N RESOLUTION NO. RESOLUTION ORDERING I16PROVEMENT ,WHEREAS, the City Council of the City.of Newport Beach on the 6th day of October, 1930, passed its Resolution of In- tention No. 630, to order the hereinafter improvement to be made and public work to be done in theCity of Newport Beach; and WHEREAS, after the passage and adoption of Resolution of Intention No. 630, the Street Superintendent of the City of Newport Beach donepicuously posted along the line of the contem- plated work and improvement at not more than three hundred (300) feet i n distance apart, and 3 in all, notices of the passage of said Resolution of Intention, headed, "NOTICE OF PUB WORKII, in the manner, form and substance as required--by law, and said Street Superintendent also caused a.notice similar in substance to be published for a period of five (5) weeks, in NEWPORT NEWS, a weekly newspaper, printed, published and circulatf in the City of Newport Beach, and named by said City Council in said Resolution of Intention as the paper in which said notice sh appear, all as appears from the affidavit of of the printers and publishers of said weekly newspaper, and which affidavit was filed in the office of the Clerk of the City of Newport Beach on the day of November, 1930, and is now on file therein; and WHEREAS, the Street Superintendent of the .City of Newport Beach commenced the posting of the notices hereinbefore referred to on the / 7 day of October, 1930, and fully completed the posting thereof on the 17 day of October, 1930, 1 as appears from the affidavit of R. L. Patterson, Street Super- 2 intendent of the City of Newport Beach, and more than ten (10) • 3 days having expired after the expiration of the time of the 4 publication of said notice within which protests or objections 5 to the proposed work or improvement might be made by any person 6 interested objecting to said work or improvement, or to the 7 extent of the district or lands to be affected -or benefited by 8 said work or improvement and to be assessed to pay the costs and .9 expenses thereof; and, 10 WHEREAS, at the next meeting of the City Council after • i 11 the expiration of said ten days after the expiration of the time 1.2 of the publication of said notice, and no objection to said work 13 or improvement having been made or on file, why said proposed 14 improvement should not be carried out in accordance with said 15 Resolution of Intention, the City Council of the City of Newport 16 Beach having now acquired jurisdiction to order the said improve- 17 me nt ; 18 IT IS HEREBY RESOLVED AND ORDERED: That the public 19 interest and convenience requires the work hereinafter described 20 and the City Council of the City of Newport Beach hereby orders 21 the following work to be done and improvement made in the City of 22 Newport Beach as follows: 23 That the following portion of 34th Street in the City 24 of Newport Beach as hereinafter described be closed•up and aband61 25 to -wit: 26 All that portion of 34th Street in the City of Newport Beach, Orange County, California, described 27 as follows, to —wit: 28 Beginning at the northwesterly corner of Lot 9, Block ' 432, as laid out and shown upon a map of Canal Section, 29 recorded in Miscellaneous Maps, Book 4 p page 98, Re- cords of Orange County$ California; running thence 30 easterly along the northerly line of said Lot 9 a dis- 31 tance of 90 feet to the northeasterly corner of said Lot 9; thence northerly along a curve concave to the 32 --I THOMPSON -2- .1.A..1 Al LAW SANTA AN^. CALIF. east and having a radius of 2924.93 feet a distance of 30 feet to the southeasterly corner of Lot 1, Block 532 of said Canal Section; thence westerly along the southerly line of said Lot 1 a distance of 90 feet to the southwesterly corner of said Lot 1; thence southerly along a curve concave to the east and having a radius of 3014.93 feet a distance of 30 feet to the point of beginning. All of which is more clearly shown on a certain map approved and adopted by the City Council of the City of Newport Beach for the said abandonment by Resolution No. 4.21f , on the 6th day of October, 1930. The public work ordered and the improvement to be made is for the purpose of closing up and abandoning a portion of 34th Street as hereinbefore described, and for that reason no district is chargeable therewith. All of the herein proposed work shall be done in pursuance of an Act of the Legislature of the State of Califo designated "Street Opening Act of 1889 ", and amendments thereto. For further particulars reference is hereby made to said Resolution. of Intention No. 630, which is dated the 6th day of October, 1930, and on file with the Clerk of the City of Newport Beach. The Clerk of the City of Newport Beach is herewith instructed to record a copy of this Resolution Ordering Improve- ment in the Office of the County Recorder of the County of Orange, State of California.
