HomeMy WebLinkAbout348 - Central Avenue & Other ImprovementsRESOLUTION N0. .349. i A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT BEACH DECLARING THEIR INTEN- TION TO ORDER THE IIAPROVMi ENT OF CERTAIN POR- TIONS OF CENTRAL AVENUE AND CERTAIN OTHER STREETS AND ALLEYS WITHIN SAID CITY, UNDER THE IMPROVEMENT ACT OF 1911, AND THE AMEND- MENTS TO SAID ACT. The Board of Trustees of the City of Newport Beach do resolve as follows: SECTION That the public interest and convenience require, and it is the intention of the Board of Trustees of the City of Newport Beach, California, to order the construction of the following described work and improvement in said City, to -wit: 1. That Central Avenue from the westerly line of B- Street to the westerly line of Tract No. 518, and the northerly prolong- ation of the westerly line of said Tract No. 518, as per map thereof recorded in Miscellaneous Maps.Book 17, pages 33, 34, 35 and 36, Records of Orange County, California; O- Street from the northerly line of Surf Avenue to the southerly line of Bay Avenue; D- Street from the northerly line of Surf Avenue to the southerly line of Bay Avenue; E- Street from the northerly line of Surf Avenue to the southerly line of Bay Avenue; F- Street from the northerly line of Central Avenue to the easterly prolongation of the southerly line of that part of Bay Avenue lying westerly of F- Street; G- Street from the northerly line of Central Avenue to the southerly line of Bay Avenue; H- Street from the northerly line of Central Avenue to the southerly line of Bay Avenue; I- Street from the northerly line of Central Avenue to the southerly line of Bay Avenue; J- Street from the northerly line of Central Avenue to the southerly line of Bay Avenue, and K- Street from the northerly line of Central Avenue to the southerly line of Bay Avenue, be graded, and that cement concrete pavement be constructed upon the roadways of said streets, and also that cement concrete curb be constructed along both sides of the roadways of the above described streets, and that cement concrete sidewalks be con- structed along both sides of said streets. 2. That the portion of Central Avenue lying between the northerly line of Central Avenue and a line thirty -five (35) feet southerly of and parallel with the northerly line of said Central Avenue from the northerly prolongation of the westerly line of Tract No. 518, as per map thereof recorded in Miscellaneous Maps Book 17, pages 33, 34, 35 and 36, Records of Orange County, California, to the westerly line of Section 36, Township 6 South, Range 10 West, S.B.B.& M., be graded and that cement concrete pavement* be constructed upon the roadway of said portion of Central Avenue, and also that cement concrete curbs be constructed along the northerly side of said roadway, and that cement concrete sidewalks be constructed along the northerly side of said portion of said Central Avenue. 3. That a cement concrete curb be constructed along the northerly edge of the concrete sideralk to be constructed along the northerly side of Central Avenue hereinbefore described, in the following locations: From a line seventy (70) feet easterly of - 2 - and parallel with the easterly line of 0- Street to a line sixty (60) feet westerly of and parallel to the westerly line of D- Street; from a line five (5) feet easterly of and parallel with the easterly line of D- Street, to a line five (5) feet westerly of and .parallel with the westerly line of E- Street; from a line five (5) feet easterly of.and parallel with the easterly line of E- Street to a line five (5) feet westerly of and parallel with the - 2 - westerly line of F- Street; from a line five (5) feet easterly of ' and parallel with the easterly line of F- Street to the southerly prolongation of the westerly line of G- Street; from the-southerly prolongation of the easterly line of G- Street to the southerly prolongation of the westerly line of H- Street, and from the southerly prolongation of the easterly line of H- Street to the southerly prolongation of the westerly line of I- Street. 4. That a cement concrete curb be constructed along the southerly edge of the sidewalk along the southerly side of Central Avenue hereinbefore described, in the following locations: From the easterly line of E- Street to the westerly line of the aforesaid Tract No. 518. 5. That cement concrete curb be constructed along the north- erly line of Surf Avenue across the entire width of C- Street, D- Street and E- Street. G. That cement concrete curb be constructed along the southerly line of Bay Avenue across the entire width of C- Street, D- Street, E- Street, F- Street, G- Street, H- Street, I- Street, J- Street and .K- Street. 7. That the alley between I- Street and J- Street, extending from the northerly line of Central Avenue to the southerly line of the first alley northerly of Central Avenue; the alley between J- Street and K- Street, extending from the northerly line of Central Avenue to the southerly line of the first alley northerly of Central.Avenue; the first alley easterly of K- Street, extending from the northerly line of Central Avenue to the southerly line of the first alley northerly of Central Avenue, and the first alley northerly of Central Avenue, from the East line of F- Street to the west line of G- Street; from the east line of G- Street to the west line of H- Street; from the East line of H- Street to the Test line of -I- Street, from the East line of I- Street to the !hest line of J- Street; from the East line of J- Street to the 7est line - 3 - ri • the profiles therefor on file in of K- Street, and from the East line of K- Street to a line, which to which said profiles reference is hereby made line is 210 feet easterly of and parallel with the easterly line of said K- Street, be graded for their entire width and have con- structed thereupon a surfacing of clay and gravel. 8. That granite concrete ornamental lighting posts, conduits, wires and appurtenances for the successful operation of an ornamental lighting system be constructed along both sides of Central Avenue from B- Street to the southerly prolongation of the easterly line of F- Street, and along the northerly side of Central Avenue from the southerly prolongation of the easterly line of F- Street to a line, which line is 210 feet easterly of and parallel with the easterly line of K- Street. All of the foregoing work snd improvement is fully set forth, delineated and described on plans, profiles, cross - sections and detailed drawinf,s No. 317, on file in the office of the City Engineer of said City, heretofore approved by the Board of Trustees of the City of Newport Beach on the 2 "—"� day of /Yorem 6e r > 1925, by Resolution Ido. J?-4Z , and in Specifications No. 35, adopted by Resolution No. 298, Specifications No. 38, adopted by Resolution No. 321, and Specifications No. 39, adopted by Resolu- tion No. "&/ , of the Board of Trustees of the City of Newport Beach, and on file in the office of the City Clerk of said City. The grades to rhich the work provided for shall be done, and the improvement made upon those portions of the streets.hereinbefore described, which are provided for in this Resolution, are the grades shown on the profiles therefor on file in the office of the City Engineer, to which said profiles reference is hereby made for the description of said grades. SECTION II. That the Board of Trustees also determine and declare that serial bonds bearing interest at the rate of seven (7) per - 4 - r t R 0 cent per annum shall be issued to represent each assessment of twenty -five (25) dollars, or more, remaining unpaid for twenty (20) days after the date of the warrant. Said serial bonds shall extend over a period ending nine (9) years from the second day of January next succeedinj; the fifteenth (15th) day of the next November following their date. Payments on the principal of un- paid assessments, and interest, shall be made by property owners to the City Treasurer and the same shall be disbursed by him, all as provided in the said Improvement Act of 1911. SECTION III. That the contemplated work and improvement hereinbefore mentioned is, in the opinion of said Board of Trustees, of more than local or ordinary public benefit, and the expense of said work and improvement is made chargeable upon the district herein- after described and said Board of Trustees do hereby declare said district to be the district benefited by said work and improvement and to be assessed to pay the costs and expenses thereof, which district is bounded and described as follows, to -wit: Beginning, at the southwesterly corner of Lot 21, Block 14, of the Balboa Tract, as per map thereof recorded in :•5iscellaneous Maps Book 4, page 11, Records of Orange oounty,0alifornia; thence easterly along the northerly line of Surf Avenue to the south- westerly corner of Lot 1, Block 22, of the East Side Addition to the Balboa Tract, as per map thereof recorded in Miscellaneous ?raps Book 4, page 20, Records of Orange,Oounty, California; thence easterly along the northerly line of Surf Avenue and along the easterly prolongation of the aforesaid northerly line of Surf Avenue to its intersection with the westerly line of Block A, of Tract No. 518, as per map thereof recorded kn Miscellaneous 11-Yaps Book 17, pages 33, 34, 35 and 36, Records of Orange Oounty,.0alifornia; thence - 5 - northerly along the westerly line of the aforesaid Block A, and along the northerly prolongation of said westerly line of Block A, to its intersection with the northerly line of Section 2, Township 7.South, Range 10 West, S.B.B.& Ii., which line is also the northerly boundary line of the aforesaid Tract No. 518; thence easterly along the northerly line of the aforesaid Sections "a, which line is also the northerly boundary line of the aforesaid Tract No. 518, to the northeasterly corner of the aforesaid Sec- tion 2; thence northerly along the westerly line of Section 36, Township 6 South, Range 10 West, S.F.B.&M. to its intersection with the easterly prolongation of the southerly line of that part of Bay Avenue lying easterly of K- Street; thence westerly along the easterly prolongation of the southerly line of that part of Bay Avenue lying easterly of K- Street,and along the southerly line of Bay Avenue to the northwesterly corner of Lot 1, Block 23, of the aforesaid map of the East Side Addition to the Balboa Tract; thence southwesterly in a direct line to the most northerly corner of Lot 13, Block 21, of the aforesaid East Side Addition to the Balboa Tract; thence westerly and northwesterly along the south- erly and southwesterly line of Bay Avenue to the northwesterly corner of Lot 7, Block 13, of the aforesaid Lisp of the Balboa Tract; thence southwesterly in a direct line to the southwesterly corner of the aforesaid Lot 21, Block 14, of the Balboa Tract, to the place of beginning, excepting therefrom any lands forming any part of any public street or alley. The above description is general only. A plat or map of said District No. 318, adopted by Resolution No. J47 , of the Board of Trustees of said City, indicating by a boundary line the extent df the territory included in the proposed district, is on file in the office of the City Clerk. Reference is hereby made to said plat or map for a further full and complete description of the said assessment district. The said map or plat so on file - 6 - z 1 : 0 shall govern for all details as to the extent of the said assess- ment district. SECTION IV Notice is hereby given that on Monday, the 23 day of Ale Vem-_4et- , 1925, at 7;30 o'clock, P.M., in the Council Chamber of the City Hall of the said City of Newport Beach, any and all persons having any objections to the proposed work or improvement or to the extent of the district, or both, may appear before the said Board of Trustees and show cause why said proposed improvement should not be carried out in accordance with this Resolution. SECTION V. The Newport News, a semi - weekly newspaper printed, pub- lished and circulated in the City of Newport Beach, is hereby designated as the newspaper in which this Resolution of Intention shall be published, and for the publication of all other notices, resolutions, orders or other matter required to be published by the provisions of the Improvement Act of 1911, hereinafter re- ferred to, and the City Clerk of said City is hereby directed to cause this Resolution of Intention to be published by two in- sertions in said newspaper, in the manner and form required by law. The Board of Trustees do not deem it advisable that the Clerk mail copies of the notice-,of improvement to owners, or reputed owners, and he is not required to mail the same. SECTION VI The Street Superintendent of said City shall, after the adoption of said Resolution of Intention, cause to be conspicuously posted along the lines of said contemplated work or improvement, and along all the open streets within the hereinbefore described assessment district, notices of hhe passage of this Resolution of Intention, in the manner and form required by law. SECTION VII. All the proceedings for the aforesaid work and improve- -7- • ment shall be had and taken under and in accordance with the pro- visions of an Act of the Legislature of the State of California, • designated as the "Improvement Act of 1911 ", approved April 7th, 1911, and Amendments thereto.
