"T A RESOLUTION OF THE CITY COUNCIL OF THE CITY • OF EMPORT BEACH, CALWORNIA, ORDERING VORK ON BAY AVENUE, UI1ITH STREET AND CERTAIN ALLEYS IN TRACT NO. 694 'UITHIA SAID CITY. �oa�ortco RESOLVED by the City Council of the City of Newport Beach, California, that the public interest and convenience require the work hereinafter mentioned to be done and therefor the said City Council hereby orders the following work to be done and improvements to be made in the said City, to -exit: The improvement of Bay Avenue, 9th Street and certain alleys in Tract No. 894 in the City of Newport Beach by certain grading, by the construction of certain cement concrete curb, cement concrete sidewalk, cement concrete pavement, vitrified clay pipe sanitary sewers, vitrified clay pipe house conn- ection sewers, brick manholes, cement concrete flush tank, cast iron pipe water mains, gate valves, valve boxes and covers, concrete valve chamber and cover, fittings and appur- tenances, cement concrete retaining wall, disintegrated granite roadway and the removal of certain cement concrete curb and sidewalk, _11 as more particularly described in Resolution of Intention No. 654, passed and adopted by the City Council of said city on the 2nd day of March, 1931, and on file in the office of the City Clerk of said City. For further particulars reference is hereby made to said Resolution of Intention No. 654 and to the plans and pro- files, being Plan No. 369, Sheets 1 to 3 inclusive, and Standard • Plans Nos. 1003, 1005, 1010, 1012, 1013, 1025, 1027, 1035 and 104:x, on file in the office of the City Engineer of said city and to specifications for the said work adopted by the City -1- •`� C et • L7 Council on the 2nd day of March, 1931, and on file in the office of the City Clerk of said City, and all of the said plans, pro- files and specifications heretofore approved by the City Council of said city are incorporated herein and made a part hereof, and reference is hereby made thereto for a more particular description of the said cork. Said City Council has determined and declared that the contemplated work or improvement hereinbefore mentioned, rras,in the opinion of the said City Council, of more than local or ordinary public benefit, and the said City Council has made the expenses of the said work chargeable upon a district. For a particular description of said assessment district, reference is hereby made to said Resolution of Intention No. 654. Said City Council has determined and declared that serial bonds bearing interest at the.rate of seven (7 %) per cent per annum be issued to represent each assessment of Tventy -five (025.00) Dollars or more remaining unpaid for thirty (30) days after the date of the warrant. Said serial bonds shall extend over a period ending nine (9) years from the 2nd day of January next succeeding the 15th day of the next Rovember following their date. Payments on the principal of unpaid assessments and Interest shall be made by the property owners to the City Treasurer, and the same shall be disbursed by him, all as pro- vided in the "Improvement Act of 1911" hereinbfter, referred to. All of the work herein ordered shall be done and carried through in accordance Trith the provisions of an Act of the Legis- lature of the State of California., designated as the "Improvement Act of 191111, approved April 7, 1911, and all acts amendatory thereto. The City Clerk of said City is hereby directed to post conspicuously for five (5) days on or near the Council Chamber -2- r.. door of said City Council in the manner and form required by law, a notice, with the specifications, inviting sealed proposals or bids for doing the work oYdered and the said City Clerk is hereby directed to publish twice in the Newport hews, a weekly news- paper published and circulated in the said City, and hereby designated for that purpose by the City Council, a notice inviting such proposals or bids for doing the said work and referring to the specifications and plans on file.
