-WHEREAS, pursuant to instructions, the City Attorney

of the City of Newport Beach has prepared a contract in which thel
5
City of Newport Beach agrees to sell to Z( V �RODGER$ and
6
d. ac✓_ RODGER?, doing business under the name. of
7
RODGER$ BROS. certain excess water of said city, upon the con -
8
ditions, restrictions and limitations in said contract set forth;
9
and
10
WHEREAS, said contract has been duly presented by said
11
City Attorney of the City of Newport Beach to the City Council of
12
said city, for its acceptance and approval.

NOW, THEREFORE, BE IT RESOLVED: That that certain con -
14
tract made and entered into the .2 ZZ"d day of March, 1930 by and
15
between the City of Newport Beach as the party of the first part,.
16
and RODGER$ and RODGER$, doing business
17
under the name of RODGER$ BROS. as parties of the second part,
18
and wherein and whereby the City of Newport Beach agrees to sell
19
certain of its excess water upon certain conditions, restrictions
20
and limitations to said second parties, be and the same is hereby
21
approved as written.

BE IT FURTHER RESOLVED: That the Mayor and City Clerk
23
of the City of Newport Beach be authorized and directed to sign
24
said contract on behalf of said City of Newport Beach.

I hereby certify that the foregoing resolution was duly
26
and regularly passed by theCity Council of the City of Newport
27

Beach at a regular meeting thereof held on the<2<fd day of March,

1930., by the following vote, to -wit:
