RESOLUTION NO. � 0 WHEREAS, during the past week the waters of the Pacific Ocean at high tide have overflowed their banks between 12th Street and 19th Street in the city of Newport Beach; and WHEREAS, considerable damage has been done to the City Streets and other properties of the city of Newport Beach, by reason of said high tides between the points designated in said city of Newport Beach, and much private property in addition thereto has been imperiled by reason of said overflow; and WHEREAS, it is incumbent upon the City of Newport Beach to protect its streets and other public properties, and private properties of others, by erecting a proper embankment to keep the waters of the Pacific Ocean in its proper confines; and WHEREAS, it is necessary that work be done immediately for the purpose of erecting an embankment against the overflow of the waters of the Pacific Ocean at high tide, and there is no time for advertising for bids for the doing of said work as provided for by law; and WHEREAS, it is the opinion of the City Council of the City of Newport Beach that the high tides of the Pacific Ocean the overflow of water therefrom into and onto the streets and other public properties of the city of Newport Beach, and the private properties of others, constitutes and is a great public calamity and by reason theredf an emergency exists. NOW, THEREFORE, BE IT RESOLVED by the City Council of the city of Newport Beach that the public interest and necessity demand the immediate expenditure of public money to safeguard life, health and property in the city of Newport Beach, from the high tides of the Pacific Ocean, between 12th Street and 19th r .a 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18. 19 20 21 22 23 24 25 26 27 28 29 • 30 31 32 ROLAND THOMPSON ATTONNBY AT LAW BANTA ANA, CALIF. Street in said city; and BE IT FURTHER RESOLVED: That the City Engineer of the City of Newport Beach be, and he is hereby instructed and directed to hire and employ sufficient machinery and men for the purpose of constructing a sand leveealong the south edge of the board walk from 12th Street to 19th Street, said levee to be approximately three feet (3t) above the grade of the board walk. BE IT FURTHER RESOLVED: That the City Engineer of the City of Newport Beach be, and he is hereby instructed to immediately contract with the Standard Dredging Company, Central Building, Los Angeles, California, for the depositing of dredging materials south of said levee so to be constructed, and sufficient to secure a fill not higher than the board walk grade at the edge of the levee, the grade of the fill at the discharge pipe to run as close to the levee as possible, and shall not exceed four feet (40 above the grade of the board walk, all in accordance with the plans and specifications of the City Engineer of the City of Newport Beach herein on file, reference being made thereto for further particulars, and the same is by such reference made a part hereof. , BE IT FURTHER RESOLVED: That the sum ofIi ^,��,�,.�r, be and the same is hereby appropriated by the City Council of the City of Newport Beach for the purpose of.paying for the machinery, men and appliances necessary for the construction of said levee along the south edge of said board walk, between 12th and 19th Streets aforesaid, and for the further purpose of paying to the Standard Dredging Company for the sand to be used for said fill heretofore mentioned, south of said levee and between the streets aforesaid mentioned, said sand so to be deposited to be iii an amount not to exceed 200,000 cubic yards. _2_ 1 2 3 4' • 5 6 7 8 9 10 11 P 12 13' 14 15 W-11 17 18 19 21 BE IT FURTHER RESOLVED that the City Council of the City of Newport Beach shall have the right by and through its City Engineer, to order the Standard Dredging Company, at any time, to discontinue the filling and depositing of sand south of said levee aforesaid. BE IT FURTHER RESOLVED that the City Engineer of the City of Newport Beach complete all the work herein contemplated as soon as possible, in order that life, health and property in the city of Newport Beach be properly safeguarded, I hereby certify that the above and foregoing Resolution was duly and regularly passed and adopted by the City Council of the City of Newport Beach; at a regular meeting thereof held on the 3rd day of June, 1935, by the following vote, to -wit: AYES, COUNCILMEN: u NOES, COUNCILMEN: ABSENT, COUNCILMEN:"''t� ST. 23'; T WEW 24 25 27 28 29 30 31 32 ROLANO THOMPSON ATTORNEY AT NW BANTA ANA.
