MMEA5, pursuant to statute, notice of filing list of unpaid assessments Vas duly given in the manner and form required by law; that the warrant, assessment, and diagram recorded on the 21st day of July, 1930, for the work and improvement madg by HAROY L. :?OUSE upon that certain contract awarded to him on the 21st day Of April, 1930, on Bain Street and certain other streets and avenues within said City, and that said warrant, assessment 2nd diagram were returned to the Superintendent of Streets together with a written statement of all payments received upon the said assessment, and after the full expiration of thirty (30) full days from the date of said warrant, said Stre�'.t Superintendent duly made and filed with the City Clerk of said City of NewportBeaeh a complete list of all assessments unpaid upon the said assessment, which list is now on file in the office of the City Clerk of the said City, now upon evidence shown this Council determines that. the assessments therein mentioned were then unpaid, the total aggregate thereof being t1h -ne.x of Eight Thousand Six Hundred Thirty -three and 211100 Dollars That assessments numbered 165, 169, 27 and 28, ag,.lzegating the sum of Two Hundred Twenty -seven and 94/100 Dollars ( 227.9'0 ,and no others, have since been paid, and that there now remains unpaid the surer of Eighty -four Hundred Five and 27 /100 Dollars(57C,405.27) upon the assessments shown upon the said list other than tho ,,.c ;ierein- before last noted, as having been paid. Reference is hereby made to Resolution of Intention No. 583, of the City Council of the City of Neriaort fiee.ch, California, passed on the 17th day of ktarch, 1930, for a complete descri,,tion of the work herein mentioned and also the list of unpaid assessments filed as above noted, for the assessments unpaid, and AML qW s WHEREAS, interested persons were nmtified in .the manner required by'lav to appear before the City Council of said City of Newport Beach, California, in the Council Chamber of the City Hall in the said City, at the hour of seven- thirty (7:30) o'clobk p.m. of Honday, the 6th day of October, 1930, and shore cause shy' bonds should not be issued upon the security of the unpaid assessments shorn on the Street Superintendent's List, and !H01EAS, notice was duly given in the manner and force required by lain that serial bonds to represent unpaid assessments and bearing interest at the rote of seven (7) per cent per annum, will be issued hereunder in the Manner provided by the "Liprovowent Bond Act of 1915" the last installment of which bonds shell mature nine (9) years from the 2nd day of July next succeedin. ten (10) months from their date. And all interested persons having appeared before this City Council and having been given full opportunity tgohow cause uhy bonds should not be issued upon the security of the unpaid assess- meets shown on the said list, and all objections presented having been heard and considered, NOW, TWI E ORZ, %; IT RESOLED, th; t the City Council does hereby find and determine that no cause has been shown why bonds should not be issued up-on the security of the unpaid assessments, and does hereby overrule all objections thereto and does hereby direct the issuance of said bonds, and further BE IT HESOULD AS FOLLOWS: that serial bonds ah.11 be issued upon the security of the said unpaid assessments to the said amount of Eighty -four Hundred Five and 27,(100 (Q'84105.27). The said bonds shall be twenty in number, known as Series M and shall be dated the 6th day of October, 1930, and bear interest at the rate of seven (7) per cent per annum, andthe denominations of the said bonds and the dates of the respectivib maturities thereof shall be as follows: • i The first coupon of interest shall be for the interest frva the 23rd day of hu!gust, 1:.i0, to the 2nd day of January, 1932, and the several coupons of interest thereafter shp.11 be for the semi - annual int €.rest, anc$ BE IT F€T'4.1*1.: RZ'HOLI,XD, th•t the signature of the Trersurer of the City of Fertport Beach upon the coupons attached to the said bonds shall be lithographed or printed signature in place,6f signature by bn..nd, and BE IT LLSO _* St)L'. u, that the City Clerk of the said City of Hew port $ Uch, Cali ornia, be and lie is horeby authorized and directed to deliver forthLith the bonds hereinbefore enumdrvted to G.
