RESOLUTION NO.
WHEREAS, there has this day been presented to the
City Council of the city of Newport Beach, a certain agreement
dated the 21st day of September, 1936, by and between the City
of Newport Beach, as first party, and the Pacific Electric Railway
Company, a corporation, second party; and
WHEREAS, said second party owns and operates a line
of railroad in the city of Newport Beach, known as the Newport
Beach line; and
WHEREAS, the Railroad Commission of the State of
California has granted the first party permission to construct
i
grade crossing No. 6E- 35.91, at Orange Street, requiring
second party to make certain structural changes in its tracks
and appurtenances at said crossing; and
WHEREAS, the parties to said agreement have reached
I an understanding as to the matters set forth above, which said
understanding and agreement is specifically set forth and
described in full in said agreement; and
WHEREAS, it is deemed for the best interests of the
City of Newport Beach that said agreement be entered into
upon the terms and conditions, and for the considerations in
said agreement set forth.
NOW, THEREFORE, BE IT RESOLVED: That the Mayor and
City Clerk of the City of Newport Beach be, and they are hereby
directed and authorized to sign and execute saidagreement in
the name of and on behalf of the City of Newport Beach.

Resolution was duly and regularly passed and adopt by the
