HomeMy WebLinkAbout498 - Ocean Boulevard & Other VacanciesRESOLUTIOiS NO. yt. • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DECLARING VACANT FOR PUBLIC STREET PURPOSES, A CERTAIN PORTION OF OCEAN DRIVE, A CERTAIN PORTION OF TUSTIN AVENUE, A CERTAIN PORTION OF TENTH STREET, A CERTAIN PORTION OF FULLERTON AVENUE, A CERTAIN PORTION OF IRVIFF AVENUE, CERTAIN ALLEYS AND CERTAIN PORTIONS OF ALLEYS WITHIN THE SAID CITY. WHEREAS, The City Council of the City of Newport Beach, on the 3rd day of December, 1928, at a regular meeting of said City Council held on that date, duly passed and adopted a Resolution being Resolution No. 479; entitled, "A Resolution of the City Council of the City of Newport Beach declaring their intention to vacate, close -up and abandon for public street purposes, a certain portion of Ocean Drive, a certain portion of Tustin Avenue, a certain portion of Tenth Street, a certain por- tion.of Fullerton Avenue, a certain portion of Irvine Avenue, certain alleys and certain portions of alleys within the said City ", and WHEREAS, The Street Superintendent of the City of Newport Beach after the passage of said Resolution caused to be conspicuously posted along the line of said contemplated improve - 0 ment at not more than three hundred (300) feet in distance apart upon said street, drive, avenues and alleys, and not less than three (3) in all upon said street, drive, avenues and alleys, notices of the passage of said resolution, said notice being headed, "Notice of Public Work ", in letters not less than one inch • in length and stating the fact of the passage of said Resolution, its date, and briefly the work of improvement proposed, being that of vacating the above named street, drive, avenues and alleys as hereinafter described, and the said notice herein mentioned re- (erred to said Resolution for further particulars; said Street Superintendent having also caused a notice similar to that here- -1- •s inbefore referred to to be published by four (4) successive in- sertions in the Newport News, a weekly newspaper printed, publish- ed and circulated in said City of Newport Beach (there being no rdaily newspaper so printed, published and circulated in said City), and more than ten (10) days after the expiration of the time of publication of said notice having elapsed and no objections to the said improvement have been delivered to the City Clerk of the City of Newport Beach, and the said Board of Trustees having ac- quired jurisdiction to order the vacation of said street, drive, avenues and alleys, as hereinafter described, THEREFORE, The City Council of the City of Newport Beach do ordain as follows: SECTION 1. That that portion of the public street, drive, avenues and alleys hereinafter described within the said City be closed up, vacated and abandoned for public street purposes; that the public interest and convenience require said closing up, vacating and abandoning; the said portions of said street, drive, avenues and alleys so closed up, vacated and abandoned for public street purposes are described as follows, to -wit: (a) All that portion of Ocean Drive within said city as said Ocean Drive is laid out and shown upon a map of the First Addition to Newport Heights, as recorded in Miscellaneous Maps, Book 4, Page 94, records of Orange County, California, from the southwesterly prolongation of the southeasterly line of Riverside Avenue southerly to the south- westerly prolongation of the northwesterly line of Tustin Avenue, and all that portion of Ocean Drive from the westerly line of Tustin Avenue southerly of 12th Street, westerly, southwesterly, southerly and easterly--to the northwesterly line of Irvine Avenue. • (b) All that portion of Tustin Avenue within said city as said Tustin Avenue is laid out and shown upon said map of the First Addition to Newport Heights, from the northwesterly prolongation of the south- westerly line of 12th Street southerly to the north- erly line of Ocean Drive and the southwesterly pro- longation of the northwesterly line of E1 Modena Avenue. -2_ • 0 (c) All that portion of Fullerton Avenue within said city, as said Fullerton Avenue is laid out and shown upon said map of the First Addition to Newport Heights from the southwesterly line of Ocean Drive, southwesterly to the northeasterly line of 10th Street. (d) All that portion of 10th Street within said city, as said 10th Street is laid out and shown upon said map of the First Addition to Newport Heights, from a line which bears South 280 69' 30" West from the south- easterly corner of Lot 2, Block "A" of the said First Addition to Newport Heights, southeasterly to the southwesterly prolongation of the Northwesterly line of Irvine Avenue. (e) All that portion of Irvine said Irvine Avenue is laid of the First Addition of N southeasterly prolongation Ocean Drive, southwesterly 10th Street. Avenue within said city, as out and shown upon said map :wport Heights, from the of the northeasterly line of to the southwesterly line of (f) All that portion of that certain 16 foot alley within said city in Block 16 of the said First Addition to Newport Heights, from the southwesterly line of 12th Street, southerly to the northwesterly line of E1 Modena Avenue. (g) All that portion of that certain 16 foot alley within said city in Block 17 of the said First Addition to Newport Heights, from the southeasterly line of E1 Modena Avenue southeasterly to the northwesterly line of Aliso Avenue and from the southeasterly prolongation of the southwesterly line of Lot 7 of said Block 17, northeasterly to the southeasterly prolongation of the northeasterly line of said Lot 7. (h) All that portion of that certain 16 foot alley within the said city, in Block 18 of the said First Addition to Newport Heights, from the southeasterly line of Aliso Avenue, southeasterly to the Northwesterly line of Fullerton Avenue and from the southeasterly pro- longation of the southwesterly line of Lot 7 of said Block 18, northeasterly to the southeasterly prolong - ation of the northeasterly line of said Lot 7. (i) All that portion of that certain 16 foot alley within the said City in Block 19 of the said First Add- ition to Newport Heights, from the southeasterly line of Fullerton Avenue, southeasterly to the north- westerly line of Irvine Avenue and from the south- easterly prolongation of the southwesterly line of Lot 7 of said Block 19, northeasterly to the south- easterly prolongation of the northeasterly line of .said Lot 7. (j) All that portion of that certain 16 foot alley within the said city, in Block 16 of the said First Addition to Newport Heights from the westerly line of Tustin Avenue, westerly and northwesterly, to the southerly line of Ocean Drive. -3- 4 p • (k) All that portion of that certain 15 foot alley within the said city in Block 25 of the said First Addition to Newport Heights from the northwesterly line of Tustin Avenue, northwesterly to the southeasterly line of Riverside Avenue. SECTION 11. That the public work herein provided for is the closing up C . _ . of the (street, drive, avenues and alleys herein described in Section 1, and it appearing to the City Council that there are no costs, damages or expense occasioned by or arising out of said "work, and that no assessment is necessary to pay the costs, damages or expenses of said work, and that therefore no commissioners shall be appointed to assess benefits and damages. SECTION 111. The City Clerk shall certify to the passage of this Resolution and shall cause the same to be published by one inser- tion in the Newport News, a vreekly newspaper printed, published and circulated in said City, and which is hereby designated for that purpose. - Passed and approved this rd day of 1929. ayor of hf City of Nermort Beach.
