HomeMy WebLinkAbout911 - Channel Place Improvement• 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 &,k 7-77 P^6�e e4 9 -17 -3 s- RESOLUTION NO. 911 RESOLUTION ORDERING IMPROVEMENT � 3 WHEREAS, the City Council of the City of Newport Beach on the 5th day of August, 1935, passed its Resolution of Intention No. 900 to order the hereinafter improvement to be made and public work to be done in the City of Newport Beach; and WHEREAS, after the passage and adoption of Resolution of Intention No. 900, the Street Superintendent of the City of Newport Beach caused to be conspicuously posted along the line of the contemplated work and improvement at not more than three hundred (300) feet in distance apart, and 26 in all, notices of the passage of said Resolution of Intention, headed "NOTICE OF PUBLIC WORK ", in the manner, form and substance as required by law, and said Street Superintendent also caused a notice similar in substance to be published for a period of four (4) weeks, in NEWPORT NEWS, a weekly newspaper, printed, published and circulated in the City of Newport Beach, and named by said City Council in said Resolution of Intention as the paper in which said notice should appear, all as appears from the affidavit of S. A. Meyer, of the printers and publisher of said weekly news - paper,.and which affidavit was filed in the office of the Clerk of the City of Newport Beach on the 29th day of August, 1935, and is now on file therein; and WHEREAS, the Street Superintendent of the City of �lNewport Beach commenced the posting of the notice hereinbefore referred to on the 19th day of August, 1935, and fully completed the posting thereof on the 19th day of August, 1935, as appears from the affidavit of John A. Siegel, Assistant Street Superin- Itendent of the City of Newport Beach, and more than ten (10) days ving expired after the expiration of the time of the publics- 11 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 • 28 tion of said notice within which protests or objections to the proposed work or improvement might be made by any person interest- ed objecting to said work or improvement, or to the extent of the district or lands to be affected or benefitted by said work or improvement and to be assessed to pay the cost and expenses thereof; and WHEREAS, at the next meeting of the City Council after the expiration of said ten days after the expiration of the time of the publication of said notice, no objection to said work or improvement having been made or on file, why said pro- posed impr"ovement should not be carried out in accordance with said Resolution of Intention, the City Council of the City of Newport Beach having now acquired jurisdiction to order the said improvement; IT IS HEREBY RESOLVED AND ORDERED: That the public interest and convenience requires the work hereinafter described and the City Council of the City of Newport Beach hereby orders the following work to be done and improvement made in the City of Newport Beach as follows: That the following portion of Channel Place in the City of Newport Beach as hereinafter described be closed up and abandoned, to -wit: All that portion of the northeasterly one -half of Place, as said Channel Place is laid out and shown upon map of Canal Section, recorded in Book 4, page 98, Miscellane- Maps, Records of Orange County, California, lying southwest - of and adjacent to Lot 15, Block 441 of said Canal Section extending between a line perpendicular to the southwesterly 29 ine of said Lot 15, which line is 17 feet northwesterly, meas- 30 ed along the southwesterly line of said Lot 15 from the most 31 ��outherly. corner of said Lot 15, and a line perpendicular to said 32 1�outhwesterly line of said Lot 15, which line is 90.53 feet 2. All of which is more clearly shown on a certain map approved and adopted by the City Council of the City of Newport Beach for said abandonment by Resolution No, 899 on the 5th day of August, 1935• i The public work ordered and the improvement to be i { made is for the purpose of closing up and abandoning a portion of Channel Place as hereinbefore described, and for that reason no district is chargeable for costs in connection therewith. All of the herein proposed work shall be done in j pursuance of an Act of the Legislature of the State of California, designated "Street Opening Act of 158911, and amendments thereto. For further particulars reference is hereby made to !{ said_Resolution of Intention No. 900, which is dated the 5th day of August, 1935, and on file with the Clerk of the City of New- port,Beach. The Glerk of the City of Newport Beach is herewith instructed to record a copy of -this Resolution Ordering Improve- ment in the Office of the County Recorder of the County of Orange, State of California. I hereby certify that the foregoing Resolution Order- ing Improvement No. 911 was duly introduced and regularly passed and adopted by the City Council of the City of Newport Beach at a regular adjourned meeting thereof held on the 16th day of Sept- ember, 1935, by the following vote, to -wit: AYES: COUNCILMEN Gordon, Claire, Ellsworth, Garfield, Hilmer.
