RESOLUTION NO. O-Q :f.
RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH TERMINATING THAT CERTAIN
LEASE LADE AND ENTERED INTO BEMEN SAID CITY
AND t +ILLIAM HOWARD, THE 16TH DAY OF JULY,1928.
WHEREAS, it is represented to the City Council of
the City of Newport Beach by the City Engineer of said city,
that William Howard, has abandoned that certain lease made and
entered into by and between the City of Newport Beach, therein
designated as the party of the first part, and William Howard,
therein designated as the party of the second part, which lease
is dated July 16th, 1928; and
WHEREAS, it likewise appearing to said City Council
that all the terms and conditions of said lease have been
violated by said William Howard in that he has not paid the
rent provided for by said lease, nor has he kept, observed or
performed any of the terms and conditions thereof; and
WHEREAS, it further appearing that William Howard's
present address is unknown and that he no longer resides in the
City of Newport Beach and that notice cannot be served upon him
as provided by said lease, or at all.
NOW, THEREFORE, BE IT RESOLVED: That said lease
dated July 16th, 1928, between the City of Newport Beach, party
of the f irst part, and William Howard, party of the second part,
be and the same is hereby terminated and ended, and of no
further force or effect for any purpose whatsoever; and
BE IT FURTHER RESOLVED: That a copy of this
resolution be served upon any person occupying said dump ground
by the Chief of Police of the City of Newport Beach, and that
said Chief of Police make due and legal return of his proceedin
had herein.
