RESOLUTION N0. cZ 7,2 .
WHEREAS, the public necessity and interest of the
people of the City of Newport Beach do require the widening of
Bay Avenue and Cypress Avenue, public streets in the City of
Newport Beach, at the intersection of said two streets, by the
acquisition of the real property hereinafter described, and for
that purpose and for such public use it is necessary that that
certain parcel or piece of land hereinafter described be acquired
by said City of Newport Beach by condemnation, namely, the follow
ing described real property situated in the City of Newport Beach
County of Orange, State of California, and more particularly
described as follows, to -wit:
All that portion of Lot 1 in Block 2, as shown
upon a map of the Balboa Tract as recorded in Miscellaneous
Maps, Book 4, page 11, Records of Orange County, California;
beginning at the most easterly corner of said Lot 1; running
thence northwesterly along the northeasterly line of said
Lot 1 to a point, which is 5 feet, southeasterly from the
most northerly corner of said Lot 1; thence westerly in a
direct line to a point in the northwesterly line of said Lot
1, which point is 4.8 feet southwesterly from the most north-
erly corner of said Lot 1; thence southwesterly along the
said northwesterly line a distance of 6.89 feet to a point;
thence southeasterly in a direct line to the point of be-
ginning.
Further reference is hereby made to the City
Engineer's map No. on file herein, on which the
location of said parcel of land herein described is accurately
shown.
NOW, THEREFORE, BE IT RESOLVED: That it is the
finding and determination of the City Council of. the City of
Newport Beach that the public interest and necessity require
the acquisition by the City of Newport Beach of that certain pie
or parcel of land hereinbefore described for a public purpose,
namely, for public highway purposes, and for the widening, con-

struction and completion of two certain public highways in said

City, to —wit: Bay Avenue and Cypress Avenue, at the intersection

thereof; and

BE IT FURTHER RESOLVED: That said certain piece
5
or parcel of land hereinbefore described be condemned for a pub-
6
lic purpose, namely, for a public highway and for the widening
7
of two certain public streets of said City, to. -wit: BayAvenue and
8
Cypress Avenue, public streets of said City, at the intersection
9
thereof, and the construction and completion of said highways
10
by the widening thereof, and the City Attorney of the City of
11
Newport Beach is hereby directed to institute proceedings in the
12
Superior Court of the State of California, in and for the County
13
of Orange, for the condemnation of said parcel of land hereinbe-
14
fore described for public street purposes and to take all steps
15
necessary for the condemnation of said pieces or parcels of
16
land, in the name of said city.

I hereby certify that the foregoing Resolution
18
was duly and regularly passed by the City Council of the City of
19
Newport Beach at a regular meeting thereof, held on the 13th day
20
of January, 1930, by the following vote, —wit:
