CALIF. r' + RESOLUTION NO. WHEREAS, an Agreement dated the let day of March, 1934, between PACIFIC ELECTRIC RAILWAY COMPANY, a corporation, as Licensor, and CITY OF NEWPORT BEACH, therein termed Licensee, has been presented to the City Council of the City of Newport Beach, California; and WHEREAS, said Agreement provides that said Licensor grant to the Licensee the privilege to construct, maintain and operate a twelve inch (129) storm drain pipe for conveying storm drain waters, said structure to be placed beneath the right of way and under the tracts of said Licensor, near 57th Street station, Newport Beach Line, County of Orange, State of California, said structure to be of the following description and specifications: Under specifications as set forth in paragraphs 7 and 8 of said agreement, to which reference is hereby made for further particulars, for the consideration and under the terms in said agreement set forth; and WHEREAS, it is deemed for the best interests and benefit of said City of Newport Beach that said storm drain pipe be so constructed as above set forth. NOW, THEREFORE, BE IT RESOLVED: That the Mayor and City Clerk of the city of Newport Beach be, and they are hereby instruoted and authorized to sign said Agreement on behalf of the said City of Newport Beach.
