RESOLUTION NO.
WHEREAS, application has been made to the City Council
of-the City of Newport Beach by certain interested parties for a
license or privilege for the period of one year, to load and un-
load passengers and patrons going to and from the City owned pier
extending into and over the waters of the Pacific Ocean, known
as the Balboa Pier and located southerly of South Main Street
in Balboa, California; and
WHEREAS, in the winter time there are insufficient live
bait boats to take care of patrons and Passengers,.while in the
summer time there is a superfluity of boats for said purpose; and
WHEREAS, many irresponsible operators of boats carry live
bait patrons in the summer time and the City of Newport Beach has
no regulation over said boats or the operators or owners thereof;
and
WHEREAS, the City Council of the city of Newport Beach
believes that it is for the best interests of the fishing public
and for the common benefit of the public, and as a police
regulation, to grant to one person the exclusive privilege of
using said pier for the loading and unloading of passengers to
from live bait boats; and
WHEREAS, the City Council of the city of Newport Beach
further believes that it is for the best interests of the City
and for the common benefit of the public generally that the
privilege and license herein mentioned be given to the highest,
best and most responsible bidder, pursuant to notice inviting bids
duly made and given.
NOW, THEREFORE, BE IT RESOLVED: That the City Clerk of
the City of Newport Beach be authorized and directed to give
Notice inviting bids for the privilege and license herein mention
in the form this day prepared by the City Attorney of the City of

Newport Beach, and which said form has been approved by the City
Council of the city of Newport Beach; and
BE IT FURTHER RESOLVED: That all bids shall be in
conformity with the specifications of the City Council on file
with the City Clerk of this Council, which specifications are
designated, "SPECIFICATIONS FOR ALL BIDDERS FOR LICENSE OR
PRIVILEGE FOR EXCLUSIVE RIGHT TO USE BALBOA PIER FOR CERTAIN
PURPOSES ".
I hereby certify that the above and foregoing
Resolution was duly and regularly passed and adopted by the City
Council of the city of Newport Beach at a regular a
meeting thereof held on the lit-6 day of February, 1 55, by
the following vote, to —wit:
