RESOLUTION NO. 41! w.
RESOLUTION REQUESTING CONSENT
OF THE COUNTY OF ORANGE TO THE ACQUISI-
TIONS CONTEMPLATED BY THE CITY OF NEW-
PORT BEACH, CALIFORNIA.
WHEREAS, the City Council of the City of Newport
Beach, California, did on the day of , 1930,
approve specifications for the acquisitions contemplated in
the matter of Acquisition and Improvement District.No. 2 of
the City of Newport Beach; and
WfU;REAS, sgid specifications were on the Z-77— day
of d ✓twi %r, 1930, filed with the City Clerk of the City
of Newport Beach; and
WHEREAS, the assessment district (as proposed) in
the matter of said Acquisition and Improvement District No. 2
of the City of Newport.Beach does not include any property
lying within the boundaries of unincorporated territory of the
County of Orange, State of California; and
WHEREAS, portions of the contemplated acquisitions
In said matter are within the boundaries of unincorporated
territory of the County of Orange; and
WHEREAS, it'is the judgment of this City Council
that the public interest, convenience and necessity require
the said proposed acquisitions and said acquisitions are nec-
essary and proper to complete, connect with and render of
greater use to the public certain existing public ways and
certain public property within the City of Newport Beach; and
WHEREAS, under Section 2 of the "Acquisition and

Improvement Act of 1925 ", as amended, it is necessary that
the consent of the legislative body of the County of Orange
be obtained to the said acquisitions within the territory
over which the County of Orange has jurisdiction and to the
commencement of proceedings for said proposed acquisitions
and to the exercise of jurisdiction by said City Council of
the City of Newport Beach over all proceedings necessary or
proper for consummating the same.
NOW, THEREFORE, BE IT RESOLVED that the consent of
the legislative body of the County of.Orange, expressed by
resolution, is hereby requested to
1. The making of the acquisitions referred to and
shown on the specifications so. approved and filed;
2. The commencement of the proceedings for the said
proposed acquisitions by the City Council of the
City of Newport Beach, California, and to the ex-
ercise of jurisdiction by said City Council of the
City of Newport Beach over all proceedings nec-
essary or proper for the purpose of consummating
the same, all in accordance with the provisions
of the "Acquisition and Improvement Act of 1925%
and amendments thereto;
M.
BE IT FURTHER RESOLVED, that a certified copy of the
.specifications now on file with the Clerk of the City Council
of the City of Newport Beach in the above entitled matter shall
be -filed with 'the Clerk of the Board of Supervisors of Orange
County; and
BE IT FURTHER RESOLVED, that a certified copy of this
resolution shall likewise be filed with the Clerk of the Board
of Supervisors of Orange County.
