RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH, CALIFORNIA, DE-
TERMINING THAT CERTAIN ALTERATIONS OR
CHANGES BE MADE IN'THE PLANS FOR THE
PROPOSED CONSTRUCTION OF REINFORCED CON-
CRETE BULKHEAD AND OTHER WORK IN AND
AROUND BALBOA ISLAND IN SAID CITY.
WHEREAS, pursuant to the provisions of the "Special
Assessment Investigation, Limitation and Majority Protest
Act of 1931," as amended, the City Council of the City of
Newport Beach,a t its meeting held on the 30th day of
September, 1935, and at the conclusion of the hearing, made
its findings and determinations on the written report there-
tofore filed by the City Engineer of said City, in the
matter of the proposed construction of reinforced concrete
bulkhead and other work and improvement in and around Balboa
Island in said City; and
WHEREAS, Section 9 of the "Special Assessment Investiga-
tion, Limitation and Majority Protest Act of 1931," as amended,
provides that the legislative body may, in its discretion,
and without further notice or hearing, make such alterations
or changes as will not exceed in amount one -tenth of the total
estimated cost as shown in said written report, and that the
person who prepares the plans and specifications shall estimate
separately the cost of each addition to, or omission from,
the things proposed to be done, as said things are set forth
in said report; and
WHEREAS, the said City Council, pursuant to the recom-
mendation of the City Engineer, deems it advisable to make
certain alterations or changes in the proposed plans, as
recommended by said City Engineer in his communication filed
with this City Council, November 12, 1935, which communication
shows the estimated amount of each change or addition to and
omissions from the things proposed to be done as set forth
in said written report;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF NEWPORT BEACH, AS FOLLOWS:
(A) That the plans herein referred to be changed and
modified by adding thereto the following:
1. The construction of a reinforced concrete
coping on top of the existing concrete
bulkhead in South Bay Front, between the
southeasterly line of Emerald Avenue and a
line 2.50 feet northeasterly from the south-
westerly line of Park Avenue.
2. The construction of cement concrete sidewalk
in South Bay Front, between the southeasterly
line of Emerald.Avenue and a line 2950 feet
northeasterly from the southwesterly line
of Park Avenue.
3. The moving and replacing of two existing
light posts on top of the concrete coping
above described.
4. That the lighting conduit shown in said
written report to be placed underground in
South Bay Front between Emerald Avenue and
Park Avenue, be changed to provide that
said conduit shall be installed in the said
concrete coping herein described between
said points.
5. That the location of the public pier along
North Bay Front at Apolena Avenue, be
changed to the location of Sapphire Avenue
at said North Bay Front.
(B) That the plans herein referred to be changed and
modified by omitting therefrom the following:

1. That a strip of sidewalk three (3) feet in
width be omitted from South Bay Front between
the easterly line of.Onyx Avenue a nd a line
10.00 feet easterly from the westerly line
of Apolena Avenue.
2. That a strip of sidewalk three (3) feet in
width be omitted from North Bay Front opposite
Lots 16 and 17 in Block 14 of Section 3,
Balboa Island.
That the City Engineer is hereby instructed to modify
the plans for the proposed improvement in accordance with
his.recommendation filed November 12, 1935, and as directed
by this Resolution.
That the City Clerk be and he is hereby instructed to
attach a copy of the City Engineers recommendation, together
with a copy of this Resolution, to the written report of the
said City Engineer.herein referred to.
PASSED AND ADOPTED by the City Council of the City of
Newport Beach, California, at a regular meeting thereof held
on the day of November, 1935, by the following vote, to -wit:
