HomeMy WebLinkAbout1234 - Marine Avenue Wideningt 1 I RESOLUTION NO. 0 . r 21 3 11 WHEREAS, by Chapter 1, Part 7, Division 2 of the 4 IlLabor Code Statutes of 1937, it is provided that not less than 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 the general prevailing rate of per diem wages for work of a similar character in the locality in which the work is performed, and not less than the general prevailing rate of per diem wages for legal holiday and overtime work shall be paid to all labor- ers, workmen and mechanics employed by or on behalf of any city in the State of California engaged in the construction of public works, exclusive of maintenance work; and WHEREAS, it is further provided that the public body awarding any contract for public work on behalf of a city shall ascertain the general prevailing rate of per diem wages in the locality in which work is to he performed for each craft or type of workman or mechanic needed to execute the contract; and WHEREAS, the City of Newport Beach is about to call for �.t boo bids for the widening of Marine Avenue northerly of Paris Avenue on Balboa Island, which notice is to be given pursuant to stat- ute and resolution of the City Council of the City of Newport Beach. Provided that double the prevailing rate shall be paid (except watchmen and guards) for any working time more than eight (8) hours during any one calendar day where such work is required in cases of extraordinary emergency caused by fire, flood or danger to life or property, and for time on Sundays and the seven legal holidays, to -wit: New Years Day, Memorial Day, 4th of July, Labor Day, Armistice Day, and Thanksgiving Day and Christmas* The foregoing prevailing wage schedules are based upon the working day of eight (8) hours, and in the event that labor - ersy workmen or mechanics are employed less than eight (8) hours per day, the rate of per diem wages shall be deemed to be that fraction of the foregoing rates that the number of hours of em- ployment bears to eight (8).
