CALM <br />RESOLUTION NO. <br />WHEREAS, there has tliis day been presented to the City <br />Counci the City of Neraport Beach an Agreement dated the llQ.- <br />day of. anuA w 1933 by and between the City of <br />Newport Beach, as the party of the first part, and C.E. McFarland,, <br />as the party of the second part; and <br />17HEREAS, said Agreement specifies that the party of the <br />first part is the owner of two certain piers or wharfs extending <br />out into the Pacific Ocean, one being at Newport Beach and the <br />other at Balboa; and <br />WHEREAS, the party of the second part is the owner of <br />stationary fishing barges anchored ordinarily vithin the three <br />mile limit of the shore line of the City of Newport Beach; and <br />WHEREAS, the party of the first part desires to regulate <br />the loading and unloading of passengers and patrons going to and <br />from said fishing barges anchored in the Pacific Ocean aforesaid, <br />in so far as said loading and unloading of passengers is done on <br />said piers or wharfs; and <br />WHEREAS, said party of the first part desires to grant <br />to the party of the second part the exclusive license for a per <br />of one year from the date of said agreement, to load and unload <br />passengers and patrons as aforesaid from said piers or wharfs to <br />said fishing barges, upon the terms and conditions in said <br />agreement set forth; and <br />:AREAS, it is for'tha best interests of the City of <br />Newport Beach that said %Aidnse be granted, <br />NOW, THEREFORE, BE IT RESOLVED: That said agreement be, <br />and the same is hereby approved as written by the City Council <br />of the City of Newport Beach, and the Mayor of said City and the <br />City Clerk of said city of Newport Beach shall, and they are <br />hereby authorized and directed to sign the same on behalf of the <br />City of Newport Beach, and the Clerk is directed to have the par <br />i <br />1 <br />2 <br />3 <br />:4 <br />• 5 <br />6 <br />7 <br />8 <br />9 <br />. 10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />29 <br />• 30 <br />31 <br />32 <br />J � ND THOMPSON <br />�ANEY AT LAW <br />\ANA.
