RESOLUTION NO. 577 RESOLUTION ORDERING IMPROVEMENT WHEREAS, the City Council of the City of Newport Beach on the 9th day of December, 1929, passed its Resolution of Intention No. 554, to order the hereinafter described improve- ment to be made and public work to be done in the City of Newport Beach; and WHEREAS, after the passage and adoption of Resolution of Intention No. 554, the Street Superintendent of the City of Newport Beach conspicuously posted along the line of the con- templated work and improvement at not more than three hundred (300) feet in distance apart, and 3- in all, notices of the passage of said Resolution of Intention, headed NOTICE OF PUBLIC WORK, in the manner, form and substance as required by law, and said Street Superintendent also caused a notice similar in substances to be published by four (4) consecutive insertions in NEWPORT NEWS, a weekly newspaper published and circulated and of general circulation in the City of Newport Beach, California, and named by said City Council in said Resolution of Intention, as,the paper in which said notice should appear, all as appears from the affidavit of Sam Meyers, owner, printer and publisher of said weekly newspaper,, and which affidavit was filed in the office of the Clerk of the City of Newport Beach on the 31,4 day of 19 3 4 and is now on file therein; and WHEREAS, the Street Superintendent of the City of Newport Beach commenced the posting of the notices hereinbefore referred to on the /;7d-.day of 19 ", and fully complete the posting thereof on the /day of ��e� r�r y , 19?�, as appears from the affidavit of John A. CALIF. of the City of Newport Beach, and more than ten (10) days having expired after the expiration of the time of the publica- tion of said notice within which protests or objections to the proposed work or improvement might be made by any person interested objecting to said work or improvement, or to the extent of the district or lande to b e affected or benefited by said work or improvement and to be assessed to pay the costs and expenses thereof; and WHEREAS, at the next meeting of the City Council after the expiration of said ten days after the expiration of the time of the publication of said notice, and no objection to said work or improvement having been made or on file, why said propos improvement should not be carried out in accordance with said Resolution of Intention, theCity Council of the City of Newport Beach having now acquired jurisdiction to order the proposed improvement: IT IS HEREBY RESOLVED AND ORDERED: That the public interest and convenience requires the work hereinafter described and the City Council of the City of Newport Beach hereby orders the following work to be done and improvement made in the City of NewportBeach, as follows; That the following portion of that certain alley in said City be closed up and abandoned, which alley to be abandoned is described as follows, to -vat: A portion of that certain ten (10) foot alley in Block 1, East Newport, as shown upon a map record- ed in Miscellaneous Maps, Book 3, page 37, Records of Orange County, California, described as follows: Beginning at the southeast corner of Lot 12 of mid Block 1; running thence northerly along the east- erly line,and the northerly prolongation of the easterly line of said Lot 12 to an intersection with the westerly prolongation of'the northerly'line of Lot 13 of said Block 1; thence easterly in a direct line to the northwesterly corner of said Lot 13; thence southerly along the westerly line of said Lot 13 to the southwesterly corner of said Lot 13; thence westerly in a direct line to the point of beginning. -2- 43,. 1 • 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17' 18 19' 20 21 22 23 24 25 26 t r All of which is more clearly shown on a certain map approved and adopted by the City Council of the City of Newport Beach for the said abandonment by Resolution No. 553, on the 9th day of December, 1929. The public work ordered and the improvement to be made is for the purpose of closing up and abandoning a portion of the hereinbefore described alley, and for that reason no district is chargeable therewith. All of the herein proposed work shall be done in Pursuance of an Act of the Legislature of the State of California designated "Street Opening Act of 188911, and amendments thereto. For further particulars reference is hereby made to I said Resolution of Intention No. 554, which is dated the 9th day of December, 1929, and on file with the Clerk of th t of Newport Beach. �\ The Clerk of the City of Newport Beach is herewith instructed to record a copy of this Resolution Ordering Improve- ment in the Office of the County Recorder of the County of Orange State of California.
