NO... 3�• A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT BEACH DECLARING THEIR INTENTION TO CRDER THE IMPROVEMENT OF CERTAIN PORTIONS OF SEAVIEW AVENUE AND CERTAIN OTHER STREETS AND AVENUES IN CORONA DEL MAR, WITHIN SAID CITY, UNDER THE IMPROVEMENT ACT OF 1911, AND THE AMENDMENTS TO SAID ACT. The Board of Trustees of the City of Newport Beach do resolve as follows: SECTION I \ That the public interest and convenience require, and it is the intention of the Board of Trustees of the City of Newport Beach, California, to order the construction of the following described work and improvement in said City, to -wit: 1. That the following described portions of streets be graded, the roadways thereof paved with macadam pavement, and cement concrete curbs and cement concrete gutters constructed along both sides of said roadways,and also cement concrete sidewalks constructed along both sides of said streets: (a) Fernleaf Avenue from a line 210 feet northeasterly of and parallel with the northeasterly line of Seaview Avenue to the northeasterly line of Seaview Avenue; (b) Goldenrod Avenue from the southwesterly line of Seaview Avenue to a line, which line is 150 feet southwesterly of and parallel with the said southwesterly line of Seaview Avenue; (c) Heliotrope Avenue from a line, which line is 300 feet northeasterly of and parallel with the northeasterly line of Seaview Avenue to the northeasterly line of Seaview Avenue, except that no cement concrete curbs shall be constructed along said portion of-said street; and from the southwesterly line of Seaview Avenue to a line, which line is 130 feet southwesterly of and parallel with the southwesterly line of said Seaview Avenue, - 1 - except that no cement concrete curb shall be constructed along the • southeasterly side of the roadway of said portion of said street; and from a line 5 feet southwesterly of and parallel with the • southwesterly line of the first alley.northeasterly of Ocean Boulevard, to the northeasterly line of Ocean Boulevard; (d) Iris Avenue from a line, which line is 320 feet north- easterly of and parallel with the northeasterly line of Seaview Avenue, to the northeasterly line of Seaview Avenue, except that no cement concrete curb shall be constructed along said portion of said street; and from the southwesterly line of Seaview Avenue to a line, which line is 50 feet southwesterly of and parallel with the southwesterly line of said Seaview Avenue, except that no cement concrete curbs shall be constructed along said portion of said street; and from the southeasterly prolongation of the northeasterly line of Bay Vies* Drive to the northeasterly line of Ocean Boulevard, except that no cement concrete curb shall be constructed along the southeasterly side of the roadway from the southeasterly prolonga- tion of the northeasterly line of Bay View Drive to the northwest- erly prolongation of the northeasterly line of the first alley lying northeasterly of Ocean Boulevard, and extending southeasterly from Iris Avenue, and except that no cement concrete curb and sidewalk shall be constructed between the southeasterly prolongation of the northeasterly line and center line of Bay View Drive; (e) Jasmine Avenue from a line, which line is 280 feet northeasterly of and parallel with the northeasterly line of Seaview Avenue, to the northeasterly line of Seaview Avenue; and from the southwesterly line of Seaview Avenue to a line, which line is 85 2 feet southwesterly of and parallel with the southwesterly line of qW the first alley lying northeasterly of Ocean Boulevard, and extend- ing southeasterly from said Jasmine Avenue, except that no cement concrete curbs shall be constructed along said portions of said street; — 2 — • (f) Larkspur Avenue from a line,which line is 340 feet north- easterly of and parallel with the northeasterly line of Seaview Avenue, to the northeasterly line of Seaview Avenue; and from the southwesterly line of Seaview Avenue to the northeasterly line of Ocean Boulevard, except that no cement concrete curbs shall be constructed along said portions of said street; (g) Marigold Avenue from the southwesterly line of Coast Boulevard to the northeasterly line of Seaview Avenue; (h) Narcissus Avenue from the southwesterly line of Coast Boulevard to the northeasterly line of Seaview Avenue; and from the southwesterly line of Seaview Avenue to the northeasterly line of Ocean Boulevard; (1) Orchid Avenue from the southwesterly line of Coast Boulevard to the northeasterly line of Seaview Avenue; and from the southwesterly line of Seaview Avenue to the northeasterly line of Ocean Boulevard; (j) Pansy Avenue from the southwesterly line of Coast Boulevard to the northeasterly line of Seaview Avenue; and from the southwesterly line of Seaview Avenue to the northeasterly line of Ocean Boulevard; (k) Hazel Drive from a line drawn from the most westerly corner of Lot 36, Block A, of Tract No. 673, as per map thereof recorded in Miscellaneous Maps, Book 20, pages 17 and 18, Records of Orange County, California,to a point in the southeasterly line of Lot 29, of the aforesaid Block A, which point is 15 feet south- erly of the most easterly corner of said Lot 29 (measured along the southeasterly boundary line of said Lot 29), to the southwest - erly line of Coast Boulevard, except that no cement concrete sidewalk shall be constructed along the northwesterly side of said portion of said street; - 3 - (1) Bay View Drive from the easterly line of Ocean Boulevard • to the northwesterly line of:-Goldenrod Avenue; and from the south- easterly line of Goldenrod Avenue to the northwesterly line of Heliotrope Avenue; and from the southeasterly line of Heliotrope Avenue to the northwesterly line of Iris Avenue, except that no cement concrete curb shall be constructed along the northeasterly side of said portion of said street from the aforesaid southeast- erly line of Heliotrope Avenue to the northwesterly line of Iris Avenue, and except that no cement concrete sidewalk shall be con- structed along the northeasterly side of said portion of said street from the center line of the first alley northwesterly of Iris Avenue to the northwesterly line of said Iris Avenue; 2. That the following described portions of streets be graded, the roadways thereof paved with cement concrete * vement and cement concrete curbs constructed along both sides of the roadways thereof, and cement concrete sidewalks constructed along both sides of said streets: (a) Carnation Avenue from the northwesterly prolongation of the northeasterly line of Seaview Avenue to the northwesterly pro- longation of the northeasterly line of Ocean Boulevard, except that no cement concrete sidewalk shall be constructed along the northwesterly side of said portion of said street; (b) Dahlia Avenue from the southwesterly line of Seaview Avenue to the northeasterly line of Ocean Boulevard; (c) Fernleaf Avenue from the southwesterly line of Seaview Avenue to the northeasterly line of Ocean Boulevard; (d) Goldenrod Avenue from a line, + 7hich line is 230 feet • northeasterly of and parallel with the northeasterly line of Seaview Avenue, to the northeasterly line of Seaview Avenue, except that no cement concrete curbs shall be constructed along said portion of said street; and from a line, which line is 150 feet northeasterly of and parallel r^ith the northeasterly line of Bay Vier Drive, to the easterly line of Ocean Boulevard; 4 — 7 (e) Heliotrope Avenue from a line, which line is 130 feet southwesterly of and parallel with the southwesterly line of Seaview Avenue, to a line, which line is 5 feet southwesterly of • and parallel with the southwesterly line of the first alley north- easterly of Ocean Boulevard, except that no cement concrete curb, shall be constructed along the southeasterly side of the roadway of said Heliotrope Avenue from a line, which line is 130 feet southwesterly of and parallel with the southwesterly line of Seaview Avenue to the center line of Bay View Drive; (f) Iris Avenue from a line, which line is 50 feet southwesterly of and parallel with the southwesterly line of Seaview Avenue, to the southeasterly prolongation of the northeasterly line of Bay View Drive, except that no cement concrete curbs shall be constructed along said portion of said street, and except that no cement concrete sidewalk shall be constructed along the northwesterly side of said portion of said street from a line 80 feet northeasterly of and par- allel with the northeasterly line of Bay View Drive to the southeast- erly prolongation of the northeasterly line of said Bay View Drive; (g) Jasmine Avenue from a line, which line is 85 feet south- westerly of and parallel with the southwesterly line of the first alley lying northeasterly of Ocean Boulevard, and extending; south- easterly from Jasmine Avenue, to the northeasterly line of Ocean Boulevard, except that no cement concrete curbs shall oe constructed a.long said portion of said street; (h) Marguerite Avenue from the southwesterly line of Coast Boulevard to the northeasterly line of Ocean Boulevard, except that no cement concrete curb shall be constructed along the northwest- erly side of the roadway of said Marguerite Avenue from a line, which line is 7 feet northeasterly of and parallel with the southeasterly • prolongation of the southwesterly line of Pacific Drive to the • northeasterly line of Ocean Boulevard; (i) Marigold Avenue from the southwesterly line of Seaview Avenue to the northeasterly line of Ocean Boulevard; (j) Poppy Avenue from the southwesterly line of Coast Boulevard to the southeasterly prolongation of the northeasterly line of that — 5 — v F w if « . part of Ocean Boulevard lying northwesterly of Poppy Avenue; ' (k) Hazel Drive from th6 southeasterly line of Poppy Avenue to a line drawn from the most westerly corner of Lot 36, Block A, of Tract No. 673, as per map thereof recorded in Miscellaneous Maps, Book 20, pages 17 and 18, Records of Orange County, California, to a point in the southeasterly line of Lot 29, of the aforesaid Block A, which point is 15 feet southerly of the most easterly corner of said Lot 29 (measured along the southeasterly line of said Lot 29), except that no cement concrete sidewalk shall be constructed along the northeasterly, northerly and northwesterly side of said portion of said street; (1) Seaview Avenue from the northeasterly prolongation of the southeasterly line of Carnation Avenue, to the northwesterly line of Marguerite Avenue, and from the southeasterly line of Marguerite Avenue to the northwesterly line of Poppy Avenue, except that no cement concrete curb shall be constructed along the north- easterly side of the roadway of said Seaview Avenue from the center line of the alley lying between Fernleaf Avenue and Goldenrod Avenue, to the northwesterly line of Marguerite Avenue, and along the southwesterly side of the roadway of said portion of said street from the center line of Heliotrope Avenue to the northwesterly line of Marguerite Avenue. 3. That a portion of the northeasterly, easterly and north - erly.part of Ocean Boulevard, from the southwesterly prolongation of the northwesterly line of Carnation Avenue to the southwesterly prolongation of the southeasterly line of that part of Poppy Avenue lying northeasterly of said Ocean Boulevard, be graded; that cement concrete pavement be constructed on the northeasterly, easterly and northerly side of the roadway of said Ocean Boulevard, the width of said roadway to be paved varying from 35 to 70 feet; that cement - 6 - 4 • concrete curbs be constructed along both sides of said cement con- . crete paved roadway, and that cement concrete sidewalk be con- structed along the northeasterly, easterly and northerly side of said Ocean Boulevard. 4• That a part of the southwesterly portion.af`.Ocean Boulevard, from the southeasterly line of Dahlia Avenue to the northwesterly line of Fernleaf Avenue, be graded, and a cement concrete pavement be constructed to a width of 20 feet upon the aforesaid part of said street; and that cement concrete curb be constructed along the southwesterly side of said pavement; and that a cement concrete curb be constructed along the northeasterly side of said pavement from the southeasterly line of Dahlia Avenue to a line 121 feet south- easterly of the southeasterly line of Dahlia Avenue; and that a cement concrete wall be constructed along the northeasterly side of said cement concrete pavement from a line 121 feet southeasterly of the southeasterly line of Dahlia Avenue to the northwesterly line of Fernleaf Avenue; and that a portion of Fernleaf Avenue from a line 50 feet southwesterly of and parallel with the northeasterly line of Ocean Boulevard, to a line, which line is 2 feet south- westerly of and parallel with the southwesterly line of that part of H- Street lying southeasterly of Fernleaf Avenue, be graded, and that a cement concrete pavement be constructed upon a portion of the roadway of said Fernleaf Avenue, varying from a width of 20 feet to a maximum width of 50 feet; and that cement concrete curbs, be constructed along the southwesterly, westerly and northwesterly side of said cement concrete pavement from the northwesterly line of Fernleaf Avenue to the northeasterly line of the first alley southwesterly of Ocean Boulevard, and along the southeasterly side of said cement concrete pavement, from a line, which line is ?0 feet southwesterly of and parallel with the southwesterly line of Ocean Boulevard, to the northeasterly line of the first alley r l • southwesterly of Ocean Boulevard; also the construction of cement • concrete curb around the curb returns and adjacent thereto at the intersection of Fernleaf Avenue and H- Street; also the construction of a cement concrete wall along the northeasterly, easterly and southeasterly side of the said concrete pavement from the north- westerly line of Fernleaf Avenue to a line, which line is 70 feet southwesterly of and psr&llel with the southwesterly line of Ocean Boulevard; and the grading and construction of cement concrete walls, cement concrete steps, cement concrete landings, cement concrete inclined walks, railing, cement concrete curb, cement concrete gutters and other appurtenances in and adjacent to the intersection of the aforesaid Ocean Boulevard and Fernleaf Avenue, and along the southeasterly side of Fernleaf Avenue to the north- easterly line of the first alley southwesterly of Ocean Boulevard. 5. That a certain part of the southerly portion of Ocean Boulevard from the center line of Iris Avenue to a line, which line is 120 feet southeasterly of and parallel with the southeast- erly line of Jasmine Avenue, be graded, and Cement concrete pavement, varying in width from 20 to 23 feet, constructed upon the herein - before described portion of said Ocean Boulevard, and that cement concrete curbs be constructed along both sides of said concrete pavement; and that a certain portion of Iris Avenue, from the north- westerly prolongation of the southwesterly line of that part of Ocean Boulevard lying southeasterly of Iris Avenue, to a line, which line is drawn at right angles to the southeasterly line of Iris Avenue through a point in the said southeasterly line of Iris Avenue, which point is 20 feet southwesterly of the northwesterly corner of Lot 18, Block A -36, of Corona del Mar, as per map thereof recorded in Miscellaneous Maps, Book 3, pages 41 and 42, Records of Orange County, California, be graded, and a cement concrete pavement varying in width from 20 to 30 feet be constructed upon said portion of • said street; and that cement concrete curbs be constructed along • both sides of said cement concrete pavement, except that no cement concrete curb be constructed along the northwesterly side of said cement concrete pavement from the southwesterly limits of the im- provement of said Iris Avenue, hereinbefore described, to a line 80 feet northeasterly of and parallel with the said southwesterly limits of said improvement. 6. That that portion of Coast Boulevard lying between the southwesterly line of said Coast Boulevard, and a line, which line is 30 feet northeasterly of and parallel with the southwesterly line of said Coast Boulevard, from a line, which line is 110 feet northwesterly of and parallel with the southeasterly line of Marguerite Avenue, to a line drawn at right angles to the south- westerly line of Coast Boulevard through a point in the southwest- erly line of said Coast boulevard, which point -is 105.02 feet east- erly of the southeasterly corner of Hazel Drive and Coast Boulevard (measured along the southwesterly line of said Coast Boulevard), be graded, and that cement concrete curbs be constructed along the southwesterly side of the roadway of said described portion of Coast Boulevard. 7. That cement concrete pavement be constructed upon the roadway of that portion of Coast Boulevard hereinbefore described, in the following locations: (a) ,From a line, which line is 110 feet northwesterly of and" parallel with the southeasterly line of Marguerite Avenue, to a line, which line is 20 feet southeasterly of and parallel with the south- easterly line of said Marguerite Avenue; (b) From a line, which line is 20 feet northwesterly of and • parallel with the northwesterly line of the following streets, to a line, which line is 20 feet southeasterly of and parallel with the southeasterly line of the following streets, viz: those por- tions of Marigold Avenue, Narcissus Avenue, Orchid Avenue, Pansy Avenue, Poppy Avenue and Hazel Drive lying southwesterly of said Coast Boulevard. 8. That that certain alley situated in Block A, of the aforesaid Tract No. 673, and extending from the southeasterly line of Hazel Drive; thence southeasterly, easterly; northeasterly and northwesterly to the southeasterly line of Hazel Drive, be graded to the entire width and a cement concrete pavement constructed upon the entire width of said alley. 9. That the southwesterly portion of Pacific Drive, from the northeasterly prolongation of the northwesterly line of that part of Marguerite Avenue lying southwesterly of Pacific Drive, to a line, which line is 175 feet northwesterly of and parallel with the southwesterly prolongation of the northwesterly line of that part of Carnation Avenue lying northeasterly of First Avenue, be graded, a cement concrete pavement be constructed to a width of 20 feet, except that at certain street intersections the pavement shall be widened to conform to the shape and dimensions shown upon the plans hereinafter referred to; and that a cement concrete gutter be constructed along the southwesterly side of said cement concrete pavement; and also that a cement concrete curb be con - structed along the southwesterly side of said cement concrete gutter; and that catch basins and other appurtenances thereto, be constructed along the southwesterly curb line of said Pacific Drive, in the following locations: — lA — 0 fi (a) Between Jasmine Avenue and Iris Avenue; (b) Between Heliotrope Avenue and Goldenrod Avenue; (o) Between Goldenrod Avenue and Fernleaf Avenue; (d) Between Dahlia Avenue and the first alley northwesterly of said Dahlia Avenue. ffiof AlsooVl ose portions of Pacific Drive lying between the northwesterly and southeasterly lines of Larkspur Avenue, Jasmine Avenue, Iris Avenue and Heliotrope Avenue, from the northeasterly line of said Pacific Drive to the cement concrete pavement herein - before described along the southwesterly side of the roadway of said Pacific Drive, be graded, and that cement concrete curbs be constructed across said portions of Pacific Drive along the south- westerly prolongation of the northwesterly and southeasterly curb lines of said streets lying northeasterly of said Pacific Drive; and that cement concrete pavement be constructed hetween said curb lines upon the hereinbefore described portions of said Pacific Drive. 10. That reinforced concrete pipe drains together with inlets and other appurtenances be constructed in and along Pacific Drive, in the following locations; (a) From a line 20 feet southeasterly of and parallel with the southeasterly line of Larkspur Avenue, to a line, which line is 20 feet northwesterly of and parallel with the northwesterly line of Larkspur Avenue; (b) From a line 20 feet southeasterly of and parallel with the southeasterly line of Jasmine Avenue, to a line 20 feet northwesterly of and parallel with the northwesterly line of Jasmine Avenue. 116 That a drain be constructed in and along Pacific Drive from a line 15 feet southeasterly of and parallel with the south- - 11 - t easterly line of Iris Avenue, to a line 57 feet northwesterly of and parallel with the southwesterly .:prolongation of the northwesterly line of that part of Carnation Avenue lying northeasterly of First Avenue, consisting of reinforced concrete pipe, ditches, walls, inlets and other appurtenances. 12. That a reinforced concrete pipe culvert be constructed from the southwesterly end of the concrete pipe culverts now in place at the intersection of Coast Boulevard and Marguerite Avenue; thence southwesterly in and along Coast Boulevard, and across the intersection of Marguerite Avenue, and in and along Pacific Drive, to a line 15 feet northwesterly of and parallel with the north- easterly prolongation of the northwesterly line of that partc8 Marguerite Avenue lying southwesterly of Pacific Drive. 13. That a reinforced concrete pipe culvert, together with catch basin and other appurtenances, be constructed in and along the southwesterly portion of Hazel Drive. 14. That a reinforced concrete pipe drain, together with catch basin and other appurtenances, be constructed in that certain alley in Block A, in the aforesaid Tract No. 673, said alley lying southeasterly of Hazel Drive. 15. That a reinforced concrete pipe drain, together with catch basin and other appurtenances, be constructed in the intersection of Carnation Avenue and Ocean Boulevard. u. 16. That^ reinforced concrete pipe drain, together with catch basin and other appurtenances, be constructed in the intersection of Ocean Boulevard and Goldenrod Avenue. 17. That a reinforced concrete pipe drain, together with catch basin and other appurtenances, be constructed in and along the southerly portion of Ocean Boulevard between Heliotrope Avenue and Goldenrod Avenue. 18. That a reinforced concrete pipe drain, together with catch basin and other appurtenances, be constructed in the inter- - 12 - • • Y U section of Ocean Boulevard and Orchid Avenue. 19. That a reinforced concrete pipe drain, together with catch basin and other appurtenances, be constructed in the intersection of Poppy Avenue and Ocean Boulevard. 20. That guard fences be constructed in the following locations: (a) Across Fernleaf Avenue, along a line, which line is 210 feet northeasterly of and parallel with the northeasterly line of Seaview Avenue; (b) Across Goldenrod Avenue, along a line, which line is 230 feet northeasterly of and parallel with the northeasterly line of Seaview Avenue; (c) Across Heliotrope Avenue, along a line, which line is 300 feet northeasterly of and parallel with the northeasterly line of Seaview Avenue; (d) Across Iris Avenue, along a line, which line is 320 feet northeasterly of and parallel with the ncrtheasterly line of Seaview Avenue; (e) Across Jasmine Avenue, along a line, which line is 280 feet northeasterly of and parallel with the northeasterly line of Seaview Avenue; (f) Across Larkspur Avenue, along a line, which line is 340 feet northeasterly of and parallel with the northeasterly line of Seaview Avenue; 21. That cement concrete steps, cement concrete landings, cement concrete curb and gutter, together with handrails and other appurtenances, be constructed in the intersection of Ocean Boulevard Is and Goldenrod Avenue, and in a portion of that part of Goldenrod � �o�ea�`- 1W Avenue lying southwester y of cean oulevard. 22. That cement concrete steps, cement concrete landings, cement concrete curb and gutter, handrails and other appurtenances be constructed in the intersection of Ocean Boulevard and Heliotrope Avenue, and in that portion of Heliotrope Avenue lying southwesterly '-- uts�oean Boulevard. - 13 - C 23. For all purposes of this proceeding, that certain public street in the City of Newport Beach described as beginning at the • northwesterly corner of Lot 34, Block A -36, of Corona del Mar, as per map thereof recorded in Miscellaneous Maps, Book 3, pages 41 and 42, Records of Orange County, California; thence southeasterly along the northeasterly line of said Lot 34, a distance of 60.48 feet to a point; thence southwesterly around a circular curve with a radius of 40 feet concave to the southeast, a distance of 50 feet, to a point; thence South 40 degrees West, along a line, which line is 30 feet southeasterly of and parallel with the northwesterly line of the aforesaid Block A -36, a distance of 151.13 feet to a point in.the southwesterly line of Lot 24, of the aforesaid Block A -36; thence southwesterly in a direct line, to the southwesterly corner of Lot 22, of the aforesaid Block A -36, a distance of 49.97 feet to a point; thence North 40 degrees East, along the north- westerly line of the aforesaid Block A -36, a distance of 210 feet, to the place of beginning, is herein referred to and designated as a part of Irie Avenue, and the name thereof is hereby declared to be and established as Iris Avenue, and so referred to. 24. For all purposes of this proceeding, all that certain piece or parcel of land lying between the northeasterly prolonga- tion of the northwesterly line of that part of Marguerite Avenue lying southwesterly of Pacific Drive, and a line, which line is 175 feet northwesterly of and parallel with the southwesterly pro- longation of the northwesterly line of that part of Carnation Avenue lying northeasterly of First Avenue, Hellman Commercial Trust and Savings County Road purposes, as recorded in Records of Orange County,California, property which was, on the 25th day heretofore deeded by the Bank, to Orange County, for Deed Book 282, page 172, together with that certain :)f August, 1926, conveyed tc the City of Newport Beach, for public street and highway purposes, - 1 4 - � K Pacific Drive, and so referred to. All of the foregoing work and improvement is fully set forth, delineated and described on plans, profiles, cross - sections and detailed drawings No. 328, on file in the office of the City Engineer of said City, heretofore approved by the Board of Trustees of the City of Newport Beach on the /sue day of �re6er , 1926, by Resolution No. and in further accordance with Specifications No. 39, adopted by Resolution No. 346, and Specifi- cations No. 40, adopted by Resolution No. 368, of the Board of Trustees of the City of Newport Beach, and on file in the office of the City Clerk of said City. The said plans, profiles, cross - sections, detailed drawings and specifications are hereby referred to for the full and detailed description of the "said proposed work and improvement. The grades to which the work provided for shall be done, and the improvement made upon those portions of the streets herein - before described, which are provided for in this Resolution, are the grades shown on the profiles therefor on file in the office of the City Engineer of said City, to which said profiles reference is hereby made for the description of said grades. SECTION II. Notice is hereby given that serial bonds to represent unpaid assessments and bear interest at the rate of seven (7) per cent per annum will be issued hereunder, in the manner provided by the Improvement Bond Act of,1915, the last installment of which bonds shall mature fourteen (14) years from the second day of July next succeeding ten (10) months from their date. - 15 - by.A. All of the foregoing work and improvement is fully set forth, delineated and described on plans, profiles, cross - sections and detailed drawings No. 328, on file in the office of the City Engineer of said City, heretofore approved by the Board of Trustees of the City of Newport Beach on the /sue day of �re6er , 1926, by Resolution No. and in further accordance with Specifications No. 39, adopted by Resolution No. 346, and Specifi- cations No. 40, adopted by Resolution No. 368, of the Board of Trustees of the City of Newport Beach, and on file in the office of the City Clerk of said City. The said plans, profiles, cross - sections, detailed drawings and specifications are hereby referred to for the full and detailed description of the "said proposed work and improvement. The grades to which the work provided for shall be done, and the improvement made upon those portions of the streets herein - before described, which are provided for in this Resolution, are the grades shown on the profiles therefor on file in the office of the City Engineer of said City, to which said profiles reference is hereby made for the description of said grades. SECTION II. Notice is hereby given that serial bonds to represent unpaid assessments and bear interest at the rate of seven (7) per cent per annum will be issued hereunder, in the manner provided by the Improvement Bond Act of,1915, the last installment of which bonds shall mature fourteen (14) years from the second day of July next succeeding ten (10) months from their date. - 15 - • SECTION_ III That the contemplated work and improvement hereinbefore mentioned is, in the opinion of said Board of Trustees, of more than local or ordinary public benefit, and the expense of said work and improvement is made chargeable upon a district hereinafter described, and said Board of Trustees does hereby declare said district to be the district benefited by said work and improvement, and to be assessed to pay the costs and expenses thereof, which district is bounded and described as follows, to -wit: Beginning at the most northerly corner of Lot 21, Block 734, of Corona del Mar, as per map thereof recorded in Miscellaneous Maps, Book 3, pages 41 and 42, Records of Orange County, California; thence easterly along the north- erly line of the last mentioned Lot 4, to the northeasterly corner of the last mentioned Lot 4; thence northeasterly in a direct line to the northwesterly corner of Lot 4, Block N, of the last mentioned Tract No. 323; thence easterly along the northerly line of the last mentioned Lot 4, to the northeasterly corner thereof; thence northerly in a direct line to the most westerly corner of Lot 9, Block 834, of the aforesaid map of Corona del Mar; thence north- easterly in a direct line, to the place of beginning, excepting therefrom any lands forming any part of any public street or alley. The above description is general only. A plat or map of said District, No. 329, adopted by Resolution No.,3Z , of the Board of Trustees of said City, indicating by a boundary line the - 18 - i I z ir • extent of the territory included in the proposed district, is on file in the office of the City Clerk. Reference is hereby made to said plat or map for a further full and complete description of the said assessment district. The said map or plat so on file shall govern for all details as to the extent of the said assessment district. SECTION IV. Notice is hereby given that on Monday, the 2 " —°day of 1926, at 7:30 o'clock, P.M., in the Council Chamber of the City Hall of the said City of Newport Beach, any and all persons having any objections to the proposed work or im- provement or to the extent of the district, or both, may appear before the said Board of Trustees and show cause why said proposed improvement should not be carried out in accordance with this Resolution. SECTION V. The Newport News, a weekly newspaper printed, published and circulated in the City of Newport Beach, is b3mreby designated as the newspaper in which this Resolution of Intention shall be published, and for the publication of all other notices, resolu- tions, orders or other matter required to be published by the pro- visions of the Improvement Act of 1911, hereinafter referred to, and the City Clerk of said City is hereby directed to cause this Resolution of Intention to be published by two insertions in said newspaper in the manner and form required by law. The Board of Trustees do not deem it advisable that the Clerk mail copies of the notice of improvement to owners, or reputed owners, and he is not qW required to mail the same. - 19 - • SECTION VI. The Street Superintendent of said City shall, after the • adoption of said Resolution of Intention, cause to be conspicuously posted along the lines of said contemplated work or improvement, and along all the open streets within the hereinbefore described assessment district, notices of the passage of this Resolution of Intention, in the manner ifnd form required by law. SECTION VII. Except as hereinbefore stated, all the proceedings for the aforesaid work and improvement shall be had and taken under and in accordance with the provisions of an Act of the Legislature of the State of California designated as the "Improvement Act of 1911 ", approved April 7th, 1911, and Amendments thereto.
