HomeMy WebLinkAbout788 - Special Municipal Election - 5-5-1933n , 1 RESOLUTION NO. _ 2 DECLARING RESULT OF ELECTION w 5 WHEREAS, a special municipal election was held and 6 conducted in the City of Newport Beach, Orange County, 7 California, on Friday, the 5th day of May, 1933, which said 8 election was duly and regularly cassed by the City Council of 9 the City of Newport Beach, in the manner required by law; and 10 WHEREAS, it appears that notice of said election 111 was duly and regularly given; that voting precincts were 12 properly established; that election officers were appointed and I3 election supplies furnished, and that in all respects said 14 election was held and conducted, and the votes cast thereat 15 received and canvassed and the returns thereof made and declared 16 in time, form and manner as required by the laws of the State of 17 California, governing elections in cities of the sixth class; an 18 WHEREAS, the City Council of the City of Newport 19 Beach met at the Council Chambers of the City Council on Monday, 20 the 8th day of May, 1933, to canvass the returns of said electio 21 and to declare the result thereof, as a result of which the City 22 Council of the City of Newport Beach finds that the number of 23 votes cast, the propositions voted upon, and other matters as 24 required by law to be as hereinafter stated. 25 NOW, THEREFORE, BE IT RESOLVED: That said special 26 municipal election was held and conducted in the City of Newport 27 Beach, Orange County, California, on the 5th day of May, 1933, 28 in time, form and manner as required by law; that there were 29 three (3) voting precincts established for the purpose of holdin, 30 said election, consisting of a consolidation of the regular 31 election precincts established for holding state and county 32 elections, as follows: Consolidated Voting Precinct "kill com- ROLAND THOMPSON ATTORNZY AT LAW SANTA AMA. That the propositions voted upon,the number ofvotes given in each precinct and in the whole city, for and against the same, are as follows: PROPOSITION I Shall the sale of alcoholic liquors "YES" be licensed in this city, to -exit, the Precinct "A" 362 city of Newport Beach? Total number of those voting on proposition- 950 Total number voting "Yes" --- - - - - -- 591 Total number voting "No" ---- - - - - -- 359 RESOLVED further that the City Council of the City of Newport Beach as a canvassing board, has proceeded to count - all absent voter ballots which have been received or returned, which count was made-by said City Council as a canvassing board, by taking up such returned envelopes containing such ballots, separately in the presence of a majority of the members of the city council of the City of Newport Beach, acting as a canvassing board, in the present of the public in the City Council Chambers of the City of Neviport Beach, and said canvassing board did carefully compare the signature of the absentee voter on each of such envelopes with that on the registration affidavit of such voter, and the City Council, acting as such board, being satisfied that the signature on the voter's identificaticn envelope was the signature of such voter, and having announced in audible voice the name of such voter and each of such voters, and having opened the identification envelope containing the ballots.of such absentee voters without defacing the affidavit printed thereon or mutilating the enclosed ballots and without unfolding said ballots, having removed the number thereof, and having deposited the same in the ballot box provided for such purposes, the ballot box having been thoroughly shaken, and the ballots being taken out, the same were counted by the canvassing board and the result of such count on each proposition, said canvassing board now finds the result of such counting of absentee voters as follows: For Proposition No. 1, Total d'e*:;i74 �aaf R Yes r No ..3- 1 2 3 4 5 6 7 8 9 10 M41N 12 13 14 15 16 17 18 19 20 21 22 23 . 24 25 26 27 For Proposition No, 2, Total yo te's ensr Yes No 3 The City Council of the City of Newport Beach, further finds as a result of the counting of said absentee votes, when added to the total, that the number of "Yes" votes on Proposition No. 1 is and the number of "No" votes on Proposition No. 1 is that the number of "Yes" votes on Proposition No. 2 is X96 and the number of "No" votes. on Proposition No. 2 is F42, RESOLVED further, that at said special municipal election, Proposition No. l was duly and regularly carried, havi received a majority of the votes in favor thereof, as heretofore stated, and it further appearing that a majority of the votes cast are in favor of license. It is therefore declared by the City Council of the City of Newport Beach that the City of Newpo Beach shall immediately cease to be No License Territory, within the meaning of the local option law, Statutes 1911, page 599, and amendments thereto. RESOLVED further that at said special municipal election, that Proposition No. 2 was duly and regularly carried, and that the majority of votes cast are.in favor of Proposition No. 2, and it is therefore ordered and declared that Ordinance No. 41SL of the City of Newport Beach be passed to second reading, and thereafter to final adoption in the manner required 28 11 by law. . 30 32 32 ROLAND THOMPSON ATTORMET AT LAW b..P.
