RESOLUTION NO. e?Q
WHEREAS, there has this day been presented to the City
Council of the city of Newport Beach, a certain agreement
wherein the Southern pacific Company, a corporation, is the party
of the first part,.and the City of Newport Beach, a Municipal
corporation, is the party of the second part; and
WHEREAS, said agreement provides that the first party,
upon the terms and conditions in said agreement set forth, permits
the second party to construct, reconstruct, maintain and operate
One 18 -inch steel pipe for conveying sewage, at and in the city of
Newport Beach, Orange County, California, at the location
specified upon the map attached to said agreement, and as in said
agreement specifically set forth; and
WHEREAS, it is deemed for the benefit and best interests
of the city of Newport Beach that said agreement be entered into.
NOW, THEREFORE, BE IT RESOLDED.by the City Council of the
City of Newport Beach, that the Mayor and City Clerk of said City
be, and they are hereby di,reoted and authorized to execute said
agreement on- behalf of the City of Newport Beach, and that a duly
executed copy thereof be delivered to the first party.
.I hereby certify that the above and foregoing Resolution
was duly and regularly passed by the Oity Council of the city of
Newport Beach at a regular meeting thereof held on -the and day of
September, 1935, by the following vote, to -wilt:
