RESOLUTION NO. .o
WHEREAS, an agreement dated the 16th day of April
19 34 , between the Southern Pacific Company, a corporation of
the State of Kentucky, and its Lessor, Southern Pacific Railroad
Company, a corporation, collectively termed as first party, and
County of Orange, a political subdivision of the State of Calif
nia, and City of Newport Beach, a municipal corporation of the
State of California, therein termed collectively, second party,
has been presented to the City Council of the City of Newport
Beach, California; and
WHEREAS, said agreement provides that the first party
grants to the second party, subject to the conditions in said
agreement contained, the right to construct and maintain a
temporary highway upon and across that certain parcel of land
situated in Orange County, California, lying within the railroad
right of way of first party, and shown in tinted coloring on
blueprint attached to said agreement, reference being made
thereto for further particulars, which said agreement is upon the
terms and conditions therein set forth; and
WHEREAS, it is deemed for the benefit and best interests
of the city of Newport Beach that said temporary highway be
constructed, as above set forth.
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City
Clerk of the City of Newport Beach be, and they are hereby
instructed and authorized to sign said Agreement on behalf of the
said city of Newport Beach.
I hereby certify that the above and foregoing Resolution
was duly and regularly passed and adopted at a regular meeting
of the City Council of the City of Newport Beach, held on the
