3 WHEREAS, pursuant to instructions, the City Attorney of
4 the City of Newport Beach has prepared a contract in which the
i`5 City of Newport Beach agrees to sell certain excess water of said
e city to Heinz Kaiser, upon the conditions, restrictions and
7 limit ations in said contract set forth; and
8 WHEREAS, said contract has been duly presented by the
9 City'Attorney to the City Council of the City of Newport Beach,
10 for its acceptance and approval.
11 NON, THEREFORE, BE IT RESOLVED: That that certain
12 contract made and entered into the 24th day of March, 1933, by
13 and between the City of Newport Beach as the party of the first
14 part, and Heinz Kaiser as the party of the second part, and where
15 in and whereby the City of Newport Beach agrees to sell certain
16 of its excess water upon certain conditions, restrictions and
17 limitations to said party of the second part, be and the same is
18 hereby approved as written.
19 BE IT FURTHER RESOLVED: That the Mayor and City Clerk
20 of the City of Newport Beach be authorized and directed to sign
21 said contract on behalf of said City of Newport Beach.
22 I hereby certify that the foregoing resolution was
23 duly and regularly.passed by the City Council of the City of
24 Newport Beach at a regular meeting thereof held on the 3rd day
25 of April, 1933, by the following vote, to -wit:
