CALIF. r 1 RESOLUTION Noe 877 2 3 WHEREAS, it affirmatively appearing to the City 4 Council of the City of Newport Beach that the public interest and 5 necessity require the acquisition of the real property herein - 6 after described, for the widening of Central Avenue in said City 7 of Newport Beach, and that the property described hereafter is 8 necessary for such widening of said street. 9 NOW, THEREFORE, BE IT RESOLVED; by the City Council 10 of the City of Newport Beach, that the public interest and 11 necessity require, and it is hereby ordered that the following 12 acquisitions for the purpose of widening Central Avenue in said 13 City of Newport Beach, at the intersection of said Central 14 Avenue with Via Lido Street, in said city, be made, to —wit, the 15 acquisition of that certain real property situated in the City 16 of Newport Beach, County of Orange, State of California, mud 17 more particularly described as follows, to —wit: 18 A parcel of land located in the City of Newport Beach, Orange County, California, and more particularly 19 described as follows, to wit: 20 All that portion of Lot 3, Section 28, Township 6 South, Range 10 west, San Bernardino base and meridian 21 described as follows: Beginning at a point in the westerly line of Central Avenue, which point bears south 180 311 22 west 29.31 feet and south 220 551 west 449.59 feet along said westerly line of Central Avenue from the point of 23 intersection of the westerly line of Central Avenue with the ordinary high tide line of the Pacific Ocean in Newport 24 Bay and designated "SOUTH LINE" as established by a decree in Court Case No. 23686 of the Superior Court in and for 25 Orange County, California, a certified copy of which decree was recorded September 19, 1928, in Book 201, page 253, 26 Official Records of Orange County, California; running thence South 220 551 west along said westerly line of said 27 Central Avenue to its intersection with the easterly line of the -100 foot right of way of the Southern Pacific Railway 28 Company, a distance of 285.44 feet; thence northerly along the said easterly line of the 100 foot right of way along a 29 curve concave to the east and having a radius of 2814,83 feet, a distance of 184.75 feet to end of said curve; thence • 30 north 170 321 East along said easterly line of the 100 foot right of way and tangent to last mentioned curve 102.66 feet; 31 thence south 670 051 East 32.98 feet to the point of beginning , 32 containing 5202 square feet, more or less, of land. i ROLAND THOMPSON —1— ATTORNEY AT LAW SANTA ANA. CALIF. t 2 _ 31 41 51 6 7 8 9 10 n 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 • r BE IT FURTHER RESOLVED: That the City Attorney of the- City of Newport Beach be, and he is hereby ordered and directed to bring an action in the name of the city of Newport Beach in the Superior Court in and for Orange County, California, for the condemntation of the property necessary to be taken for the acquisition herein ordered, and heretofore described, and to do all things necessary to prosecute said action to final determin tion. BE IT FURTHER RESOLVED: That the public interest and convenience require, and it is hereby ordered that the city of Newport Beach, a municipal corporation of the sixth class, plaintiff in said condemnation action, take immediate-possession and use of the property herein ordered to be acquired, upon com- plying with the requirements of law applicable thereto, and that the said City Attorney report to this city Council the amounts o money required therefor, as soon as the same can be ascertained. BE IT FURTHER RESOLVED: That said action for condemna- tion of said property so to be acquired shall be taken in accordance with Section 14 of Article 1 of the Constitution of the State of California.
