A resolution of the Board of Trustees of the City
of Newport Beach ordering the vacating, closing up and

abandonment of a certain portion of Bay View Avenue, a
public street in the City of Newport Beach.

The.Board of Trustees of the Citv of Newport Beach do

resolve, declare and determine as follows:

whereas, at a meeting of the Board of Trustees of the
10
City of Newpar t Beach held the 26th day of April, 1926, there was
11
passed a resolution declaring its intention to order a certain
0
12
portion of Bay View Avenue, a public street in said City, vacated,

13
closed up and abandoned, said resolution containing and specifying

the things and matters required by law.

Whereas, the Street Superintendent of said city there —

after caused to be and there was posted notifies of Public 'fork

along the line of said contemplated improvement not less than 300

feet in distance apart and twelve notices in all.

Whereas, the said Street Superintendent caused a notice

similar in substance to be published at the times and for the

Period prescribed by law, in Newport News, a newspaper of general
22
circulation, printed, published and circulated in said city and
23
designated for that purpose.

whereas, no interested or other person objected to s'iid

work or made or filed any Turitten or other objection thereto and
26
the time having expired for the making of said objections.

whereas, public interest and convenience require the

hereinafter described portion of Bay View Avenue, a public street

in the City of Newport Beach, to be vacated, closed up and
30
abandoned.

Section 1,
The Board of Trustees of the Uity of Newport Beach having
acquired jurisdiction for that purpose, hereby orders all that
portion of Bay View Avenue located in the City of Newport Beach,
County of Orange, State.of California and particularly described as:
Beginning at the southwest corner of Lot 17 of Block
2 of the Balboa Bay Side Tract as per map thereof recorded
in Book 4, page 78, Records of Orange County, California,
which southwest corner of said Lot 17 is also the northeast
corner of %ay View Avenue and Bay Avenue; thence North 50
51 30" west along the easterly line of said Bay View Avenue
which line is also the westerly line of the aforesaid Lot
17, a distance of 48.16 feet to a point; thence south 160
561 west a distance of 51.95 feet to a point; thence North
84`541 30" east a distance of 19.47 feet to the place of
beginning.
to be and the same is hereby vacated, closed up and abandoned.
Section 2,
It is not necessary to take land for the closing up,
vacation or abandonment of the described portion of Bay View Avenue
and no damages, host or expense will accrue therefor and no
assessment is necessary and no com-rissioners are required or
appointed to assess benefits or damages.
The above and foregoing resolution No =2z?was passed
and adopted by the Board of Trustees of the city of Newport Beach at
a meeting thereof held the 5th day of July, 1926 oy the following
vote:
