly line of the first alley easterly of Marine Avenue; and Central Avenue between a line, which line is 85 feet westerly of and parallel with the westerly line of the first alley westerly of Abalone Ave- nue, and a line drawn from the southeasterly corner of Lot 20, Block 9, of Section 5, Balboa Island; as per map thereof recorded in Map Book 8, page 9, Records of Orange County, California, to the northeasterly corner of Lot 27, Block 5, of the aforesaid Section 5, Balboa. Island; (u) Park Avenue bet *,een a line drawn from the most westerly corner of ]Block 2 of the aforesaid re- subdivision of Section 1, Balboa Island, to the most northerly corner of Lot 1, Block 1, of the aforesaid re- subdivision of Section 1, Balboa Island, and a line 85 feet easterly of and parallel with the easterly line of the first alley easterly of Marine Avenue; and Park Avenue between a line drawn from the southeasterly corner of Lot 13, Block 5, of the aforesaid Section 5, Balboa Island, to the northeasterly corner of Lot 18, Block 4, of the aforesaid Section 5, Balboa Island, and a line, which line is 85 feet westerly of and parallel with the westerly line of the first alley westerly of Abalone Ave- nue; And that cement concrete curbs and cement concrete sidewalk be constructed along the roadway of all of the above described streets except where cement concrete curbs and cement concrete sidewalks already exist; and except that certain small portions • of the existing cement concrete curbs and cement concrete sidewalks • along certain portions of the above described streets which are broken and in bad condition be removed and new cement concrete curb and cement concrete sidewalk constructed in place thereof, the exact locations and lengths of the said portions of said cement concrete curb and cement concrete sidewalk are shown on the plan hereinafter referred to. - 5 - 2. That pipes, hydrants and other appliances and appurtenances • for supplying and distributing clomestic rater and for fire pro- tection be constructed in certain portions of the following de- scribed streets and alleys: (a) In the first alley northerly of Central Avenue from a line three (3) feet easterly of and parallel with the westerly line'of the first alley westerly of Marine Avenue to the westerly line of Collins Avenue; (b) In the first alley northeasterly of Park Avenue from the westerly line of Collins Avenue to the northeasterly line of said Park Avenue; thence across Park Avenue and in and along the first alley southwesterly and southerly of said Park Avenue to a line, which line is 165 feet easterly of and parallel with the easterly line of 'urine Avenue; (c) In-the following alleys from the pipe line hereinbefore described in the first alley southwesterly of Park Avenue to the pipe line hereinbefore described in the first alley northeasterly of said Park Avenue; in the first alley northwesterly of Er:erald Avenue, in the first alley northwesterly of Garnet Avenue, in the first alley northwesterly of Pearl Avenue, in the first alley northwesterly of Agate Avenue, and in the first alley northwesterly of Opal Avenue; (d) In the first alley northwesterly of Topaz Avenue from the pipe line hereinbefore described, in the first alley south- westerly of Park Avenue to the southwesterly line of Park Avenue; (e) In the first alley northwesterly of Turquoise Avenue from the pipe line hereinbefore described, in the first alley •• -southwesterly of Park Avenue to the southwesterly line of Park 4/Jd Avenue in the first alley southeasterly of Turquoise Avenue, and in Collins Avenue from the pipe line hereinbefore described in the first alley southv,.?esterly of Park Avenue to a line in said Collins Avenue, which line is 120 feet southerly of and parallel with the southerly line of that part of Park Avenue lying easterly of - 6 - 14i Q .i r _. Collins Avenue; • (f) In the first alley westerly of.Ruby Avenue from the pipe line herein described in the first alley southerly of Park Avenue to the pipe line herein described in the first alley northerly of Central Avenue; (g) In the first alley westerly of Diamond Avenue from the pipe line hereinbefore described in the first alley southerly of Park Avenue to the northerly line of Central Avenue; (h) In the first alley westerly of Marine Avenue from the pipe line hereinbefore described in the first alley southerly of Park Avenue to the southerly line of Park Avenue; (i) In the first alley easterly of marine Avenue from the pipe line hereinbefore described in the first alley southerly of Park Avenue to a line, which line is 195 feet northerly of and parallel with the northerly line of Central Avenue; (j) In the following streets from the pipe lines herein— before described in the first alley northeasterly of Park Avenue and in the first alley northerly of Central Avenue to a lire, which line is 10 feet southwesterly and southerly of and parallel with the southwesterly and southerly lines of the aforesaid alleys: Emerald Avenue, Garnet Avenue, Pearl Avenue, Agate Avenue, Collins Avenue, Ruby Avenue, Diamond Avenue, Sapphire Avenue, Coral Avenue, Apolena Avenue, Amethyst Avenue, Onyx Avenue and Marine Avenue; (k) In Oentral Avenue from a line three (3) feet easterly of and parallel with the westerly line of the following described alleys to a ltne ten (10) feet westerly of and parallel with the • westterly line of said alleys; the first alley westerly of Ruby • the first alley resterly of Diamond Avenue, Avenue,/the first alley westerly of Sapphire Avenue, the first alley westerly of Coral Avenue, the first alley westerly of Apolena Avenue, the first alley westerly of Amethyst Avenue, the first alley westerly. of Onyx Avenue, the first alley westerly of Marine Avenue and the first alley easterly of Marine Avenue; — 7 — t j i 4 = • (1) In the following streets from the pipe_ %l.ines_1ereinbefore • described in the first alley southwesterly and southerly of Park Avenue to. a line which line is 10 feet northeasterly and northerly of and parallel with the northeasterly and northerly lines of the first alley southwesterly and southerly of Park Avenue; Emerald Avenue, Garnet Avenue, Pearl Avenue, Agate Avenue, Opal Avenue, Topaz Avenue, Turquoise Avenue, Collins Avenue, Ruby Avenue, Diamond Avenue, Sapphire Avenue, Coral Avenue, Apolena Avenue, Amethyst Avenue, Onyx Avenue and Marine Avenue. All of the aforesaid pipes, hydrants and other appliances and appurtenances thereto shall be constructed across all street and alley intersections or portions thereof. The exact location and length thereof to be constructed in all of the.hereinbefore men- tioned streets and alleys or portions of said streets or alleys, are shorn upon the plans hereinafter referred to. The grades to which the work shall be done and the improve- ment made on Emerald Avenue, Garnet Avenue, Pearl Avenue, Agate Avenue, Opal Avenue, Topaz Avenue, Turquoise Avenue, Collins Avenue, Ruby Avenue, Diamond Avenue, Sapphire Avenue, Coral Avenue, Apolena Avenue, Amethyst Avenue, Onyx Avenue, Marine Avenue, and those portions of Central Avenue and'Park Avenue ly- ing westerly of the Grand Canal, which are provided for in this Resolution, shall be the official grades which have heretofore been formally established by this Board of Trustees. The grades to which the work provided for shall be done and the improvement made upon that portion of Abalone Avenue lying •• southerly of Central Avenue, Crystal Avenue, Jade Avenue and all those portions of Central Avenue and Park Avenue lying easterly of the Grand Canal, which are provided for in this Resolution, are the grades shown on the profiles therefor on file in the office of the City Engineer, to which said profiles reference is hereby made for the description of such grades. • All/of the foregoing work and improvement is fully set forth, •delineated and described on plans, profiles, cross - sections and detailed :drawings No. 308 and No. 309, on file in the office of the City Engineer of said City, heretofore approved by the Board of Trustees of the City of Newport Beach on the day of January, 1925, by Resolution No. 3 // and in Specifications No. 33, adopted by Resolution No. 165, Specifications No. 36 adopted by Resolution No. 302, and Specifications No. 37 adopted by Resolution No..3' /0 of the Board cf Trustees of said City, and on file in the office of the City Clerk of said City. The said plans, profiles, cross-:sections, detailed drawings and specifica- tions are.hereby referred to for the full and detailed description of the said proposed work and improvement. SECTION II Notice is hereby, given that serial bonds to represent unpaid assessments, and bear interest at the rate of seven (7) per cent per annum, will be issued hereunder in the manner provided by the Improvement Bond Act of 1915, the last installment of which bonds sha21 mature fourteen (14) years from.the second day of July next succeeding ten months from their date. SECTION III That the contemplated work and improvement hereinbefore men- tioned is, in the opinion of said Board of Trustees, of more than local or ordinary public benefit, and the expense of said work and improvement is made chargeable upon the district hereinafter de- scribed, and said Board of Trustees does hereby declare said dis- trict to be the district benefited by said work aid improvement, and to be assessed to pay the costs and expenses thereof, which district is bounded and described as follows, to -wit: Beginning at the ;Host easterly corner of Lot 7, Block 4 of Section 5, Balboa Island', as per map thereof recorded in 'ap Book 8, page 9, Records of Orange Couzity, California; thence north- �Z �.. westerly in a direct line to the mott easterly corner of. Lot 15, • Block 5, of the aforesaid Section 5, Balboa Island; thence north- westerly in a direct line to a point in the northeasterly line of Lot 8, Block 9, of the aforesaid Section 5, Balboa Island, Y which point is fifteen (15) feet northwesterly of the most east- erly corner of said Lot 8 measured along the northeasterly line of said Lot 8; thence northwesterly in a direct line to the most northerly corner of Lot 14, Block 8, of the aforesaid Section 5, Balboa Island; thence northwesterly in a direct line to the north- easterly corner of Lot 21, Block 14, of Section 4, Balboa Island, as per map thereof recorded in Yap Book 7, page 37, Records of Orange County, California; thence westerly in a direct line to the northwesterly corner of Lot 16, Block 16, of Section 3, Balboa Island, as per map thereof recorded in Map Book 7, page 15, Records of Orange County, California; thence westerly in a direct line to the northeasterly corner of Lot 20, Block 15, of the aforesaid Section 3, Balboa Island; thence westerly in a direct line to the northeasterly corner of Lot 4, Block 10, of a re- subdivision of Section 1, Balboa Island, as per Map thereof recorded in ?dap Book 6, page 30, Records of Orange County, California; thence westerly in a direct line to the most northerly corner of Lot 1, Block 6, of the aforesaid re- subdivision of Section 1, Balboa Island; thence westerly in a direct line to the most easterly corner of Lot 6, Block 4, of the aforesaid re- subdivision of Section 1, Balboa Island; thence westerly in a direct line to the most east- erly corner of Lot 12., Block 2, of the aforesaid re- subdivision _• of Section 1, Balboa Island; thence westerly and southwesterly along the northerly and northwesterly boundary line of the last 1 y most northerly corner of Lot 1, Block 1, of the aforesaid re- subdivision of Section 1, Balboa Island; thence southerly and southeasterly along the westerly and southwesterly boundary - 10 - • line of the last mentioned Block -1, to the most southerly corner _ of Lot 12 of the last mentioned Block 1; thence southeasterly in P. direct line to the most westerly corner of .Lot 1, Block 3, of the aforesaid re- subdivision of Section 1, Balboa Island; thence southeasterly in a direct line to the most southerly corner of Lot 6, Block 5, of the aforesaid re- subdivision of Section 1, Balboa Island; thence southeasterly in a direct line to the most westerly corner of Lot 1, Block 7, of the aforesaid re- subdivision of Section 1, Balboa. Island; thence southeasterly in a. direct line to the most southerly corner of Lot 6, Block 11, of the aforesaid re- subdivision of Section 1, Balboa. Island; thence southeasterly in a direct line to the most westerly corner of Lot 1, Block 13, of the aforesaid re- subdivision of Section 1, Balboa Island; thence southeasterly along the southwesterly boundary line of the last mentioned Block 13 to.the southeasterly corner of Lot 6, of the last mentioned Bloc 13; thence easterly in a direct line to the most westerly corner of Lot 1, Block 15, of the aforesaid re- subdivision of Section 1, Balboa Island; thence easterly in.a direct line to the place of beginning, excepting therefrom any lands forming any part of any public street or alley. The above description is general only. A plat or map of 3�0 said District No. 310, adopted by Resolution No. of the Board of Trustees of said City, indicating by a boundary line the extent of the territory included in the proposed district, is on file in the office of the City Clerk. Reference is hereby made to said plat or map for a further full and complete description • of the said assessment, district. The said map or plat so on file • shall govern for all details as to the extent of the said assess- ment district. I SECTION IV. Notice is hereby given that on Monday, the 26th day of January, 1925, at 7 :30 o'clock, P.M. in the Council Chamber of the - 11 - • City Hall of the said having any objections the extent of the dis Board of Trustees and should not be carried x City of Newport Beach, any and all persons to the proposed work or improvement, or to trict, or both, may appear before the said show cause why said proposed improvement out in accordance with this Resolution. SECTION V. The Ne�rport News, a weekly newspaper printed, published and circulated in the City of Newport Beach, is hereby designated as the newspaper in which this Resolution of Intention shall be published, and for the publication of all other notices, reso- lutions, orders or other matter required to be published by the provisions of the Improvement Act of 1911, hereinafter feferred to, and the City Clerk of said City is hereby directed to cause this Resolution of Intention to be published by two insertinns in said Newspaper in the manner and form required by law. The Board of Trustees does not deem it advisable that the Clerk mail copies of the notice of Improvement to owners, or reputed owners, and he is not required to mail the same. SECTION VI. The Street Superintendent of said City shall, after the adoption of said Resolution of Intention,..cause to be conspicuously posted along the lines of said contemplated work or improvement, and along all the open streets within the hereinbefore described assessment district, notices of the passage of this Resolution of Intention in the manner and form required by law. SECTION VII. �• Except as hereinbefore stated, all the proceedings for the aforesaid work and improvement shall be had'and taken under and in accordance with the provisions of an Act of the Legislature of the State of California, designated as the 'Improvement Act of 191111, approved April 7th, 1911, and Amendments thereto. - 12 - i C.
