HomeMy WebLinkAbout374 - Abalone Avenue & Other Vacationr RESOLUTION NO. 3 %J'� A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT BEACH DECLARING VACANT FOR PUBLIC STREET PURPOSES CERTAIN PORTIONS OF ABALONE AVENUE AND CERTAIN ALLEYS IN BLOCKS 8 AND 9, AND A CERTAIN PORTION OF THE ALLEY IN BLOCK 7, SECTION 5, BALBOA ISLAND, WITHIN SAID CITY. i V WHEREAS, The Board of Trustees of the City of Newport Beach, on the 18th day of May, 1925, at a regular meeting of said Board held on that date, duly passed and adopted a Resolution, being Resolution No. 335, entitled, "A Resolution of the Board of Trustees of the City of Newport Beach declaring its intention to vacate, close -up and abandon for public street purposes certain portions of Abalone Avenue and certain alleys in Blocks 8 and 9, and a certain portion of the alley in Block 7, Section 5, Balboa Island, within said City", and WHEREAS, The Street Superintendent of the City of Newport Beach, after the passage of said Resolution, caused to be conspicuously posted along the line of said contemplated improve- ment, at not more than three hundred (300) feet in distance apart, upon said street, and alleys, and not lees than three (3) in all, upon said street and alleys, notices of the passage of said Resolution, said notice being headed "Notice of Public Work", in letters not less than one inch in length, and stating the fact of the passage of said Resolution, its date, and briefly the work of improvement proposed, being that of vacating the above named street and alleys, as hereinafter described, and the said Notice herein mentioned referred to said Resolution for further particulars; said Street Superintendent having also caused a notice similar to that her einbefore referred to to be published by four successive insertions in the Newport News, a semi- weekly newspaper printed, published and circulated in said City of Newport Beach(there being no daily newspaper so printed, published and circulated in said - 1 - r City), and more than ten (10) days after the expiration of the time • of publication of said notice having elapsed and no objections to • the said improvement have been delivered to the City Clerk of the City of Newport Beach, and the said Board of Trustees having ac- quired jurisdiction to order the vacation of said street and alleys as hereinafter described; THEREFORE, The Board of Trustees of the City of Newport Beach do resolve as follows: SECTION I. That those portions of the public street and alleys hereinafter described, within the said City, be closed -up, vacated and abandoned for public street purposes. The said portions of said street and alleys so closed -up, vacated and abandoned for public street purposes, are described as follows: All that portion of Abalone Avenue from the northerly line of Central Avenue to the northerly termination of said Abalone Avenue; and all of that portion of the first alley lying westerly of and parallel with Abalone Avenue extending northerly and southerly through Block 8, of Section 5, Balboa Island, from the northerly line of Central Avenue to the southwesterly line of the first alley northerly of Central Avenue; and all that portion of the first alley lying easterly of and parallel with Abalone Avenue, extending northerly and southerly through a portion of Block 9, of Section 5, Balboa Island, from the northerly line of Central Avenue to the southwesterly line of the first alley north- easterly of Central Avenue; all that portion of the alley extend- ing northwesterly through Block 9, of Section 5, Balboa Island, from the northerly line of Central Avenue to the easterly line of Abalone Avenue; and all that portion of the first alley northerly of Central Avenue extending northwesterly and southeasterly through Block @, of Section 5, Balboa Island, from the westerly line of - 2 - . Abalone Avenue to the westerly line of Block 8, of Section 5, Balboa Island, and all that portion of the alley extending north- erly and southerly through Block 7, of Section 5, Balboa Island,. from the southerly line of Central Avenue to a line drawn from the southeasterly corner of Lot 7, Block 1, of Section 5, Balboa Island, to the southwesterly corner of Lot 22, of the aforesaid Block 7, Section 5, Balboa Island. SECTION II. That the public work herein provided for is the closing -up of the street and alleys herein described, in Section I, and it appearing to the Board of Trustees that there are no costs, damages or expenses occasioned by, or arising out of said work, and that no assessment is necessary to pay the costs, damages or expenses of said work, and that, therefore, no com- missioners shall be appointed to assess benefits and damages. SECTION III. The City Clerk shall certify to the passage of this resolution, and cause the same to be published by one (1) in- sertion in the Newport News, a weekly newspaper printed, published and circulated in said City, and which is hereby designated for that purpose.
