RESOLUTION NO. I
WHEREAS, a contract has been let by the State of-
California, for the purpose of constructing a grade separation
at the Arches, Newport Beach, California, at Station 5 +80,
0. R. A. 43 —A; and
WHEREAS, on account of said construction it will
be necessary for the City of Newport Beach to relocate a portion
of its sewer line, in order to properly provide for sewage
disposal in the future in said City of Newport Beach; and
WHEREAS, it would be exceedingly expensive, if not
impossible, to relocate said line after the construction of the
work heretofore mentioned, or to construct said line after the
completion of said work heretofore mentioned, because of the
depth required for the installation of said sewer; and
WHEREAS, work has been commenced on said grade
separation and the City of Newport Beach has not time in which
to call for bids as required by law, for the laying and
construction of said sewer; and
WHEREAS, in the opinion of the City Council of the
City of Newport Beach it is necessary that said work of
constructing said sewer be commenced immediately in order to
safeguard life, health and property and.by reason of said facts,
the City Council finds and determines that an emergency exists.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach: That the public interest and
necessity demand the immediate expenditure of public money
for the purpose specified in this resolution, in order that life,
health and property in the City of Newport Beach may be
safeguarded and protected.
