RESOLUTION NO. l 13,
WHEREAS, the City of Newport Beach has acquired by
deed a ten (10) foot easement for highway purposes at 28th I
Street across a portion of the tight of. way of the_.Paciflo Eiectjic
Railway Company; which said easement is by deed recorded in
Book 534, page 394, Records of Orange County, California, and
bears date as of September 3, 1924; and
WHEREAS, the City of Newport Beach is desirous of
constructing a grade crossing at said 28th Street in said City
of Newport Beach; and
WHEREAS, it is necessary that the City obtain from
the Railroad Commission of the State of California, permission
authorizing the said City to construct said grade crossing.
NOW, THEREFORE, BE IT RESOLVED: That the City
Attorney of the City of Newport Beach be instructed and directed
to prepare the proper application for permission to construct
a grade crossing at 28th Street and Central Avenue in said City
of Newport Beach, and that the Mayor of said city be and he is
hereby authorized to sign said application on behalf of said
City of Newport Beach.
I hereby certify that the foregoing Resolution was
duly passed by the City Council of the City of Newport Beach at
a regular meeting thereof held on the 2nd day of June, 1930, by
the following vote, to -wit:
