A RESOLUTION NO. L 3 O A RESOLUTION. OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, DECLARING THEIR INTENTION TO ORDER THE CLOSING OP AND ABANDONMENT OF A CERTAIN STREET KNOWN AS 34TH STREET, BETWEEN RAILROAD AVENUE and THE ALLEY TO THE EAST OF RAILROAD AVENUE, IN THE CITY OF NEWPORT BEACH, DECLARING IT TO BE FOR THE PUBLIC INTEREST AND CONVENIENCE, AND FIXING THE TIME AND PLACE FOR HEARING OBJECTIONS TO SAID PRO- POSED IMPROVEMENT. The City Council of the City of Newport Beach, pursuant to the provisions of an Act of the Legislature of the State of California, known as "Street Opening Act of 1889" approved March. 6th, 1889, and amendments thereto, do resolve and declare as follows: Section I* That the public interest and convenience requires the closing up and abandonment of that certain street as hereinafter described, in the City of Newport Beach, and it Is the intention of the City Council of the City of Newport Beach to order the following street in said City to be closed up and abandoned, to —wit: All that portion of 34th Street in the City of Newport Beach, Orange County, California, described as follows, to —wit: Beginning at the Northwesterly corner of Lot Nine (9) Block 432 as laid out and shown upon the map of Canal Section, recorded in Miscellaneous Maps, Book 4, page_ 98, Records of Orange County, California; running thence Easterly along the northerly line of said Lot Nine (9) , a distance of 90 feet to the Northeasterly corner of said Lot Nine (9); thence Northerly along a curve concave to the East and having a radius of 2924.93 feet, a distance of 30 feet to the southeasterly corner of Lot One (1) Block 532 of said Canal Section; thence Westerly along the southerly line of said Lot One (1) a distance of 90 feet to the southwesterly corner.of said Lot One (1); thence southerly along a curve concave to the East and having a radius of 3014.93 feet a distance of 30 feet to the point of beginning. —1— 1" 3 < 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 2e 2s 30 31 32 HOLAND THOMPSOP ATTORNEY AT LOW SANTA ONO. AD All of which is more clearly shown on a certain map appr -oved and adopted by the City Council of the City of Newport Beach for said abandonment by Resolution No. on the 6th day of October, 1930, Section 2. That the said City Council of the City of Newport Beach does further declare that the lots, lands or premises affected by the closing up and abandonment of the hereinbefore described street and benefited by said improvement are those certain parcels of real property described as follows, to -wit: Lot One 1) in Block 532, Canal Section, and Lot Nine (9), in Block 432, Canal Section, in the City of Newport Beach, Orange County, California. Section 3. That. the proceedings for the closing up of the aforesaid st'r`eet shall be had and taken under and in accordance with an Act of the Legislature of the State of California,. designated and known as "An Act to Provide for Laying,0ut, Opening .Extending, Widening, Straightening. or Closing up in Whole or in Part oi-any Street, Square, Lane, Alley, Court or Place within Municipalities, to Condemn and Acquire any and all Land and Property Necessary or Convenient for that Purpose ", approved March 6, 1889, and amendments thereto. Section 4. The Street Superintendent shall cause to be conspicuously posted along the line of said contemplated work .and improvement and at not more than 300 feet in distance apart, (but not less than three in all, notices of the passage of this resolution, in the form and manner as required by law; and he shall also cause a notice similar in substance, for a period of five (5) successive weeks, to be published in the Newport News, a weekly newspaper, published and circulated and of general (circulation in the City of Newport Beach, California, and hereby -2- 1 2 • 3 4 5 6 7 8 9 10 1.1 12 13 14 15 16 17' 18 19 20 21 22.' 2 3 2 4? 25 26 27 AOL 28 29 30 31 32 ROLAND THOMPSON .IT.. L11LIF. of • ' r: - x designated for that purpose by the City Council, containing a statement of the fact of the passage of this resolution of intention, the date thereof, and briefly describing the work or improvement proposed and referring to this resolution for further particulars. Section 5. That any person interested, objecting to said work or improvement, or to the extent of the district or lands to be affected or benefited by said work and improvement and to be assessed to pay the costs and expenses thereof, may make written objections to the same, within ten (10) days after the expiration of the time of)the publication of said notices, which objections shall be delivered to the Clerk of the City Council of the City of Newport Beach. I hereby certify that the foregoing Resolution was duly and regularly introduced, passed and adopted by the City Council of the City of Newport Beach, at a regular meeting thereof, held on the 6th day of October, 1930, by the following vote, to —wit: AYES , CnOUNCILMEN: C51 NOES, COUNCILMEN: "y ABSENT, COUNCILMEN: CityMerk of the City of Newpat Beach
