RESOLUTION NO. �pl� WHEREAS, the city of Newport Beach did on or about the 7th day of November, 1932, grant unto one George C. Hiner, a lease or license of that certain pier located in the City of Newport Beach, and which extends into and over the waters of the Pacific Ocean, opposite McFadden Place in said city; and WHEREAS, by the provisions of said license or lease said City of Newport Beach granted to the said George C. Hiner the option or right to renew said lease or license upon the terms and conditions therein mentioned, and upon the consideration therein set forth; and WHEREAS, the said George C. Hiner has not renewed said lease for the reason that the amount therein specified, to —wit, the sum of $100.00 per month commencing October 1st, 1933, is in excess of the amount which he is able to earn on said pier under present conditions; and WHEREAS, the said George C. Hiner has always lived up to the terms and conditions of his agreements with the City of Newport Beach, and has in all respects rendered the public the service on said pier as in said license agreement provided for; and WHEREAS, the City of Newport Beach believes that it is for the best interests and benefit of said city that a new lease The given to the said George C. Hiner, upon the same conditions and terms as said lease of November 7, 1932. NOW, THEREFORE, BE IT RESOLVED:, That said license agreement of November 7th, 1932, between the city of Newport Beach and the said George C.'Hiner be, and the same is hereby cancelled and declared of no further force or effect whatsoever, and a new license agreement upon the same conditions and terms as the license agreem ent of November 7th, 1932, shall be given to the saidGeorge C. Hiner.
