RESOLUTION NO.
• 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CANCELLING A CERTAIN LEASE BADE
4 AND ENTERED INTO THE let DAY OF DECEMBER, 1926,
BY AND BETWEEN THE CITY OF NEWPORT BEACH, THEREIN
5 DESIGNATED LESSOR, AND WALTER EASTLACK, THEREIN
DESIGNATED LESSEE, AND AGREEING TO GIVE SAID
6 WALTER EASTLACK OR HIS ASSIGNEES A NEW LEASE ON
CERTAIN OTHER DESCRIBED REAL PROPERTY.

8 WHEREAS, on or about the let day of December, 1926,
9 the City of Newport Beach granted to WALTER EASTLACK, for a
10 designated term, a certain lease on real property belonging
11 to the City of Newport Beach; and
12 WHEREAS, said lease was assigned by said Walter
13 Eaetlack, with the consent of the City of Newport Beach, to
14 ��,/ (/�� , of the City of Newport Beach, and
15 WHEREAS, it appears that said Walter Eaetlack, or
16 his assignees, have constructed a building on said real property
17 which they assumed to be the property leased under the terms
18 and provisions of the lease heretofore mentioned; and
19 WHEREAS, it now transpires that said building was
20 constructed on other property belonging to the said City of
21 Newport Beach, and
22 WHEREAS, the said City of Newport Beach needs the
23 property leased to the said Walter Eaetlack as aforesaid, for
24 city purposes; and

WHEREAS, the City of Newport Beach has agreed and
26 does hereby agree to cancel said first lease and to give t
27 said Walter Eaetlack or his assignees, a new lease on the
.� 28 now occupied by them, and described as follows, to -wit:
29 A parcel of land 12 feet by 20 feet, being a
30 portion of Lot 9 in Block 9, Balboa Tract, as re-
corded in Miscellaneous Baps, Book 4, page 11, Recc
31 of Orange County, California, and more particularly
described as follows: -

Beginning at a point in the southerly line of
said lot and said block, which point is 12 feet west-
erly of-the southeast corner of said lot; running
thence northerly along a line parallel to and 12 feet
westerly of the easterly line of said lot a distance
of 20 feet; thence westerly along a line parallel to
and 20 feet northerly of the southerly line of said
lot a distance of 12 feet; thence southerly along a
line parallel to and 24 feet westerly of the said
easterly line of said lot a distance of 20 feet to a
point in the southerly line of said lot; thence east-
erly 12 feet to the point of beginning.
In consideration of the cancellation of said old
lease, being the lease heretofore described.
NOW, THEREFORE, BE IT RESOLVED; That said lease
dated the let day of December, 1926, between the City of Newport
Beach and Walter Eastlack, as aforesaid, be cancelled by writing
thereon a written cancellation signed by the City of Newport
Beach, by. its Mayor, and attested by the signature and seal
of the Clerk of the said City of Newport Beach, and executed
and snigned by Walter Eastlack and his assignee

BE IT FURTHER RESOLVED; That a new lease be �given
to Walter Eastlack or his assignee , /2srvyr��.r�
on the property heretofore particularly described, under the
same terms and conditions as said old lease; said lease to be
delivered to said Walter Eastlack or his assignee, upon the
cancellation of said first described lease and the payment
of any rental due under the terms of said first described lease.
I hereby certify that the foregoing Resolution was
regularly introduced and passed by the City Council of the City
of Newport Beach, at a regular meeting thereof held on the 8th
day,of April, 1929, by the following vote, to —wit:
