RESOLUTION NO. % 3
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, AUTHORIZING AND DIRECTING THE
SALE OF ALL OF THE RIGHT, TITLE AND INTEREST OF
THE CITY OF NEWPORT BEACH, IN AND TO CERTAIN REAL
PROPERTY OF SAID CITY, FIXING THE CONSIDERATION
THEREFOR, AND AUTHORIZING AND DIRECTING THE MAYOR
AND CITY CLERK OF SAID CITY TO EXECUTE A DEED TO
THE PURCHASER ON BEHALF OF SAID CITY.
WHEREAS, the City of Newport Beach has heretofore
leased to Newport Harbor Post No. 291 of the American Legion
the real property hereinafter described; and
WHEREAS, the title to said real property is defective
in certain particulars and it is necessary that suit or suits
be instituted thereon, for the purpose of clearing said title;
and
WHEREAS, the City of Newport Beach is desirous of
obtaining the right and privilege of constructing a highway
for street through and over said real property so leased, the
description of said property so reserved being contained in the
(description hereinafter mentioned as a reservation; and
WHEREAS, certain representations were made by the
Newport Harbor Post No. 291 of the American Legion, that they
will erect and construct a semi - public building on said real
property, when and if the title thereto is cleared of all defects;
and
WHEREAS, the Newport Harbor Post No. 291 of the Amer
Legion is a non - profit organization, composed of veterans of the
World's War of the City of Newport .Beach and vicinity, and is in
all respects an organization which should be encouraged in its
high aims and aspirations; and

WHEREAS, the city of Newport Beach is desirous of

assisting said Newport Harbor Post No. 291 of the American

Legion to the fullest extent; and
4
WHEREAS, it satisfactorily appearing to the City
5
Council of the City.of Newport Beach that it is for the benefit
6
and best interests of said City of Newport Beach to dispose of
7
said real property hereinafter described for the reasons herein-
8
after set forth; and

WHEREAS, it further satisfactorily appearing to said
10
City Council that said real property is vacant and unsuitable
11.
for use by said city, and is not now being used by said city, and
12
that the City has not the right to use the same, and further that
13
said City has no use for said premises; and
14
WHEREAS, said property is not any portion of any tide
15
lands or harbor front; and
16
WHEREAS, the City Council of the City of Newport Beach
17
deems that an adequate and sufficient consideration has been
18
offered to the City of Newport Beach by the Newport Harbor Post
19
'No. 291 of the American Legion, in that said street has been
20
given to said city, and the Newport .Harbor Post No. 291 of the
21
American Legion has further agreed to bear the expenses of im-
22
proving the same in so far as the street may run through
23
properties owned by them on either side thereof, and the said
24
Newport Harbor Post No. 291 of the American Legion has further
26
agreed to and will cancel the lease now on all of said premises.

NOW, THEREFORE, BE IT RESOLVED, that it would be for
27
the benefit and for the best interests of the City of Newport
28
Beach that the City of Newport Beach grant to the Newport Harbor
29
Post No. 291 of the American Legion, by quitclaim deed, all of
30
its right, title and interest in and to the following described
31
real property, reserving for road and street purposes the propert
32
therein reserved, all of which said property is more particulmrly
described as follows, to wit;

All that certain real property situate in the City of
Newport Beach, County of orange, State of California,
and more particularly described as follows, to -wit;
Beginning at the intersection of the easterly line of
Tenth Street and a line 210 feet northerly of and parallel
with the northerly line of Central Avenue (North Drive) as
said Tenth Street and Central Avenue are shown on the map of
Section "B ", Newport Beach, recorded it Book 4, page 27 of
Miscellaneous Maps records of Orange County, California;
thence easterly along a line, which is 210 feet northerly
of. and parallel with the northerly line of Central Avenue
(North Drive) to an intersection with a line, which line is
1 foot southwesterly of and parallel with the United States
Government meander line, said meander line being the north-
easterly boundary line of Lot 4, Section 34, Township 6
South, range 10 West, S. B. B. & M; thence southeasterly
along a line which line is 1 foot southwesterly of and
parallel with the aforesaid government meander line to its
intersection with a line, which line is 200 feet easterly
of and parallel with the northerly prolongation of the
easterly line of said Tenth Street; thence northerly along
a line, which line is 200 feet easterly of and parallel with
the northerly prolongation of the easterly line of said
Tenth Street to its intersection with the bulkhead line
extending from U. S. bulkhead Station No. 116 to U. S.
Bulkhead station No. 117, as said bulkhead line and bulkhead
stations are shown on Map of Newport Bay showing harbor
lines, approved by the War Department January 18th, 1917;
thence westerly along said bulkhead line to its intersection
with the northerly prolongation of the easterly line of
Tenth Street; thence southerly along the northerly pro-
longation of the easterly line of Tenth Street to the point
of beginning,
Reserving therefrom for road and street purposes the
following described property, to -wit;
All that certain real property situate in the City of
Newport Beach, County of Orange, State of California, and
more particularly described as follows, to -wit;
Beginning at a point in the northerly prolongation of the
easterly line of 10th Street, which point is 90 feet north-
erly of the intersection of the easterly prolongation of the
southerly line of Block 6, Tract 626, as laid out and shown
upon a map recorded in Miscellaneous maps, Book 30, pages
40 and 41, records of Orange County, California, with the
easterly line of 10th Street; running thence easterly along
a line parallel with the northerly line of Block 109, as
shown upon a map of Section "B ", Newport Beach, recorded
in Miscellaneous Maps, Book 4, page 27, records of Orange
County, California; a distance of 200 feet; thence north-
erly along a line parallel with the easterly line of 10th
Street, a distance of 50 feet; thence westerly along a line
parallel with the said northerly line of Block 109, of
Section "B ", Newport Beach, a distance of 200 feet to an
intersection with the northerly prolongation of the easterly
line of 10th Street; thence southerly along the northerly
prolongation of the easterly line of 10th Street, a distance
of 50 feet to the point of beginning.

That upon the cancellation of said lease agreement
between the City of Newport Beach as party of the first part,
and the Newport Harbor Post No. 291 of the American Legion,
as the party of the second part, a quitclaim deed be executed
and delivered to the said Newport Harbor Post No. 291 of the
American Legion, and the Mayor and City Clerk of said City of
Newport Beach are hereby directed to execute said deed on behalf
of said city, conveying all of the right, title and interest of
said City of Newport Beach, in and to said real property and the
whole thereof, except as to the property reserved for street and
road purposes.
I hereby certify that the foregoing Resolution was
duly and regularly passed by the City Council of the City of
Newport Beach at a regular meeting thereof held on the 3rd day
of November, 1930, by the following vote, to —wit:
